To Polidorus, archbishop of Zara (Iadren.), residing in the Roman court, Mandate, at the recent petition of William Wodman, priest, of the diocese of St. Andrews, M.A. (containing that a cause arose lately between him and the late John Ker, clerk, of the said diocese, about the perpetual vicarage of Hadynton in the said diocese, provision of which William alleged to have been made to him by papal authority, which provision John opposed and prevented from taking effect, intruding himself and detaining possession; that the present pope, at William's instance, committed the cause, although not lawfully devolved to the Roman court, to Gabriel, bishop of Capo d'Istria (Justinopolitan.), residing in the said court, and afterwards to the above Polidorus, then bishop of Bergamo (Pergamen.), residing in the said court, the latter of whom has proceeded short of a conclusion; and adding that, whilst the cause has been pending, John has died in possession) to surrogate the said William, who is a kinsman of James, bishop of St. Andrews, to all John's right, and to make collation and provision to him thereof, etc., and moreover to collate and assign to him the said vicarage itself, value not exceeding 16l. sterling.Litterarum etc. (—. xxvi. To the bishops of Lincoln and Bath and the prior of Holy Trinity, London. Mandate, at the recent petition of Robert Stillyngton, rector of Aysshbury in the diocese of Salisbury, doctor of laws (containing that although he canonically obtained the said church and possession thereof, and has held it for some time with all its rights and appurtenances, Thomas Gay, layman, of the city of London, has taken fruits, tithes etc. belonging to the said rector by reason of the said church, and he and William Rylpyn, priest, of the diocese of York, the administrators of the late William Skelton, sometime rector of the said church, refuse to repair etc. the chancel thereof, the rector's principal house, and other houses etc. and buildings within the parish and belonging to the said church, which repair pertained to the said William and now pertains to the said administrators by law and custom of the country; and adding that the merits of the case can be better and more easily made clear in those parts than in the Roman court), to summon the said Thomas and William and others concerned, and hear and decide all causes arising out of the above, causing their decision to be observed by ecclesiastical censure. Confirmation, at the recent petition of the master and wardens and other members of the art or mistery of drapers of Coventry (fn. 2) (containing that formerly in the parish church of St. Michael the Archangel, Coventry, on the north side of the choir, there were two contiguous chapels, one of St. Mary the Virgin, the other of All Saints, but that the parishioners, wishing to enlarge the church, have destroyed them, turned the place where they had been into the nave of the church, built another chapel of St. Mary the Virgin and All Saints also on the north side of the choir, and had it dedicated by the ordinary), of the said demolition and building; grant and assignment to the said newly built chapel of all the property of the said two demolished chapels; mandate, under pain of ipso facto excommunication. absolution from which can be granted by the pope alone, except in the hour of death, that the chaplain of St. Mary the Virgin commonly called ‘Seynr [sic] Mary preste’ and the other chaplains of the said demolished chapels shall celebrate masses in the said newly built chapel, and serve it, and bear all its burdens, as they did in the said demolished chapels; grant to the said newly built chapel of the enjoyment of all privileges, indulgences, indults etc. granted by the apostolic see or otherwise to the said demolished chapels, especially in regard to the three chaplaincies formerly founded in the said chapel of St. Mary the Virgin; and mandate to the bishop of Coventry and the abbots of Kyllyngworth alias Kenelworth and Stonley in the diocese of Coventry to execute the foregoing. Mandate, at the recent petition of John Arrous, a canon of Dunkeld, doctor of canon law (containing that on the voidance of the archdeaconry of Glasgow, a non-major dignity, by the death of George Borthwyke, James, king of Scots, alleging that by ancient custom the presentation during voidance of the see of Glasgow, even for a whole year from such voidance, belonged to the king, presented for the said archdeaconry (which had become void within such year, and after provision had been made to William, [now] bishop of Glasgow, of that see, then void) the above John to the said bishop William, who instituted him or made him collation and provision, in virtue of which he obtained possession, which he still holds, but the validity of which presentation etc. he now doubts), to collate and assign to the said John the said archdeaconry, not elective and not with cure, value not exceeding 50l. sterling, still void as above; notwithstanding that John (who was lately dispensed by papal authority to hold for life any two benefices with cure or otherwise incompatible etc., and to resign them, simply or for exchange, as often as he pleased, provided that he did not hold two parish churches or their perpetual vicarages, or one of each) holds a canonry of Dunkeld and the prebend of Forgoyndeny and the perpetual vicarage of Largow in the diocese of St. Andrews, value altogether not exceeding 35l. sterling. To the archdeacon of Glasgow. Mandate, as below. Upon the voidance of a canonry of Glasgow and the prebend of Tarbolton by the resignation to the pope of James de Douglas, the pope made provision thereof, previously reserved, to Richard Cady, then holding the parish church of Lochmaban in the diocese of Glasgow, which the pope required him, as he also offered, to resign upon obtaining the said canonry and prebend. The recent petition of Alexander Waus, clerk, of the diocese of Whiteherne, contained that, the said parish church becoming void by the said Richard's resignation to William, bishop of Glasgow, before obtaining the said canonry and prebend, the said bishop erected it into a canonry and prebend of the church of Lyncloudane in the said diocese, without the consent of the chapter thereof, and made collation and provision of them to Thomas de Spens, [now] elect of Whiteherne, then a notary of the present pope and of lower rank (fn. 4); that the said canonry and prebend (after the said Thomas, [now] elect, then a notary, had obtained possession by virtue of the said collation and provision, and had held possession for about three years, and before provision had been made to him by the present pope of the said see) became void by the resignation of the said elect, then a notary (who had faculty to resign his benefices, without the Roman court, simply or for exchange, to any ecclesiastical person holding a dignity, and for such person to receive such resignations and make collation of such benefices to others) to Andrew Durisder, dean of Aberdeen, who in virtue of the said faculty admitted the resignation, and that the said Andrew, dean [made collation and provision of the said] canonry and prebend [void by the said resignation, to the above Alexander Waus, who in virtue thereof] obtained and still holds possession (fn. 5). At the said petition, adding that the said Alexander doubts whether the said erection and the said collation and provision made to himself hold good, the pope orders the above archdeacon, if he find the facts to be as stated, to confirm the said erection and its consequences, and in that event to collate and assign pro tutiori cautela the said canonry and prebend, value not exceeding 25l. sterling, to the said Alexander.
