Undertaking by William de Middelton, clerk, that if Sir Adam de Strattone, clerk, should at any time be impleaded in the King's court concerning a messuage, land, and tenement, which William had in Tyteberst, in the parish of Aldenham, of the grant of Emma late the wife of Walter de Camera, and which he had granted to the said Sir Adam, and if without default of his own he should fairly lose the suit, that then the said William should be bound to pay him 30 marks within a month after notice given; with further undertaking to acquit him whether against Jew or Jewess as to any debt concerning the said premises. Surrey to Ralph Egerton, esquire, and Richard Haukyn, vicar of the church of Madeley under Lyme, co. Stafford, for five years, of the rectory of Drayton in Halys, co. Salop, with a yearly pension of 40s. to be received from the abbot and convent of Comburmere, and all other profits except the advowson of the vicarage of the same; the grantees to pay yearly 19l. to the said prior and convent, and to lay out yearly, on Holy Thursday, at their own expense, thirteen 'strikes' of corn and 13d. by view of the vicar there, upon thirteen of the most needy parishioners as the alms of the said prior and convent; if the grantees fulfil all the agreements, then a bond entered into by them and others named, for 40l. to the said prior and convent, shall be void. Lancaster, yeomen, of the manor and lordship of Smalwood; witnessing that if John Dodd of Egerton, yeoman, shall, in the presence of three witnesses, pay to the said grantees 100l. in order to make the said grant void, then it shall be lawful for the said Edward to re-enter upon the said premises. 8 October, 41 Elizabeth. Demise by Sir Lawrence de Sanford, to Sir Gilbert de Donteseye, for his life, of all his land in Donteseye, Tydovere, Smythecote, Bremelham, and Wyvelesford, and if Gilbert die in the lifetime of his brother, Richard de Donteseye, the said Richard and his heirs by his wife shall hold all the grantor's land in Smythecote, Bremelham, and Wyvelesford; with further demise to the said Richard, for his life, of the manors of Donteseye and Tydovere; the said Gilbert and Richard to have power to sell and make grants from the wood of Donteseye, each in the time of his possession, reserving to the said Laurence the soil of the said wood. Defeasance of a statute staple of Westminster, of even date, by William Hollys and William Dauntesey, citizens and mercers of London, and merchants of the staple at Calais, to John Halle, citizen and grocer of London, and merchant of the staple of Calais, for 300l.; witnessing that if the said Hollys, and Dauntesey shall pay to the said Halle, yearly, for his life, 20l. within the church of St Thomas of Acon, in the ward of Westchepe, London, on the altar of St. Thomas the Martyr "sett in the body of the same chirche," at the dates specified, then the said bond shall be void. 19 November, 19 Henry VIII. [York. W.R.] A. 6783. Grant by Gilbert Basset, to Philip Basset, his brother, of all the land in Lede which Thomas Basset, brother of Gilbert, held from the constable of Chester, viz. two parts of the said town; doing such foreign service to the grantor as belongs to the fourth part of one knight's fee, and rendering yearly, at Michaelmas, one mewed (mutarium) sparrow- hawk. Gilbert and his heirs will warrant the said land to Philip and his heirs, begotten on his wife; and if they shall be unable to warrant the same, they will make him an exchange, that same namely which the constable of Chester made to them. Demise by Robert de Derbia, chaplain, to John de Milton, citizen of London, for five years, of a messuage, two crofts, and land, in the prebend of Oxegate, part of the land abutting on the lane called 'Loverdeslane' parts on 'la Dene,' and part on Crokeslane, but if the said John shall pay 4 marks 11s. in Robert's name to Edward Britzwelle of Willesdon, he shall continue to hold the premises in fee for ever; the said Edward having demised the said messuage &c. to Robert, for the said term, from Trinity 32 Edward I. with the agreement that the premises were to remain to Robert in fee, if he should pay the said Edward the above sum, within the said term.
