1453[-4]. 4 Id. March. (12 March.) St. Peter's, Rome. (f. 71.)	To the abbot of Lindores in the diocese of St. Andrews, and the chancellor and the treasurer of Moray. Mandate, as below. The petition of John Benale, prior of the Benedictine priory of Urcharde, contained that the fruits etc. of the said priory and of that of Pluscardyn, of the order of Val-des-Choux, both of them in the diocese of Moray, both of them conventual, with cure and elective, and of the foundation of kings of Scotland, have been by wars etc., past and present, so much diminished that the priors and religious thereof cannot be decently maintained and their buildings finished and others erected and repaired etc., and that the divine office therein is not becomingly carried on, especially because in Pluscardyn there are not more than six, and in Urcharde not more than two religious living with the said priors; and added that if the said priory of Pluscardyn (which is more worthy, whose buildings are more easy of repair, and which depends on the conventual priory of Val-des-Choux in the diocese of Langres) were separated therefrom, had the order of Val-des-Choux suppressed in it and that of St. Benedict substituted, if to it were united the said priory of Urcharde, dependent on the Benedictine monastery of Dunfermelyne, and if the said priory of Pluscardyn were made dependent on the said monastery, etc. divine worship in the said priories, thus united and making one convent, would be greatly increased etc. The pope therefore, having learned moreover that Andrew Haag, the present prior of Pluscardyn, with a view to the foregoing taking effect, proposes to resign, orders (at the petitions also of James, king of Scots, John, bishop of Moray, the ordinary, the abbot of the said monastery, the convents of the same and of the said priories, and of the said Andrew and John Benale) the above to receive the said Andrew's resignation and, after making a fit compensation to the said prior and convent of Val-des-Choux, to separate the said priory of Pluscardyn from that of Val-des-Choux, substitute therein the order of St. Benedict for that of Val-des-Choux. decree the said priory of Pluscardyn to be dependent on the said monastery [of Dunfermelyne], unite in perpetuity to the said priory of Pluscardyn that of Urcharde, the yearly value of each not exceeding 50l. sterling, collate and assign the said priory of Pluscardyn to the said John Benale, and reserve to the said Andrew a yearly pension of 12½l. sterling, to be paid at Pluscardyn, half at Christmas and half at St. John Baptist's, with food for himself and a servant. He further decrees that at future voidances the election of the priory of Pluscardyn shall, when there are no papal reservations, belong to its convent or, by lapse, to the convent of the said monastery [of Dunfermelyne], etc. Ad apicem a postolice dignitatis. Indult for life to him, who is Henry, king of England's great almoner, to take and to rent, let and grant to farm or yearly pension to any persons, even laymen, the fruits of his benefices, whilst studying letters at an university, or being in the service of the said king, or residing in the Roman court or any of his benefices: with mandate executory hereby to the bishops of Worcester and Condom (Condomieu.) and the archdeacon of Canterbury. 1450. 3 Non. May. (5 May.) St. Peter's, Rome. (f 117.)	To Laurence Pyot, precentor (cantori) of Moray. Confirmation etc., as below. His recent petition contained that formerly, on the voidance of the precentorship of Moray by the resignation of the late Andrew de Tulach, made by his proctor Andrew Fyffe, then perpetual vicar of Marinton in the diocese of Brechin, to Thomas de Edynhame, a canon of Aberdeen, the said Thomas, who had special commission from John, bishop of Moray, in accordance therewith made collation and provision of the said precentorship, together with its annexed canonry and prebend, to Laurence, who in virtue thereof obtained possession and still holds it. At Laurence's said petition, adding that some doubt the validity of the said collation and provision, the pope confirms the same, and moreover, for greater safeguard (pro potiori cautela), hereby makes collation and provision to him of the said precentorship, a non-major, non-elective dignity with cure, value not exceeding 50l. sterling, whether it became void as stated, or by the death at the apostolic see of Adam de Hamylton, or by the resignation of William Hog or Andrew Durisder. to whom successively provision thereof was made or ordered to be made by papal authority, or by the resignation of the late Richard Clepham to whom provision was likewise made or granted to be made, by the same authority, or by the resignation of the said Andrew Tulach, or by his death, or in any other way. To William de Elphinston(e), a canon of Dunkeld, M.A.Motu propriocollation and provision to him, who is by both parents of a race of barons, and is also a bachelor of laws, of a canonry of Dunkeld, with reservation to the pope's gift, for collation to him, of a prebend and a dignity etc. thereof, not being a major dignity, and reservation of a benefice with or without cure, wont to be assigned to secular clerks, value not exceeding 25l. sterling if it be with cure, or 18l. if without, in the collation etc. of the abbot and convent of the Benedictine monastery of Kelso in the diocese of St. Andrews. Collation and provision to him, who is by both parents of noble birth and is a kinsman of James, king of Scots, of the deanery of Brechin, a major elective dignity with cure, value not exceeding 30l. sterling. void by the death of David Crannoch, and reserved under the pope's late general reservation of all cathedral major dignities; with mandate executory hereby to the bishop of St. Andrews and the officials of St. Andrews and Brechin to induct him, after receiving from him the usual oath of fealty to the pope and the Roman church, the form of which is appended. Upon obtaining possession of the said deanery he is, as he has offered, to resign the canonry and prebend of Banchredeueny in Aberdeen, value not exceeding 15l. sterling. 10 Kal. April. (23 March.) St. Peter's, Rome. (f. 162.)	