To the prior of Inyscronayn in the diocese of Killaloe (Laonien.). Mandate (the pope having been informed by Matthew Ossyda, clerk, of the diocese of Killaloe, that Raynaldus Ocorban, perpetual vicar of Killiburan in the said diocese, has dilapidated the goods thereof, publicly kept a concubine, and neglected to celebrate masses and other divine offices and to celebrate the sacraments in the said church, wherein he has not resided for more than four years) if and after Matthew (who alleges that he has been dispensed by papal authority, on account of his illegitimacy as the son of a priest and an unmarried woman, to be promoted to all [even holy] orders and hold a benefice even with cure, and that provision was recently by the said authority ordered to be made to Philip Oflandmera, [priest? ], of the said diocese (fn. 3), of the said vicarage by papal letters which are surreptitious because its true yearly value was not therein expressed) accuses Raynaldus before the above prior, to summon Raynaldus, and if he find the above to be true, to deprive and remove him, and also to summon the said Philip. and if he find the said letters surreptitious, to declare them and their consequences null and void, and in those events to collate and assign the vicarage, value not exceeding 10 marks sterling, to Matthew; whether it become void by such deprivation, or be void by the death of James Ylandnura, or in any other way. Mandate to collate and assign to Denis Macgillavanach, clerk, of the diocese of Kilmacduagh (who was lately dispensed on account of his illegitimacy, as the son of a priest and an unmarried woman related in the double second degrees of affinity, to be promoted to all, even holy orders and hold a benefice even with cure) the perpetual vicarage of Mearyd in the diocese of Annadown, of the patronage of laymen and value not exceeding 6 marks sterling, so long void (because Donald Macgillavanach, priest, of the diocese of Kilmacduagh, when holding it intruded himself without any canonical title into the rectory of Kyleolgon in the same diocese of Kilmacduagh, and for more than a year unduly detained possession of it, as he still does, together with the said vicarage, without having obtained any canonical dispensation) that by the Lateran statutes its collation lapsed to the apostolic see; summoning and removing the said Donald, on account of whose power in the city and diocese of Annadown Denis has no hope of obtaining justice therein. Mandate to collate and assign to John de Burgo, canon of Tuam, by both parents of a race of barons and otherwise of knightly race, the rectory of Athnaryd in the diocese of Tuam, of the patronage of laymen and value not exceeding 30 marks sterling, so long void, by the death of Milerus Bremecheam, that by the Lateran statutes its collation lapsed to the apostolic see; whether it be void as stated, or by the non-promotion to the priesthood of Richard de Burgo, or by the deprivation by papal authority of William Ycorcrayn, or in any other way, and notwithstanding that he holds a canonry of Tuam (without a prebend), whose fruits etc. are of no value to an absentee. To Master Peter Martini de Caveisrubeis, papal chaplain and auditor of causes of the apostolic palace. Mandate, as below. Eugenius IV. (upon its being set forth to him on behalf of John Donaldi, perpetual chaplain in the parish church of Perth, in the diocese of St. Andrews, that a cause had arisen lately between him and the late John de Luchris, priest, of the diocese of Moray, about the perpetual vicarage of Octirgawin in the diocese of Dunkeld, Donaldi alleging that on its voidance by the death of John de Rettre, collation and provision thereof had been made to him by authority of the ordinary, that in virtue thereof he had obtained possession, and that the said John de Luchris had hindered his peaceable possession) committed (the cause having by Donaldi's appeal lawfully devolved to the Roman court) the cause of the appeal and of the principal matter, at the instance of the said John de Luchris, to the above auditor, to whom, after he had proceeded short of a conclusion, the said pope gave special commission to admit to the cause John de Seres, priest, of the diocese of Brechin, M.A., who alleged that provision had been granted to him by papal authority, after which the auditor proceeded further in the cause between the said three, short of a conclusion. The same pope, having learned that, the suit being thus pending, the said John de Seres proposed to give up the cause and all right in or to the vicarage, ordered under date 8 Kal. Oct. (24 Sept.) anno 16 [1446] the above auditor to receive and admit the said cession, and thereupon to surrogate Donaldi, who was a priest, in and to all the said right and to make him collation and provision thereof, and moreover to collate and assign to him the vicarage itself, value not exceeding 6l. sterling; whether it became void by such cession, or were still void