Memorandum of defeasance, upon condition that they pay a moiety of that sum at the day named.

Thomas Makwilliam citizen and grocer of London to the said John and John. (Like) recognisance.
John Ravenser and John Lincoln clerks of the one part, Thomas Frith esquire and Thomas Makewilliam citizen and grocer of London of the other part. Indenture of defeasance of the foregoing recognisances, made by reason of debates between the said Thomas and Thomas concerning lands in Great Gelham co. Essex and other matters, upon condition that they shall both abide the award of John Wodroue, Robert Heth, John Rokell, William Gildrith, John Gouncy and Edmund Bendissh by them chosen, or of an umpire chosen by the arbitrators in case they may not agree, the award day to be at Westminster on Thursday three weeks after Michaelmas next, or between that date and Easter following, that all causes or pleas between them pending shall be continued by consent until Easter aforesaid, that another arbitrator shall be chosen in case one of them be not able to attend, that in the meantime Thomas Makewilliam shall hold a little pasture lying near his field against 'Lariottes place,' neither committing a grievance against the other by depasturing or escape of cattle upon the other parcels, and that if either make default he shall incur the pain in the recognisance aforesaid. Charter of the manor of Pappeworth Everard, which the grantors had by grant of Thomas vicar of Foxton by virtue of a fine levied in the late king's court between the said Thomas, Lawrence Breuley knight, John Granceste and William Castelacre plaintiffs and John Dengayne and Margaret then his wife deforciants, whereby the deforciants acknowledged the plaintiffs' right etc.; and grant that in case the said Joan shall overlive her husband she shall be quit of action for waste therein. Memorandum of an undertaking under a pain of 100l., made in chancery at Westminster 2 September by the said prior, that he shall do nought by himself or others to hinder the force of such ordinance, but shall prosecute his suit by process of law, or by agreement.

Order on sight etc. to cause proclamation to be made that all lords, knights, esquires and other the fencible men of the duchy shall before the last day of August hasten to draw toward the king's person in as great force as they may in order to overcome the king's enemies of Scotland, that the king and his lieges may be delivered from the straits and vexation caused by their treachery and rebellion; as the king has particular information that the Scots and their adherents gathered in a great host have invaded the realm, burning, wasting and slaying men, women and children in the cradle, and have advanced almost to the city of York, to the disgrace of the king and realm; and by advice and assent of the council the king is hastening to march against them in person. The king will render thanks to the lords etc. who will march with him in his army, and he will deservedly commend their loyalty. By K. and C.

Northampton.

Order to cause proclamation to be made that all the lords, knights, esquires and other the fencible men of the duchy, and all those of their retinue dwelling in that county (sic), whom by letters of the privy seal the king warned to come to his person, shall wait at home ready upon reasonable warning to march with him in his army at another time in like case, although lately the king ordered proclamation to be made that they should all hasten to draw to his person before the last day of August in order to overcome his enemies of Scotland; as the king has particular information that the Scots have now newly withdrawn out of the realm. Memorandum that on 27 August this year before the council James Dardani canon of Tropea, collector in England of the profits of pope Urban [VI], made oath upon the gospels (text follows) of allegiance to the king, that he should do or procure nought, and so far as in him lay should suffer nought to be done to the hurt or prejudice of the king, the realm and the laws, that he should give the king true counsel when required, and keep secret the king's counsel, that he should execute no letters or commands of the pope which might be to the prejudice of the king etc., and suffer none to be executed, that he should receive no letters of the pope or other without delivering them to the council before publication or delivery to any man, should send out of the realm no treasure of the king and no duty of the pope, a cardinal or any other in money or plate of gold or silver, by letters of exchange or otherwise without special licence of the king or council, nor letters contrary to the premises, that he should keep and maintain the king's honour and estate and the laws, that he should demand or levy no first fruits of benefices given by the king, or now or hereafter granted in expectation by the pope, making no processes for that cause and introducing nothing new with or without command save by the will and with special licence of the king, and without first shewing the cause or command to the king or council, and that he should not depart out of the realm without special licence of the king, and that by letters or writs under the great seal.

To the mayor and bailiffs of Bristol. Order at their peril on sight etc. to cause proclamation to be made forbidding any merchant alien or native or any other person under pain of forfeiting the same to take out of the realm without special licence of the king any gold or silver in money, the lump or plate; and order to make search of those passing from time to time in that port, merchants and others, that they take none contrary to this prohibition; as the king has learned that many merchants and others have so taken great sums contrary to his prohibition, having received the same for merchandise brought to England and sold in Bristol.

Writ of supersedeas, with assent of the council and of the prelates and lords in this parliament, upon the petition of the prior and convent of the abbey of St. Augustine Canterbury, in respect of their demand upon the petitioners for the moiety of a tenth and fifteenth granted to the king by the commons in the parliament last holden at Westminster payable upon the temporalities of the abbey, which are in the king's hand by the death of the last abbot, and order to discharge them and the collectors thereof; as in consideration of the great farm which they are bound to render for the said temporalities in this vacancy, that the abbey is of the foundation of former kings and of his patronage, and that it is burdened with debt, the king, with the assent aforesaid, has pardoned them the said moiety.

Writ of supersedeas in respect of their demand against Roger Walden to answer or account for a third part of five ships of Spain lately taken at sea by the king's admirals and brought to Sandewich, and of goods and merchandise therein to no small value, whereof the third part pertains to the king, or for other enemies' ships and goods taken at sea by the admirals and other lieges in the king's service at his wages, by reason of the king's commission of 4 June 10 Richard II to Simon de Burle late constable of Dovorre castle and warden of the Cinque Ports, Baldwin de Radyngton controller of the king's household, the said Roger and William Hauney his clerks to survey the said ships and goods and any other which should be taken as aforesaid, to take in his name the third part thereof to the king pertaining, and to safe keep the same until further order, and order to proceed nevertheless against other commissioners who meddled therein; as that commission was not delivered to the said Roger, neither did he receive it for execution, nor meddle in aught therein contained, as the king is informed by credible witness.
