Mandate, after imposing penance for incest, to dispense Edmund Baret, layman, and Catherine daughter of Thady Meccarthe, layman, of his (tue, cf. the next following dispensation) diocese, who have often committed fornication and had offspring, still living (prolem gradientem super terram exinde procreaverunt), in order to assuage the riots, discords and enmities which have arisen between their parents, kinsmen and friends, etc. to contract marriage, notwithstanding the impediments arising from their being related in the simple fourth and also the fourth and third degrees of kindred, and the third and third degrees of affinity, and notwithstanding also the impediment of quasi-affinity between them arising from the fact that a certain layman, related to Edmund in the second and second degrees of kindred, contracted marriage with the said Catherine per verba legitime de presenti, upon proof of whose impotence to consummate the marriage, it was dissolved by authority of the ordinary (fn. 5); declaring the said offspring and that to be born of the marriage legitimate. Mandate to dispense William Raket, layman and Agnes Bellynghan (sic), relict of Thomas Bellynghan [layman], of the diocese of Durham (Dunelmensis diocesis, cf. the preceding dispensation), to remain in the marriage which they formerly contracted per verba legitime de presenti, solemnised and consummated, not in ignorance of an impediment of spiritual relationship arising from the fact that the said Thomas, then Agnes's husband, and the late Alice, then William's wife, acted as godfather and godmother to one another's offspring during their respective marriages (fn. 6), the said William and Agnes having contracted the said marriage with a good intention, and for the avoiding of the great scandals, contentions and discords which had arisen about certain conterminous lands and possessions; imposing penance for the said contract etc. and declaring the offspring born, if any, and that to be born of the marriage legitimate. To the abbot of Feverisham in the diocese of Canterbury, Mandate, as below. The recent petition of the inhabitants of the town (ville) of Quenboruch in the diocese of Canterbury contained that (inasmuch as the said town is about two miles of those parts from the parish church of St. Sexburga the Virgin. Minster, which [parish church] is canonically annexed to the Augustinian canonesses’ monastery of Minster, end of which they [the said inhabitants] are parishioners) some of the said inhabitants, for want of the presence of the rector of the said church, have died without confession and other sacraments, that a number of infants, born weak, and unable to be taken in time to the said church for christening, especially in winter on account of the said distance and snows and floods, have died without christening, at least administered by a priest, and that many of them who are very old and weak cannot conveniently go to the said church to hear divine offices, besides which they suffer many other inconveniences. At the said petition, adding that they have in the said town a very notable chapel of Holy Trinity, lately founded and endowed by the king of England who then was, in which they could conveniently hear masses and other divine offices and receive the sacraments, the pope hereby orders the above abbot to summon the rector of the said church and others concerned, and if he find the facts to be as stated, to grant licence to the said inhabitants to erect a baptismal font, have infants born in the said town christened by their own chaplain or other fit priest chosen by them for the purpose, have masses and other divine offices celebrated and all necessary sacraments and sacramentals administered to them, and have the bodies of those who die in the said town buried in or at the said chapel or in another fit place to be chosen by them; and to grant faculty to such chaplain or priest to do all the foregoing; without prejudice to the said church etc. Decet Romanum pontificem. To the abbot of St. Michael's, Mayo (de Magio), in the diocese of Tuam, and Dermit Omeachain and Bernard Orattura, canons of Tuam. Mandate to cause Walter de Burgo, archdeacon of Annadown—who is of noble birth, and who was lately dispensed by papal authority, on account of illegitimacy as the son of an archdeacon and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, and was subsequently (after he had obtained by canonical collation the rectory of Gnobeag in the diocese of Annadown, and had been promoted to all the said orders) dispensed to receive the said archdeaconry, a non-major dignity, provision of which had been made to him by the said authority, and to retain it and the said rectory together for life—to be received as a canon of the Augustinian monastery of St. Mary, Cong (de Cunga), in the diocese of Tuam, and to receive his regular profession. As soon as he has been thus received and has made his profession, or taken the habit and worn it for three days, etc., he is to resign the said archdeaconry and rectory, value not exceeding 8 and 10 marks sterling respectively. Exemplification at his petition, from a certain book of the apostolic chancery, of a constitution read and published in the said chancery, on 20 March, 1446[–7] anno 1, and beginning Item racionabilibus suadentibus causis, revoking all unions and appropriations of benefices to other benefices by papal or any other authority, on account of which those interested were not holding peaceable possession of the [benefices] thus united (fn. 8), and calling up all causes pending in regard thereto, and extinguishing the suits thence arising, etc.; with decree that the present tenour shall have the same force and value as judicial evidence as the original constitution would have if exhibited.