by the death of the said John de Rettre or of the said John de Luchrys (who afterwards died without the said court) or in any other way, and notwithstanding that Donaldi held the said perpetual chaplaincy, without cure and value not exceeding 4l. sterling. Inasmuch as the said pope died before his letters were drawn up, the pope hereby decrees that they hold good from the date thereof, and that these presents are sufficient proof, and orders the above auditor to admit the said cession and to surrogate etc. as above and thereafter to make the said collation to Donaldi. To Thomas Osiredean and Paul Macachan, canons of Ardagh, and the official of Ardagh (fn. 4) Mandate (the pope having been informed by Charles Oflaynd, clerk, of the diocese of Kilmore (T[r]iburnen.), that John Magillachuli, perpetual vicar of Kyllcachunurch in the diocese of Ardagh, has dilapidated the goods thereof and committed perjury and fornication and, neglecting the said church and its cure, did not administer the sacraments to a dying parishioner), if and after Charles (who, notwithstanding his illegitimacy, as the son of unmarried parents, has been made a clerk, and who has studied (fn. 5) in canon and civil law for twelve years) accuses John before them, to summon John, and if they find the above to be true, to deprive and remove him, and in that event to collate and assign the vicarage, value not exceeding 8 marks sterling, to Charles; whether it become void by such deprivation, or be void by the death of Andrew Miccalruoig, or in any other way. and notwithstanding that the pope recently made him provision of a canonry of Ardagh, with reservation of a benefice with or without cure (fn. 6), in the collation etc. of the bishops and the deans and chapters of Ardagh and Kilmore, and dispensed him to receive and hold such canonry of Ardagh and benefice. He is hereby dispensed. on account of the said illegitimacy, to receive and hold the vicarage, and the pope decrees that the said other letters shall hold good as regards such benefice with cure, even after he gets possession of the vicarage, but wills that as soon as he obtains possession of such benefice with cure he shall, as he has offered, give up the vicarage, if he have meanwhile obtained it, or all right therein or thereto. Mandate (the pope having recently made provision to Thomas Penven [now] chancellor of Dunkeld. then holding inter cetera the perpetual vicarage of Vyston in the diocese of Glasgow, of the said chancellorship, a dignity with cure, then void and previously reserved, and having decreed that as soon as he got possession thereof he should resign the vicarage) to reserve to his gift, for collation to William Johannis, priest, of the diocese of St. Andrews. and upon its voidance to collate and assign to him, the said vicarage, which in accordance with the foregoing is expected to become void, value not exceeding 15l. of old sterlings; notwithstanding that provision was lately granted to William by papal authority of the perpetual vicarage of Selkyrk in the said diocese of Glasgow, value not exceeding 35l. of like sterlings, which provision shall, as he has offered, be null and void upon his obtaining possession of the said vicarage of Vyston. Mandate (the pope having been informed by Thady Macconmara, canon of Killaloe, that Malachy Macconmara, rector of Cluoenlag of the half cantred of Oblaid, in the diocese of Killaloe (fn. 7), has dilapidated the goods thereof, committed simony and public kept a concubine) if and after Thady, who is by both parents of noble birth, accuses Malachy before the above prior, to summon Malachy, and if he find the above to be true, to deprive and remove him, and in that event to collate and assign the rectory, value not exceeding 12 marks sterling, to Thady; notwithstanding that he holds a canonry of Killaloe and the prebend of Disertmalacala, and that the pope recently ordered provision to be made to him of another canonry of Killaloe and the prebend of Tulachnactescov (fn. 8), value not exceeding 3 and 8 marks sterling respectively. Reservation to the pope's gift, for collation to him, who is by both parents of noble birth, of the perpetual vicarage of Cargil in the diocese of Dunkeld, value not exceeding 16l. sterling, to become void by the promotion [recently] made by the pope, of William elect of Caithness to that church, and his consecration which is to be administered; notwithstanding that he holds a canonry of Glasgow and the prebend of Castilscaris (sic) therein, value not exceeding 12l. sterling, and that the pope lately made him provision of a canonry with reservation of a prebend and dignity etc. of Moray, and of a benefice with or without cure, even if a canonry and prebend, dignity etc. in the collation etc. of the bishop and the dean and chapter of Glasgow, the letters of which shall, upon his obtaining possession of the said vicarage, be null and void as far as regards another incompatible benefice only.
