To the justices of the Bench. Writ of supersedeas until further order in respect of the plea hereinafter mentioned; as a fine levied, it is said, in the late king's court at Westminster one month after Easter 13 Edward III between Ralph Basset of Weldoun knight plaintiff and Roger Basset parson of Arthyngworth and Henry son of Philip Trayly deforciants of the manors of Weldoun and Weston by Asshele, eleven messuages, 6½ virgates of land and 70s. of rent in Weldoun and 76s. of rent in Weston excepted, and of the advowson of the priory of la Launde, whereby the plaintiff acknowledged the right of the said Roger, and the deforciants granted the same to the plaintiff for life, with remainder to Ralph his son and Joan daughter of Richard de la Pole citizen of London and to the heirs male of their bodies, remainder to the plaintiff's right heirs; and although by averment of John de Aylesbury knight and John Knyvet, cousins and heirs of the said plaintiff as they say, the king has learned that he is now dead, that Ralph the son and Joan are dead without male issue of her body by him, and that Richard Basset has entered two thirds of the premises with the exceptions aforesaid, and John Clisseby and Eleanor his wife a third part, and are severally holding the same contrary to the form of the said fine, willing that acts in the late king's court be duly put in execution, the king ordered the sheriff of Norhampton to give notice to the said Richard, John and Eleanor to be before the said justices at Westminster in the octaves of St. Martin in order severally to shew cause wherefore the several portions of the premises by them held ought not to remain to the said John de Aylesbury and John Knyvet; but upon the finding of an inquisition, taken before John Tyndale late escheator, that Ralph Basset of Weldoun knight, who was son and heir of the said Ralph and Joan it is said, at his death held the said manors in chief by name of the manors of Weldoun and Weston upon Wylonde, and that the said Richard, who is within age and in ward of the king, is his son and next heir, the same are among other lands of the deceased taken into the king's hand, so to remain until the lawful age of the heir, and the king is bound to render their lands whole to such heirs, when they shall come of age, or at least as he received the same; and after deliberation in chancery with the said justices and other justices and them of the council learned in the law, and hearing of divers arguments and allegations for the king and the parties, it seemed to them and the other justices that the plea ought not to proceed during the nonage of the said Richard.
