Mandate (the pope having been informed by Dermit Macgerreastyr, priest, of the diocese of Kilfenora, that Denis Macgeruastyr, perpetual vicar of Noua alias de Nuocouayl in the said diocese, a public and notorious fornicator, has dilapidated and alienated etc. the goods of the said vicarage and committed simony, to the shame of the priestly order) if and after Dermit (who was lately dispensed by papal authority, on account of illegitimacy as the son of unmarried parents, to be promoted to all, even holy orders and hold a benefice even with cure, after which he had himself so promoted) accuses Denis before the above three, to summon Denis, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said vicarage, value not exceeding 4 marks sterling, to Dermit, to whom the pope hereby grants that he may resign the said vicarage, simply or for exchange, when he pleases, and receive and retain instead a similar or dissimilar benefice, notwithstanding the said defect etc. Vite etc. (P. and H. Nicholas V (upon learning that the perpetual vicarage of Dubgere in the diocese of Killaloe (Laonien.) had become void because Donatus bishop of Killaloe had summoned to his presence and by a definitive sentence deprived and removed for his faults and demerits Henry Olacdeayn, by his ordinary authority, and had made collation and provision thereof by the said authority to Denis Odalayd, priest, of the said diocese; and that by virtue of the said collation and provision Denis had obtained possession and had held it for about nine years, but was in doubt as to whether they held good) granted on Prid. Id. Feb. anno 8 [12 Feb., 1455] a mandate to a certain judge [not here expressed] to collate and assign the said vicarage, value not exceeding 5 marks sterling, to the said Denis, whether it were still void as above, or by the death of David Idalayd, or by the resignation of the said Henry, or in any other way. Feb. anno 8 [12 Feb., 1455] a mandate to a certain judge [not here expressed] to collate and assign to Donald Macciaedagayn, priest, a canon of Elphin, the perpetual vicarage of Chilerua(n) in the diocese of Elphin, value not exceeding 3 marks sterling, so long void, because John Macciaedagayn, having obtained it by canonical collation, had held it for more than a year without having himself ordained priest and without dispensation, that by the Lateran statutes its collation had lapsed to the apostolic see; whether it were void as above, or by the resignation of Florence Miccieadagayn (rectius Micciaedagayn), or in any other way, and notwithstanding that he had been received by authority of the ordinary as a canon of Elphin. Inasmuch as the said pope died before his letters were drawn up, the pope hereby decrees that the said grant shall hold good from the said date, and that these presents shall suffice as proof; with mandate to the above dean to collate and assign as above. Mandate (the pope having been informed by Cornelius Omulchonere, clerk, of the diocese of Ardfert, that Florence Osullevan, rector of the rectory of Inisdasleioueg otherwise commonly called the parcels of Cahyirbreslean and Kylldacom and Kyillymunelleach, (fn. 2) in the diocese of Ardfert, (fn. 3) has committed simony and, being a public and notorious fornicator, has dilapidated and alienated etc. the goods of the said rectory, to the shame of the clerical order) if and after Cornelius (who lately, notwithstanding his illegitimacy as the son of a priest and prior, a canon regular professed of the order of St. Augustine and an unmarried woman related in the third degree of kindred, was made a clerk, and was afterwards dispensed by papal authority to be promoted to all even holy orders and hold a benefice even with cure, and who from fear of Florence's power has no hope of obtaining justice in the city and diocese of Ardfert) accuses Florence before the above bishop, to summon Florence, and if he find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said rectory, which is without cure and value not exceeding 3 marks sterling, to Cornelius, whether it become void by such deprivation, or be void by the death of Maurice Ysulleuuan, or by the resignation of the said Florence, or in any other way. To the bishop of Zamora and Andrew Macbradayd and Terence Ocayrbry, canon[s] of Kilmore (Triburnen.). Mandate, as below. Eugenius IV ordered Thady (Tyteus), now bishop of Kilmore, then perpetual and secular vicar of St. Bridget's (Sancte Brigide), Nurnagy, in the diocese of Kilmore, to be received as a canon of the Augustinian monastery of St. Mary, Druimleachan, in the said diocese, requiring him, as soon as he made his profession, to resign the said vicarage [see Cal. Papal Lett., IX, p. 493]. The said pope further ordered provision of the said priory, then void, to be made to the said Thady (Thiteus), after he had made the said profession, and willed that, after he had obtained the priory, he might hold therewith for life the said vicarage in commendam [ibid., p. 528]. Seeing that the present pope recently (after the said Thady (Thateus) had made his profession, had obtained the priory in virtue of the said letters, and had held therewith the vicarage in commendam for several years) made provision to him, still holding the vicarage in commendam, of the church of Kilmore, after which he was consecrated by the pope's order at the apostolic see, wherefore the said commenda has ceased and the vicarage is still void by the said profession, the pope hereby orders the above three to collate and assign to Nemeas Odroma, clerk, of the said diocese, who was lately dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all even holy orders and hold a benefice even with cure, and whom the pope hereby absolves from all sentences of excommunication etc. and also from