1452[–3]. 13 Kal. April. (20 March.) St. Peter's, Rome. (f. 3.)	To the archdeacon and the precentor of Ossory and David Botoler (rectius Boteler), a canon of the same. Mandate—the pope having been informed by William Clyoim, a monk of the Cistercian monastery of St. Mary's, Jerpoint (de Jeripont[e]) in the diocese of Ossory, that David Mortymer, abbot thereof, has committed perjury and, a notorious fornicator, has dilapidated and alienated a number of the possessions of the monastery, and is greatly defamed of these things in those parts—if and after William, who has made his profession and is in priest's orders, accuses David before the above three, to summon him, and if they find the foregoing to be true, to deprive and remove him, and in that event to make provision of the monastery, value not exceeding 20 marks sterling, to William. 1453. 9 Kal. Sept. (24 Aug.) St. Peter's, Rome. (f. 18d.)	To Thomas, elect of Down and Connor (fn. 2). Provision to him, prior of the Benedictine priory of St. Augustine, Daventre, in the diocese of Lincoln, S.T.B., of the united churches of Down and Connor, void by the death without the Roman court of John, during whose life they were specially reserved by the present pope. Apostolatus officium.
	Concurrent letters to the chapter of the said united churches, to the clergy and to the people of the cities and dioceses, and to the vassals of the churches—Apostolatus etc.; to the archbishop of Armagh—Ad cumulum; and to Henry, king of England—Gracie divine premium. Kal. Dec. (1 Dec.) St. Peter's, Rome. (f. 23d.)	To the bishop of Ratisbonne (Regensburg). Mandate, as below. The recent petition of Thady (Tatheus), abbot of the monastery of St. James of the Scots, Erfurt (Erfforden.), in the diocese of Mainz, contained that formerly, after Maurice, then abbot of the monastery of St. James of the Scots or Irish (Scotorum sive Hibernicorum), immediately subject to the Roman church, in the above bishop's diocese, had resigned the rule and administration thereof before George Cheysler, notary public by imperial authority, and witnesses, certain proctors of Maurice, alleging that he had been despoiled of the said rule and administration, obtained the commission of the cause in the matter of the said spoliation to Master John Josso, a papal chaplain and auditor, who is said to have proceeded short of a conclusion. At the said petition, adding that it is alleged that Maurice died before the said commission of the cause, or after some proceedings had been taken in it, the pope, hereby calling up the cause to himself, in the event of the said resignation or death, and not otherwise, and absolving Thady from all sentences of excommunication etc. as far only as regards the taking effect of these presents, hereby orders the above bishop to summon the said Maurice, if still alive, and others concerned, resume the cause, hear it further and decide it without appeal, causing his decision to be observed by ecclesiastical censure. In the event of Maurice having died, he is to extinguish the suit, and if he find that the said resignation took place, he is to admit it by papal authority, and in that event to make provision to Thady of the said latter monastery, value not exceeding 30 marks of silver, whether it be void by such resignation or death, or in any other way. To the bishop of Ardfert, the abbot of the Apostles Peter and Paul, Raithtuaith [in the diocese of Ardfert], and Thomas Macconchubair, a canon of Ardfert. Mandate—the pope having been informed by Edmund Fitzmores, a monk of the Cistercian monastery of Monasteranenagh (de Magio) in the diocese of Limerick, that Maurice Fitzmores, abbot of the Cistercian monastery of St. Mary de Kyrieleyson in the diocese of Ardfert, a simoniac and notorious fornicator, has dilapidated and destroyed a number of its immoveable possessions, and continually (in dies) burdened the monastery with manifold burdens in favour of secular persons—if and after Edmund (who was lately, before he entered the said religion, dispensed by papal authority on account of illegitimacy as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure) accuses Maurice before the above three, to summon him, and if they find the foregoing to be true, to deprive and remove him, and in that event to make provision of the said monastery, value not exceeding 24 marks sterling, to Edmund, after he has made his express profession of the said Order. — (f. 63.)	