Memorandum of defeasance, upon condition that before the feast of St. Gregory the Pope John Smyth shall cause 10,000 tiles according to sample to be brought to 'Templebrugge' London and there unladed to the said Robert's use, and other 10,000 before 1 May next, for which the said Robert has paid 40s., and shall pay 40s. on delivery of the first 10,000, and 20s. on delivery of the residue.

Hertford, now held of the grantor's heritage by the said Walter during the life of Parnell who was wife of the said butler. Walter Arderne of Farnham co. Essex and John Sweyn of Walden clerk. Indenture reciting (the foregoing quitclaim and warranty), and witnessing covenants that, if the said Walter, his heirs or assigns, shall be impleaded concerning (the premises) in Therefeld, Bokelond and Berlee or parcel thereof, and shall vouch the said John to warranty, and he shall be ready to warrant the same, and if having entered for the purpose the said John shall further vouch Richard Giles or his heirs, and shall at the costs and by appointment of the said Walter prosecute that warranty so far as he lawfully may, he shall not be bound to make up the value of the premises though the same or parcel thereof be recovered against the said defendants; and that if the said John shall recover his warranty against the said Richard or his heirs he shall at the costs of the said Walter sue for execution thereof as speedily as the law will suffer him, and shall hereby be bound to the said Walter, his heirs and assigns, for so much as by judgment of the king's court he shall thereupon recover from the said Richard.
