Mandate to collate and assign to Thomulteus Macbrayn, a canon of the Augustinian monastery of St. Mary, Clontuaskeartanasinna, in the diocese of Elphin (the fruits etc. of which are so slight that they are insufficient for the support of the prior and convent, so that the canons are obliged to betake themselves to strange (aliena) and distant places in order to acquire the necessaries of life, to the diminution of divine worship therein), the perpetual vicarage of Kilglass (de Kyllglasa) in the said diocese, situate within the bounds of the territory of the said monastery and value not exceeding 3 marks sterling, so long void by the death of John Macoly that its collation has by the Lateran statutes lapsed to the apostolic see; whether it be so void, or by the non-promotion to the priesthood of the said John within the lawful time. To Walter de Burgo, abbot of the Augustinian monastery of St. Mary, Cong (de Cunga), in the diocese of Tuam. Grant, as below. Lately the pope (on learning that the said monastery was void by the death of Theobald de Burgo, although the late Dermit Odubayd was without title unduly detaining possession after he had been deprived and removed by papal authority) ordered Dermit Omeacham, a canon of Tuam, and two colleagues to cause the above Walter (who was then a secular priest and had previously been dispensed ‘sub certa forma’ on account of illegitimacy as the son of an archdeacon and an unmarried woman), to be received as a canon of the said monastery and to receive his regular profession, and thereafter to make provision to him of the said monastery, the letters mandatory stating that the value of its fruits etc. did not exceed 50 marks sterling. At his recent petition (containing that the said Dermit Omeacham received him as a canon, and received his profession and made to him the said provision, and that in virtue thereof he obtained and still holds possession, taking the fruits; and adding that at the date of the said letters the said Dermit Odubayd did not detain the monastery but had died, and that some allege that the said fruits etc. are worth more [than 50], although not more than 60 marks sterling, that there are otherwise doubts as to the validity of the said provision, and that the monastery is still void by the death of the said Theobald or Dermit Odubayd) the pope hereby grants to him (who was dispensed by the said letters to be abbot, notwithstanding the said defect, and who has not yet been blessed, and whom the pope hereby absolves from all sentences of excommunication etc. as far only as regards the taking effect of these presents) that the said provision and dispensation and their consequences shall hold good from the date of these presents, even if the monastery be still void by the said deaths, or by the ways expressed in the said letters, or in any other ways, as if it had been expressed therein that the value did not exceed 60 marks sterling, and that the said Dermit Odubayd had died and that the monastery had perhaps become void by his death, etc. Apostolice solicitudinis. Mandate (the pope having been informed by Bernard Ohanaynd, an Augustinian canon of St. Mary's, Rostomayn (sic), in the diocese of Elphin, that Malachy Macacdagan (sic), prior of the Augustinian priory of St. Mary, Inchcleraun (de Insula Clochrain) in the diocese of Ardagh, a public and notorious fornicator, has dilapidated and alienated and uselessly consumed the possessions of the said priory of Inchcleraun (de Insula Clochrayn), and committed simony and perjury) if and after Bernard, who is a priest, accuses before the above three the said Malachy (who is a priest, and from fear of whose power Bernard has no hope of obtaining justice in the city and diocese of Ardagh), to summon Malachy, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the priory, which is conventual, has cure and is elective and whose value does not exceed 10 marks sterling, to Bernard; transferring him from Rostomayn (sic) to the said priory, and causing him to be received as a canon thereof. Mandate (the recent petition of Patrick, abbot, and the convent of the Premonstratensian monastery of St. Mary, Wtburne, in the diocese of Connor, containing that although the rectory of St. Nicholas, Caracsergus (rectius Caracfergus), in the said diocese belonged from of old to the said monastery, as having been united and appropriated thereto by papal grants and with consent of the patron, nevertheless in course of time, as a result of collations made de facto by divers bishops of Connor, the rectory has long been unjustly governed or rather detained, as it is at present by John Maganngyd, priest, of the said diocese, by a collation made to him by the late John, the last bishop of Connor; and the pope having been informed by the said abbot and convent that the said John Macanngyd, a public and notorious fornicator, has dilapidated and converted to evil uses (fn. 8) very many possessions, even moveables of the said rectory, and is defamed thereof in those parts, to the shame of the