‘Nicolaus etc. dilectis filiis … abbati monasterii apostolorum Petri et Pauli Armachani et decano ac Patricio Okynagan canonico ecclesie Armachane salutem etc. Vite ac morum honestas, aliaque laudabilia probitatis et virtutum merita, super quibus apud nos dilectus filius Cornelius Magmurchayd alias Omurigean presbyter Armachane diocesis fidedigno com[m]endatur testimonio, nos inducunt ut sibi reddamur ad graciam liberales. Ad audienciam siquidem nostram, dicto Cornelio referente, pervenit quod dilectus filius Goffredus Olucherean perpetuus vicarius parrochialis ecclesie de Domnachmor dicte diocesis, suorum salutis status et honoris immemor ac fame sue prodigus pudicitieque laxatis habenis, quandam mulierem in concubinam suam publice tenere, ac manus violentas in quendam clericum, quem etiam in publico letaliter usque ad mortem exclusive vulneravit, maioris excommunicacionis in tales a canone late sentenciam propterea dampnabiliter incurrendo iniicere, ac eadem sentencia.’ Unfinished and therefore without date. Mandate to collate and assign to John Oduibneachayn, priest, of the diocese of Ardfert, who was lately dispensed by papal authority on account of illegitimacy as the son of a priest and an unmarried woman, to be promoted to all, even holy orders, and hold a benefice even with cure, after which he had himself so promoted, the perpetual vicarage of Kyllcarychy in the said diocese, value not exceeding 4 marks sterling, void by the death of David Bunean without the Roman court; whether it be void as stated, or by the death of Odo Yega, or by the resignation without the said court of one of the said David and Odo or of William Fi[t]zmoris, or be void in any other way. Mandate to collate and assign to John Forster, priest, of Brechin (whom the pope hereby absolves from all sentences of excommunication etc. as far only as regards the taking effect of these presents) a canonry of Moray and the prebend de Affeyr de Crumdel therein, value not exceeding 9l. sterling, void by the resignation of David Gulde to John bishop of Moray without the Roman court, and admitted by that bishop by his ordinary authority without the said court. 15 Kal. Sept. (18 Aug.) St. Peter's, Rome. (f. 145d.)	To the dean of Cashel. Mandate to admit by papal authority for this turn only the resignation which John Flemyng, canon of Cashel, proposes to make of the canonry and prebend of Hylardry (rectius Kylardry) therein, and to collate and assign them, value not exceeding 4 marks sterling, to William Omukony, priest, of the diocese of Cashel; whether they become void by such resignation, or be void by [the resignation] of the late Henry Payn, or be void in any other way etc. (fn. 3) The dean is to see that there be no corruption on the part of the said John and William. Prid. Id. Maii. (14 May.) St. Peter's, Rome. (f. 150.)	To the abbots of Mothel (de Mottallia) and Inishlounaght (de Surio), in the diocese of Lismore, and Walter Botteler, a canon of Lismore. Mandate (the pope having been informed by Robert Sueton (fn. 4), priest, of the diocese of Ferns, that John Wythei a canon of Ferns, has publicly kept a kinswoman as his concubine, and committed incest and perjury (fn. 5), and dilapidated and alienated and uselessly consumed a number of the possessions of his canonry of Ferns and the prebend de Fyterd therein, and laid violent hands on a priest, and, being excommunicate therefor (fn. 6), has celebrated or rather profaned masses etc. in contempt of the Keys, incurring irregularity, to the shame of the clerical order, and from fear of whose power Robert has no hope of obtaining justice in the city and diocese of Ferns) if and after Robert (all of whose benefices and their values and his dispensations the pope holds to be expressed by these presents) accuses John before the above three, to summon him, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said canonry and prebend, value not exceeding 20 marks sterling, to Robert; whether they become void by such deprivation, or be void by the death of Thomas Wogayn, priest, of the said diocese, or by the resignation of the said John, or be void in any other way. 14 Kal. Oct. (18 Sept.) St. Peter's, Rome. (f. 258.)	