To Malachy Macochlayn. Provision to him—who was lately dispensed by papal authority on account of illegitimacy as the son of an unmarried man and a married woman related in the simple fourth degree of kindred, to be promoted to all, even holy orders and hold a benefice even with cure; and who was formerly declared (inasmuch as, after he had made his profession as a canon of the Augustinian monastery of St. Mary, Galynd, in the diocese of Clonmacnoise (Cluanen.), when a number of laymen, enemies of the said monastery, had invaded and entered with an army the parish church of Galynd, abutting on the walls of the monastery and belonging thereto, he joined a number of other laymen for resistance and defence, on which occasion several were killed or wounded, but without his wounding or striking any one) not to have incurred or contracted the guilt of homicide or irregularity or disability on account of the foregoing—of the priorship of the said monastery, which is conventual, depends on no monastery or regular place, is elective and has cure, and whose value does not exceed 12 marks sterling, void by the death of prior William Oduburlay, and reserved under the pope's late reservation of all conventual priories, void and to be void; whether it be void as stated, or by the resignation of the late Donatus Yduburlay, or in any other way. To the abbot of Dorchester (de Dorcacestria) in the diocese of Lincoln. Mandate, at the [recent] petition of the prior and convent of the Augustinian priory of St. Frideswide, Oxford—containing that the fruits etc. of the perpetual vicarages of St. Nicholas Merston and St. Andrew Hedyngton, in the same diocese of Lincoln, in their presentation (which parish churches are only a mile apart and have been wont to be governed by two perpetual vicars, and in which the prior and convent have a peculiar jurisdiction) have become so slight that two perpetual vicars cannot conveniently be maintained therein etc.—to unite in perpetuity the said vicarages, the value of each of which does not exceed 5 marks sterling; so that on that on the resignation or death of the vicar of one of the said churches, the surviving vicar may take possession of the void vicarage etc. Pastoralis officii. To the abbot of Battle (de Bello) in the diocese of Chichester, Mandate, as below. The recent petition of Thomas London, priest, a Benedictine monk of St. Augustine's without the walls of Canterbury, contained that, although he has always lived a laudable life, nevertheless William Kenyngton, a monk of the said monastery, is said to have found a certain schedule of diffamation written by the said Thomas, containing a number of alleged crimes committed by him, in respect of which crimes he, without Thomas being duly summoned, purged himself before the said (sic) abbot. Seeing that Thomas, who, as he alleges, copied the schedule from another one which he found, and left it in his room without evil intent, has been ready, even in William's presence, to purge himself according to form of law, and that the said (sic) abbot has unjustly delayed his doing so (fn. 2), the pope hereby orders the above abbot of Battle to summon the said William and others concerned, and admit Thomas to such purgation. To William Croyser, archdeacon of Teviotdale (Theuidalie) in the church of Glasgow, a notary of the pope. Reservation and assignment, motu pro prio—seeing that he has this day resigned to the pope by his proctor John Michaelis, rector of the parish church of St. Severius [sic], Vienne (Viennen.), the commenda of the Augustinian priory de Bossia in the diocese of Lyon (Lugdunen.), which was granted to him in commendam for life by the late Amedeus bishop of Sabina, then called in his obcdience Felix V. and that the present pope has ordered the same to be granted in commendam for life to Peter Poysiaci, prior of the Augustinian priory de Valle in the diocese of Vienne—of a yearly pension for life of 50 old crowns (scutorum antiquorum), of which 64 are worth a mark of gold, on the fruits etc. of the said priory de Bossia, to be paid every year by the said Peter, who has consented, and his successors, in the city of Lyon within the octaves of Easter, under stated penalties etc. Grata devotionis obsequia. |