priestly order; the abbot and convent also alleging that, the said rectory being situate in the confines of the monastery, they can on account of such nearness conveniently serve it in divine offices etc.) if the said abbot and convent, who from fear of John's power have no hope of obtaining justice in the city and diocese of Connor, accuse him before the above two, to summon him, and if they find the foregoing, or at least enough thereof to be true, to deprive and remove him, and in that event, and in the event of their finding true the other circumstances set forth above, to restore the abbot and convent, or to unite and appropriate anew in perpetuity the said rectory, with cure and net yearly value not exceeding 8 marks sterling, to the said monastery, value not exceeding 6 marks sterling. To the provost of Killala (Aladen.). Mandate, at the recent petition of Eugenius Ocaemayn and Thady Macfirbissyg, Augustinian friars, dwelling in the diocese of Killala—containing that recently Thady Odubda, donsel, of the said diocese, for himself and for the welfare of the souls of his progenitors, and from reverence for the Holy Trinity etc. gave them in frankalmoin, with the consent of the ordinary etc., a certain land called In[i]stormor in the said diocese for the building in a fit place thereon of a convent of the said Order, dedicated to the said Holy Trinity; and adding that the said Eugenius and Thady (who without having obtained licence of the apostolic see, accepted the said place and caused the lands thereof to be ploughed and cultivated) and other friars of the said Order, living under its rule, could not, on account of the barrenness of those parts, be conveniently maintained by begging alms from door to door in the said place, which is very remote from cities, towns, castles and other notable and populous places, unless they cultivated and ploughed the lands etc. of the said place of In[i]stormor, even with their own hands (fn. 9) —to absolve the said Eugenius and Thady from sentences etc. incurred on account of the foregoing, enjoining penance etc., dispense them on account of irregularity contracted by celebrating masses etc. when under such sentences, and rehabilitate them, and, if he find the said grant lawful, to confirm it and its consequences, and to grant licence to the said Eugenius and Thady and other friars to build a house of the said Order, with church, bell-tower, bell, cemetery (fn. 10), dormitory, refectory etc., and transfer themselves thither etc., cultivate the said lands and possessions, even with their own hands, and cause them to be cultivated, and have a boat for catching and salting fish from the neighbouring river, to be sold by others (fn. 11); saving the right of the parish church etc., and without requiring licence of the ordinary and any other. Mandate, at the petition of Richard Symioyr, abbot of the Cistercian monastery of St. Mary de Wethenya in the diocese of Emly (containing that in times past he did not govern well the said monastery, but committed fornication with several women, and by some of them had offspring (fn. 12), dilapidated and alienated some of the goods of the monastery, and lent (fn. 13) others to divers of his friends, did not celebrate divine offices in the monastery nor administer the sacraments, at times bore arms within its precincts, and perpetrated several other excesses and crimes [not here expressed], wherefore he became worthy of deprivation (fn. 14); and adding that he regrets the foregoing, desires to return to the bosom of the church and do penance, recover the said goods and rule the monastery well in future) if and after the said Richard has restored the said goods or assigned a proper compensation, or given a suitable guarantee to assign them (sic) (fn. 15), to summon Malachy Omokean, a monk of the said monastery, to whom the pope has by other letters, the execution of which has not yet been proceeded to, ordered provision to be made thereof, as being to become void by the making of such deprivation, absolve Richard from the aforesaid and other excesses etc., and from all sentences of excommunication etc., without prejudice to the said Malachy, enjoining penance etc., dispense him on account of irregularity contracted by celebrating masses etc. when under such sentences, and dispense him to minister in his orders, and rehabilitate him.Sedes apostolica, pia mater. Indult for the abbot and his successors, and those of the monks who hold or shall hold office in the monastery, to have a portable altar, and to celebrate or cause to be celebrated thereon by other fit priests masses and other divine offices, and to celebrate or cause to be celebrated thereon masses even before daybreak when their business requires it and when, in the exercise of such offices, they, for the defence of the rights and for the utility and advantage of the said monastery, betake themselves to remote and divers parts of the world where they cannot easily have access to churches or chapels where masses can be celebrated (fn. 17).