To the precentor (cantori) of Aberdeen. Mandate, as below. The recent petition of Martin Vaus, priest, of the diocese of Aberdeen, M.A., contained that on the voidance of a canonry and prebend of Aberdeen by the resignation of Gilbert Forasterii, an acolyte and chaplain of the present pope, to Ingram bishop of Aberdeen, and admitted by that bishop's ordinary authority, the said bishop made collation and provision thereof by the said authority to the said Martin, who in virtue thereof took possession and thenceforward held them; that (upon its being set forth to the present pope by William Lyndsay, clerk, of the diocese of Dunkeld, that the said Gilbert had resigned them to the said bishop for purpose of exchange without having obtained licence of the apostolic see, and that the said bishop had made the said provision of them to Martin as being void by such resignation made for the said purpose of exchange, and that Martin had under pretext of the said resignation and collation unduly detained them for between one and two years) the pope ordered the above precentor and the abbot of Der and the prior of Fyvy in the said diocese of Aberdeen to summon Martin and others concerned, and if they found the said canonry and prebend to be void as above, or in any other way, to collate and assign them to the said William; and that under pretext of those letters William caused Martin to be summoned before the above precentor, who has proceeded in the cause short of a conclusion. At the said petition, adding that it is alleged that neither of the said litigants has a right in or to the said canonry and prebend, the pope hereby orders the said precentor, if as a result of the suit he find such to be the case, to collate and assign them, value not exceeding 16l. sterling, to Martin, whether they be void by the said resignation of Gilbert, or by the death of Thomas Grindlaw, or in any other way, or they be reserved to the papal gift, specially or generally, because Gilbert was an acolyte and chaplain of the pope. 4 Id. Oct. (12 Oct.) St. Peter's, Rome. (f. 263.)	To the bishops of Glasgow and Dunblane and the abbot of Cupar (de Cupro) in the diocese of St. Andrews. Mandate, as below. The recent petition of John Adolie, rector of Conveth in the diocese. of St. Andrews, contained that the present pope (upon learning that the said church was void by the death of Thomas Grinlaw, although Adam Falconer, priest, of the diocese of Dunkeld, was unduly holding possession) ordered the bishop of Brechin and certain colleagues, if they found the said church to be void as above or in any other way, to make collation and provision of it to the above John, summoning and removing the said Adam; that the said John caused David Monipenii [i.e. Monipeny] (who, succeeding to the said Adam, meanwhile deceased, was detaining possession of the said church) and Richard Cady (who was also falsely alleging that the church belonged to him), clerks, of the dioceses of St. Andrews and Glasgow, to be in virtue of the said letters summoned before John bishop of Brechin, who promulgated a definitive sentence in favour of John and against David and Richard, which became a res judicata, etc.; that, inasmuch as Richard falsely alleged that the said sentence was unjust, John and he agreed upon arbitrators and swore to abide by their award; that, although the said arbitrators made an award by which they confirmed the said definitive sentence, Richard refused to obey the said sentence and award, and had recourse to James bishop of St. Andrews, who remitted the cause of the said recourse to the judgment of the apostolic see, but afterwards, at Richard's instance, committed the hearing and ending of it to John de Schenes, a canon of Glasgow, residing in the diocese of St. Andrews; that the said canon caused the said rector John to be summoned before him, and (although rector John protested before him that, inasmuch as the cause had been remitted to the judgment of the said see, the said canon could not take cognisance of it) unjustly refused to hear him, wherefore he has appealed to the said see and petitioned the pope to cause the said definitive sentence to be executed. The pope therefore orders the above three to summon David and Richard and others concerned, and, as far as regards the said causes of recourse and appeal, to hear both sides and decree what is just without appeal, and to cause their decision to be observed by ecclesiastical censure, and moreover to cause the said definitive sentence, if they find the said res judicata lawful, to be in like manner observed.
