To the archdeacon of Ardfert. Mandate, as below. The [recent] petition of Cornelius Ochomychuyr (fn. 3), priest, of the diocese of Ardfert, contained that formerly, after he had been dispensed by papal authority, on account of illegitimacy as the son of unmarried parents, to be promoted to all, even holy orders and hold a benefice even with cure, had thereafter obtained peaceable possession of the perpetual vicarage of Achamalyn in the said diocese, then void by the death of Cornelius Otuohyl and collated to him in virtue of letters of the present pope ordering provision thereof to be made to him, and had held it in peace for more than a year, John Ocholmayn, clerk, of the said diocese (alleging that the vicarage belonged to him in virtue of other letters of the pope [above, p. 433] ordering provision to be made to him thereof, as being void because the late Thady Okynnela, the said late Cornelius's predecessor, having obtained it by canonical collation, had held it peaceably for more than a year without having himself ordained priest and without dispensation) brought him before John Puichel (rectius Purchel, i.e. Pursel) (fn. 4), a canon of Limerick, sub-executor of the said later letters, deputed by Alan, precentor of Limerick, the principal executor thereof; that the said canon John (notwithstanding that it was objected before him on behalf of the said Cornelius that, inasmuch as both he and the said John Ocholmayn were of the same diocese in which the said vicarage is situate, he could not and ought not to have been, in accordance with a constitution of Boniface VIII, convened by the said John Ocholmayn in the cause before the said canon John (fn. 5) ) proceeding in the cause, without hearing the said Cornelius in the matter, promulgated a definitive sentence, which was null, by which he adjudged the vicarage to John Ocholmayn and imposed perpetual silence on Cornelius. Seeing that, as the said petition added, it is alleged that neither the said Cornelius Ochonnchuyr [nor John Ocholmayn] has a right in or to the vicarage, and that, as the pope has learned, the vicarage is still void by the death of the said Co[r]nelius Otuohyl, the pope hereby orders the above archdeacon, taking lawful cognisance of the said process had by the said canon John, to decree what is just and hear and decide the cause which Cornelius intends to bring against John Ocholmayn, causing his decision to be observed by ecclesiastical censure, without appeal, and, after the suit has been lawfully introduced before him, if by the result thereof he find that neither Cornelius nor John has such right, to collate and assign the said vicarage, value not exceeding 8 marks sterling, to Cornelius.