To the provost of Bothwyle and the chancellors of Glasgow and Dunkeld. Mandate, at the recent petition of Adam Achinlek, priest, of the diocese of Glasgow (containing that after Martin V and Eugenius IV's reservation to themselves and their successors of all sentences of excommunication etc. against simoniacs, he, in order that provision might be made to him of canonries and prebends of Glasgow and Moray and the parish church of Neulande in the diocese of Glasgow, then void, or one of them, promised and gave gifts, whereby he got provision made to him of the said canonries and prebends and parish church, under pretext of which he obtained possession, and has held them for more than three years, thereby incurring the said sentences) to absolve him from the said sentences and rehabilitate him, and in that event to collate and assign to him, after he has duly resigned them, the said parish church, canonry of Moray, of lay patronage, and canonry of Glasgow and prebends, value altogether not exceeding 60l. sterling. To John de Balfour, perpetual vicar of Lynlithqw in the diocese of St. Andrews, M.A. Dispensation to him, who is by both parents of noble birth, at his own petition and that of James, bishop of St. Andrews, of whose household he is a continual commensal, to hold with the said vicarage any one, or if he resign the vicarage any two other benefices with cure or otherwise incompatible, even if parish churches etc. or dignities etc., namely for ten years if two parish churches or perpetual vicarages or one of each, for life if other incompatible benefices, and to resign them, simply or for exchange, as often as he pleases; notwithstanding the pope's late ordinance [see above, p. 5] etc. Nobilitas etc. (Pe. de Noxeto. \| xxxxv. 1454. 5 Kal. June. (28 May.) St. Peter's, Rome. (f. 190d.)	To Thomas de Levingsten(e), bishop in the universal church. Reservation to the pope's gift, to be held in commendam by him (who is S.T.M., has made his profession in the Cistercian order, has no cathedral church, and has not enough ecclesiastical fruits to keep up the episcopal dignity), of the first to become void Cistercian monastery of the realm of Scotland, of whatsoever tax or annual value (provided that it be not Melros, Dund[r]aynan or Kynlos, whose abbots are father-abbots), until provision has been made to him of a cathedral church and he has obtained possession of its administration; with mandate executory hereby to the bishops of Penne, St. Andrews and Glasgow. Upon his obtaining possession of the administration etc. of such monastery, the pension of 100 florins of gold of the camera on the fruits etc. of the Cistercian monasteries of Noubotil and Dundraynan in the dioceses of St. Andrews and Whiteherne, which has been assigned to him by papal authority, shall, as he has offered, cease and expire, and, in the event of his absenting himself or not residing in such monastery, he shall not receive more than 300 florins a year from its fruits etc. De sedis apostolice. 17 Kal. June. (16 May.) St. Peter's, Rome. (f. 245d.)	To the bishop of Penne and the dean and chancellor of Brechin. Mandate, as below. The pope recapitulates Eugenius IV's mandate to James, bishop of St. Andrews to deprive adherents of the Council of Basel, and collate and assign their benefices to others [Cal. Lett., VIII, pp. 238, 239, 315 note], in pursuance of which the said bishop, as the recent petition of John de Balfour, priest, of the diocese of St. Andrews, M.A., contained, monished the late Thomas Graynlaw, rector of Conveth in the said diocese, then residing at Basel, to leave that city within a certain time, and, upon his disobedience, deprived him of the said church, and made collation and provision thereof, thus void, to Adam Falconier, priest, of the said diocese, in virtue of which the said Adam obtained possession and held it for about seven years. Subsequently the present pope, by certain letters, restored to their benefices those who had been for the said adherence deprived by Eugenius IV or by his letters [see above, p. 1], after which the said Thomas died, without having recovered possession of the said church, and the pope ordered provision thereof, as void by the said death, to be made successively to Richard Cady, priest, and John [de] Atholia (fn. 4), clerk, of the dioceses of Glasgow and Dunkeld, whilst David Monipenny, clerk, of the diocese of Brechin, obtained possession of it in virtue of certain other letters of the pope, as void by the death of the said Adam. After the cause which therefore arose between the said John de Atholia, Richard and David about the said church, which each of them claimed, had been for some time ventilated before a certain papal delegate appointed for the purpose, the said John and Richard resorted to arbitrators, who gave a definitive sentence on behalf of John and against Richard; and upon Richard's having recourse to the said bishop, alleging the said sentence to be unjust, and causing the said John to be summoned before John Genes, official of St. Andrews, the said official by a definitive sentence revoked the said sentence of the arbitrators, notwithstanding which the said John Atholie obtained the pope's letters to certain judges in regard to the confirmation of the said sentence in his favour. Subsequently the pope, at the instance of the above David, committed to John Didaci de Coca, a papal chaplain and auditor, the cause which David intended to bring against the said John Atholie about the said church. Lastly the said Richard and David in like manner resorted to arbitrators, who delivered a sentence which is said to have become a res judicata. Seeing that, the cause pending before the said auditor, David and John Atholie have this day resigned to the pope the cause and all right belonging to each of them in or to the said church by their proctor John Colston, clerk, of the diocese of Whiteherne, the pope hereby, calling up the cause to himself and extinguishing the said suit, orders the above to collate and assign to the said John de Balfour, who is by both parents of noble birth, the said church, value not exceeding 30l. sterling, whether void by the death of the said Thomas, or by the resignation of the said Thomas or Adam or any other, or void in any other way.