To John de Murano, a friar professed of the Friars Preachers’ house of SS. John and Paul, Venice (loci de Venetiis) in the diocese of Castello (Castellan. dioc.). Faculty, at his recent petition (containing that the province of England was recently deputed to him by the chaptergeneral of his Order, thither to betake himself and complete the Book[s] of the Sentences and other proper courses for the degree of master of theology; and adding that, inasmuch as he is of delicate health and poor, he cannot without great inconvenience go to England, which is very distant from his native place, in order to complete the said lectures and courses (fn. 5) ) that he, who had previously begun to lecture in the university of Padua and in the said faculty (fn. 6), may complete in the said university the lectures and proper courses for the taking of the said degree, howsoever required, and, after he has duly completed them there, and if he be otherwise deserving and be found fit after examination by the masters of the said faculty and university, may take the degree of master (fn. 7), and that after he has taken it he may teach in the said faculty and exercise public acts, and be deemed a master in theology within the said Order and everywhere without it, and enjoy the privileges, immunities and exemptions etc. granted by the apostolic see and by the said Order to the friars thereof who have taken the mastership of theology in the said university, as if, in accordance with the said deputing, he had taken the said degree in the said province or elsewhere in accordance with the customs of the said Order and had, at the time of taking the degree, kept the proper courses in the Order and completed them in accordance with its customs (fn. 8). To the bishop of Bath and Wells. Mandate, as below. The recent petition of William Etrete, a Benedictine monk of St. Mary's, Glastonbury (de Glasconia), in the diocese of Bath and Wells, contained that he lately, with the consent of his superior, went to Rome for the sake of the Indulgence of the Jubilee and for the performance of other business in the Roman court, and that William, abbot of St. Edmunds, Bury, in the diocese of Norwich, Henry king of England's proctor in the said court, caused him (at the instance of John Lax. clerk, of the said (fn. 9) diocese [of Bath and Wells], who persecuted the said monk with hate and rancour) to be, without any lawful cause, imprisoned in the prison in which the courtiers of the said court are wont to be imprisoned; that afterwards (fn. 10) the said prison was broken by the prisoners, without the help or consent of the said monk, and all the prisoners escaped; and that he, knowing that there had been no just cause for his imprisonment, departed thence also and returned to his said monastery; but that the abbot thereof, at the false suggestion of the said John that the said monk had been imprisoned for his demerits and excommunicated on account of the said [prison] breaking and escape, has unjustly refused and still refuses to receive him into his monastery. The pope therefore orders the above bishop to summon the said abbot of Glastonbury and others concerned, and after receiving from the said monk a pledge that if it be found that he was justly excommunicated he will obey the commands of the above bishop and of the church, to absolve him ad cautelam therefrom, and if he find the aforesaid to be true, to cause him to be received into his said monastery etc. Humilibus supplicum votis. Faculty, on account of the fewness of the canons of the priory in priest's orders, to dispense four of the canons who are deacons, have made their profession and are below the age for the priesthood, to be, as soon as they reach their twenty-third year, promoted to priest's orders and minister therein. To the archbishop of Canterbury, the dean of Wells and the archdeacon of Rochester. Mandate, as below. The recent petition of William Etrete, a Benedictine monk of St. Mary's, Glastonbury (de Glaschonya), in the diocese of Bath and Wells, contained that he lately … wont to be imprisoned [as above, f. 248d], and kept therein for about 3 months, with very great hunger and thirst; that afterwards (fn. 11) … prisoners escaped [as ibid.]; and that, knowing that there had been no just cause for his imprisonment, when the other prisoners of divers nations went forth, he, despairing for his life, went forth with them and returned to England and to his said monastery, but that the abbot, at the false suggestion of the said John, made by letter, that the said monk had been imprisoned for his demerits and excommunicated on account of the said [prison] breaking and escape, refused to receive him into the monastery until he should obtain absolution from the sentence of excommunication. The pope therefore orders the above bishop to summon … concerned [as above, f. 248], absolve the said monk from the said sentence, enjoining penance, and thereupon cause him to be received by the said abbot and convent as a monk etc. Solet sedis apostolice.
