To the dean and the archdeacon of Cork, and Donald Omonghan, canon of the same. Mandate—the pope having been informed by John Omonghan, clerk, of the diocese of Cork, that Dermit Mackelchy, rector of Curruhura in the said diocese, has dilapidated and alienated and converted to unlawful uses the possessions thereof, publicly kept with him in the presbytery (in domo presbyterali) a concubine (fn. 1) by whom he has begotten offspring still alive, and is accused of divers other crimes [not here expressed]—if and after John (who was lately dispensed by papal authority, as the son of unmarried parents, to be promoted to all, even holy orders and hold a benefice even with cure) accuses Dermit before the above three, to summon him, and if they find the above to be true, to deprive and remove him, and in that event to collate and assign the said rectory, value not exceeding 5 marks sterling to John; whether it become void by such deprivation, or be void by the death of Patrick Ygonniban, or by the resignation of the said Dermit and Patrick, or in any other way. Decree, as below. The [recent] petition of the warden and fellows of the college or hall of Valence Mary, commonly called ‘Penbrokhalle,’ founded in the university of Cambridge for the sustentation of a master or warden and certain fellows or scholars, contained that amongst the statutes there is one about the election of the warden, as follows:—
In primis ordinatum est quod officio custodis vacante quomodocunque, statim infra octo dies a tempore cessationis custodis, dumtamen major et sanior pars sociorum collegii presens fuerit, senior socius iuxta statutum suu(m) [sic] in domo congregationem scolarium faciat, iniungatque omnibus et singulis sociis quod ipsi fideliter odio et facore deductis, solum deum et sacramentum eorum dom[i]ni prestitum habendo pre oculis, eligant et dicant pro uno dicte communitatis qui melius poterit et sciverit et maiorem zelum habuerit ad faciendum et expediendum negocia domus, duntamen sacerdos fuerit.

Pro maiori etiam conscientie serenitate et fidei securitate diligenter est advertendum ordinationes ipsas vel statuta privilegia libertates et consuetudines conscientias singulorum easque iurantium sic ligare ut nulli singulariter liceat eas transgredi quovis modo: sic tamen dictum collegium ipsosve scolares non arctent, quin cum aliquibus personis eorundem certis ex causis et legitimis contra ipsas consuetudines vel statuta preterquam in socios eligendos concernentibus poterint aliquotiens dispensare, duntamen omnes et singuli socii vel maior pars et sanior sociorum consentiant gratie concedende, et nisi in certis statutis contra que non liceat cum aliquo dispensare nisi consensu custodis et omnium et singulorum sociorum primitus concurrente, ut in suis locis plenius apparebit. Cum autem, sicut eadem petitio subiungebat,… (fn. 2)
Seeing that, as the said petition added, there are divers statutes about the election of the warden and fellows, and that many doubt whether the said statutes are to be understood to mean that no one can be elected warden who is not one of the fellows, as if they cannot dispense with the statute about the election of fellows, or whether or not in virtue of the statutes the fellows can dispense with the said statute about the election of the warden, in such wise, that is to say, that they can elect as warden a priest, beneficed or not beneficed, who is not a fellow, because (inasmuch as there are only fellows who are poor, having few or no benefices, and who have not the power to resist the malignities of men) many inconveniences will probably result to the college, the warden and fellows have therefore petitioned the pope for an interpretation or declaration in regard to the aforesaid. The pope therefore (fn. 3) hereby decrees that the fellows, as often as the office of warden is void, may dispense with the said statutes and elect as warden a priest, beneficed or not beneficed, although he be not and have not been a fellow, notwithstanding the aforesaid and any other statutes etc. Ad futuram rei memoriam. To Eugenius Ossullevayn, clerk, of the diocese of Ardfert. Rehabilitation on account of his having, after canonically obtaining the perpetual vicarage of Kyllymelach in the diocese of Ardfert, held it for more than a year without being ordained priest; and of his having continued to hold it, after the lapse of the said year, for a year and more, but less than two years, without having acquired any new canonical title. Mandate, recapitulating the preceding, to collate and assign to the above Eugenius, upon his duly resigning it, the above vicarage, and also the rectory without cure of Inishousyl in the said diocese (so long void by the death of Andrew Ochuoma that by the Lateran statutes its collation has lapsed to the apostolic see, although Donatus Obygonayn, clerk, of the said diocese, has detained it without canonical title for more than ten, but less than eleven years), and also the perpetual vicarage of Kyldachom in the said diocese (whose vicar, Maurice Ohoullachayn, as the said Eugenius has informed the pope, has committed simony and perjury, and is a public and notorious fornicator and a dilapidator of the said vicarage, in the event of Eugenius accusing Maurice before them in the usual lawful way, and their finding the accusations or enough thereof to be true, and their consequent deprivation of Maurice), values not exceeding 5, 1 and 3 marks sterling respectively; whether they became or become void in the ways stated, or whether the said vicarage of Kyldachom be void by the death of Odo Ylegyn, priest, or whether they be void in any other way. To Laurence Blyth, priest, of the diocese of St. Andrews. Grant as below. The pope, under date 18 Kal. July anno 1 [14 June, 1447], ordered provision to be made to him of one or two benefices, even if such one or one of such two had cure or were a rural deanery or archpriestship (fn. 5) [or a dignity etc. as below, f. 312d.] in the collation etc. of the bishop and the prior and chapter etc. of St. Andrews and the abbot and convent of the Augustinian monastery of St. Thomas the Martyr, Aberbrothoc, in the diocese of St. Andrews. In order that he may the more quickly obtain the effect thereof, at his own petition and that of James, bishop of St. Andrews the pope, holding all his benefices and their values and his dispensations to be sufficiently expressed by these presents, grants that in the obtaining of such benefice or benefices and otherwise as regards the plenary taking effect of the said grace and letters he may and shall enjoy all the preferences etc. expressed in the letters lately granted by the pope in favour of a certain number of persons nominated by king James to a certain number of benefices, as if he were one of such nominees etc. Vite etc. (O. and G. Dispensation to him (who is a brother of William, bishop of Coventry and Lichfield, and all of whose benefices and their values the pope holds to be sufficiently expressed by these presents) to hold for life with the said church any one other benefice, or if he resign the said church any two other benefices, with cure or otherwise incompatible, even if such one or either or both of such two be another parish church or a perpetual vicarage or a dignity etc. and to resign them, simply or for exchange, as often as he pleases etc. Litterarum sciencia, vite etc. (P. and Jo. To all faithful in Christ. Relaxation, as below. Eugenius IV granted on 9 Kal. Dec. anno 9 [23 Nov., 1439] for a space of twenty years, twelve of which have elapsed, a relaxation of three years and three quarantines of enjoined penance to penitents who on certain feasts, then expressed, visited and gave alms for the conservation and fabric of the church of the Friars Preachers house of St. Mary de Rathbranna in the diocese of Killala (which, as well as the said house, was on account of wars but little frequented, and was without refectory, bell-tower or bell (fn. 7); and which was also, because it was not yet finished, suffering in its buildings, as it still does, much deformity and ruin) and of a hundred days to those who did so on the octaves of the said feasts and on certain other days. The pope therefore grants hereby a relaxation of seven years and seven quarantines of enjoined penance to penitents who on the feast of the Assumption of St. Mary the Virgin, visit and give alms as above, the present letters to be valid for twenty years.
