Mandate—seeing that Cornelius, bishop of Clonfert (Conflecten., rectius Clonferten.), has set out on his way to the Roman court—after imposing penance for incest, to dispense to marry, in order to assuage and obviate wars, dissensions etc. between their kinsmen and friends etc., Malachy Oceallayd, nobleman, and Margaret de Burgo, noblewoman, of the diocese of Clonfert (Conflecten.), who formerly, not in ignorance that they were related in the second and third and also in the third and third degrees of affinity, and also in the fourth and fourth degrees of kindred, several times committed fornication; decreeing offspring born, if any, and that to be born of the marriage legitimate. To the abbot of Lysgobayl in the diocese of Clogher. Mandate, as below. The recent petition of Donald Offrych (fn. 7), clerk, of the diocese of Clogher, contained that the so-called ‘erenachs’ keep up the hospitality which is wont, after the custom of the country, to be observed on account of lands situate within the bounds of the parish churches of the said diocese or at least of the greater part thereof, and have been wont, in aid of such hospitality, to collect levy and have, under a yearly pension payable to the ordinary, the so-called ‘episcopal fourths,’ in whatsoever way due by right or custom to the diocesan on account of the tithes arising from the lands situate within the bounds of such parish churches; and that the said Donald, with his kinsmen, is bound, on account of lands and possessions situate within the bounds of the parish church of Daerybrosca in the said diocese and lawfully belonging to him and them, to bear a share of the hospitality wont to be observed within the said bounds. The pope therefore, in order that Donald may the more easily bear the said share, orders the above abbot, if the facts be as stated, to grant that he may, within the bounds of the parish of the parish church in the place of the plebs of Dumthomuach, of the said Daerybrosca, and also within the bounds of the parish of the parish church of Macharinacrossi (fn. 8), in the said diocese, freely and lawfully collect, exact and have, subject to the yearly registered pensions due therefrom and wont to be paid, and the modes, agreements and conditions entered into or to be made thereupon between the said ordinary and Donald, the said episcopal fourths howsoever due to the said ordinary; provided that Roger, the present bishop of Clogher consent, if he have not already consented (fn. 9). To Berardus, bishop of Spoleto, the pope's vicar in spirituals in Rome. Mandate, as below. The petition of William Radeclefe, I.U.D., a papal chamberlain, and Richard Thwatis, nobleman, then chamberlains of the hospital of Holy Trinity and St. Thomas the Martyr of the English at Rome, John Kylnyngton, warden and all the brethren of the council thereof, and John Lax, doctor of laws and a brother of the said hospital, contained that (fn. 11) recently, namely on Friday, 28 March, 1451, the said chamberlains (camerarii), warden and all the other brethren, being assembled in the council room of the said hospital for the transaction of the affairs thereof and especially of those below-written, upon its being set forth before them, amongst other things, that a number of ruinous houses belonging to the hospital (especially a certain tower or house situate in the rione Parione (in regione Parionis) in the parish of S. Biagio (Sancti Blasii), and the ruinous out-buildings adjoining it (fn. 12), which [tower or house] had for some time been of little use to the hospital and would probably soon fall to ruin unless it were repaired) were in need of no little repair; and upon its being resolved to let the said tower or house to some one who should make such repair, part at the hospital's, part at his own cost, the said John Lax, at the prayers of the said chamberlains (camerariorum), warden and brethren, and upon the refusal of the rest of the brethren, undertook the burden of the said repair, whereupon the said chamberlains, warden and brethren (considering that such lease was to the manifest utility of the hospital, both on account of the relief from the many expenses which the said tower needed, and also because the revenues of the hospital would in future be thereby increased to no small extent) granted on perpetual lease (in emphiteosim perpetuam) for life to the said John Lax the said tower or house, with its adjoining out-buildings high and low, destroyed and not destroyed (fn. 13), and all its rights and appurtenances, under a yearly cess of seven gold florins of the camera, in such wise, however, that he and the hospital should each be bound to lay out for the repair of the said tower a hundred like florins; and, although the said chamberlains, warden and brethren were rightly satisfied with the foregoing, nevertheless the said John Lax, of his pure liberality and for charity, offered to give fifty other like florins towards the repair of the said tower or house, as is all said to be more fully contained in a public instrument bearing the subscriptions of the said chamberlains, wardens and the greater part of the said brethren, and the great seal of the hospital. At the said petition (which added that by a statute of the hospital, sworn to by its officers and brethren and confirmed by letters of the late Peter, cardinal priest of St. Praxed's, then legate and vicar-general of the apostolic see in Rome, it is provided that no house belonging to the hospital can be let to any one for more than three years, and that the said chamberlains, wardens and brethren have as far as they could relaxed the said statute and derogated therefrom) the pope hereby orders the above bishop, if on inquiry he find the said lease to be to the manifest utility of the hospital, by the pope's authority to approve and confirm it and the other contents of the said instrument, and cause it to be inviolably observed during the life of the said John Lax, notwithstanding the said statute etc. Ex iniuncto nobis. To the abbot of Paisley (de Pasleto) in the diocese of Glasgow. Mandate, at the recent petition of James lord of Hamylton, knight, of the diocese of Glasgow (containing that formerly, after the present pope ordered the bishop of Glasgow, if on inquiry he found to be true what was set forth to the pope by the said knight, to erect the perpetual vicarage of the parish church of Hamylton into a collegiate church, and institute and create therein a provost and six canons from certain lands etc and four chaplaincies of the said knight's patronage, given by him for the purpose; and that after William, bishop of Glasgow, prevented by lawful causes from executing the said commission, had appointed as subdelegates Thomas bishop of Whiteherne and Archibald abbot of the Augustinian monastery of Holyrood, Ede[n]bourch, in the diocese of St. Andrews. the said subdelegates, upon the said knight presenting to them the pope's said letters, erected the said vicarage into a collegiate church, and instituted a provostship and six canonries and as many prebends, and endowed them from the goods given by the said knight, applied certain fruits etc. in perpetuity to the said canonries and prebends, granted for the first time, and as often as they should in future become void, to the said knight and his heirs and successors for ever, the patronage thereof and the presentation thereto of fit persons, to be instituted by the said bishop of Glasgow or the bishop for the time being, and did other things, as is said to be more fully contained in authentic letters or public instruments bearing the seals of the said sub-delegates), if he find the foregoing to be true, to approve and confirm by papal authority the said erection, institution, endowment and grant of patronage etc. Ex debito pastoralis.