simony and perjury, as far only as regards the taking effect of these presents, the said vicarage, value not exceeding 4 marks sterling; notwithstanding that he has been received by authority of the ordinary as a canon of the said church of Kilmore (Triburnen.), which was recently by order of the pope changed into the church of Kilmore (Keelmoren.). Mandate (the pope having been informed by Thomas Oduynd, perpetual vicar of Rosseyre (rectius Rosseyrc) in the diocese of Killala, that Thomas Omurchro alias Omurchuayn, perpetual vicar of Crosmolina and Eugenius Occunnan, rector of Rosseyre (sic), in the said diocese, public and notorious fornicators, have dilapidated and alienated the goods of their said respective benefices, that Eugenius is irregular on account of having been present at and taken part in divers fights, manslaughters, depredations and arsons, and that he and the said Thomas Omurchro have committed perjury, (fn. 5) to the shame of the clerical order), if and after the said Thomas Oduynd accuses them before the above three, to summon them, and if they find the foregoing to be true, to deprive and remove them (here with the spelling ‘Omurchu’), and in that event to collate and assign the said vicarage and the said church of Rosserie (sic), which is without cure and was formerly called the chancellorship of the church of Killala, their value not exceeding 12 marks sterling, to the said Thomas Oduynd. Nicholas V (upon being informed by Dermit Mackcleneayn, clerk, of the diocese of Kilmacduagh, that Eugenius Onyellayn, perpetual vicar of Killyhegney in the said diocese, had publicly kept concubines in his house and dilapidated and uselessly consumed for the purposes of the said concubines and other depraved purposes the goods of the said vicarage and, being under sentence of the greater excommunication on account of contumacy, and publicly so proclaimed, had celebrated and taken part in masses and [other] divine offices, even in contempt of the Keys, and incurred irregularity, to the shame of the clerical order) ordered on Kal. March anno 8 [1455] certain judges, if and after Dermit accused Eugenius before them, to summon Eugenius, and if they found the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said vicarage, value not exceeding 2 marks sterling, to Dermit. Mandate to collate and assign to Donald Okeallayd, scholar, of the diocese of Tuam, who is in his twenty-fourth year and is illegitimate, being the son of a clerk and an unmarried woman, after he has been made a clerk, the perpetual vicarage of Killoscoba in the said diocese, value not exceeding 4 marks sterling, void because John Meachada, clerk, of the said diocese, having obtained it by canonical collation, held it for more than a year without being ordained priest and without dispensation; summoning and removing Odo Macaedagayn, priest, of the said diocese, who has unlawfully detained possession, without any title, for more than two years but less than three, and from fear of whose power Donald cannot safely meet him in the city and diocese of Tuam; whether it be void as above, or be still void by the death of Donald Yrodichayn or the resignation of Odo Ymolchayn, or in any other way. To the prior of St. Mary's, Innysfalynd, in the diocese of Ardfert. Mandate, as below. The recent petition of Thady (Tatheus) Ycuyl, priest, of the diocese of Ardfert, contained that formerly, after Martin V's reservation to himself and his successors of the absolution from all sentences of excommunication etc. incurred for simony, and after Thady had been dispensed on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all even holy orders and hold a benefice even with cure, upon the voidance of the perpetual vicarage of Maghoflatym in the said diocese, of the presentation of the abbot and convent of the Cistercian monastery of St. Mary de Kyrieleyson in the said diocese, divers of Thady's friends promised, with his knowledge, to pay a sum of money to the abbot, or a certain son of his or a kinsman, to the intent that the abbot and convent should present Thady to the late Nicholas bishop of Ardfert, as a result of which bargain the abbot and convent or the greater part presented Thady to the said bishop who, perhaps ignorant of the said bargain, instituted Thady, under pretext of which presentation and institution he obtained possession of the said vicarage and detained it for some time, taking the fruits, and paid the said sum, being afterwards expelled by a certain adversary from possession, or removed therefrom by the agency of such adversary. The pope hereby, learning that the vicarage is void because Maurice Osullevayn held it for more than a year without being ordained priest and without dispensation, although he, who is an acolyte, of the said diocese, unlawfully detained it after the lapse of the said year, without having acquired any new title, for about another year, and still detains it, orders the above prior to absolve Thady from the said sentences etc., enjoining penance, dispense him on account of irregularity and rehabilitate him, and thereafter, summoning and removing the said Maurice, to collate and assign the vicarage, value not exceeding 12 marks sterling, to Thady, whether it be void as above, or by the death of Donald Ycayre, priest, or the resignation of the said Maurice or Donald, or in any other way. Mandate (the pope having been informed by Dermit Odonnagayn, priest, of the diocese of Ross, that Dermit Osuotharayn (rectius Ofuotharayn), (fn. 10) perpetual vicar of Myros in the said diocese, a public and notorious fornicator, has dilapidated, alienated, taken away, pawned and uselessly consumed and converted to the evil uses of his children the goods, chalices, books and other ecclesiastical ornaments of the said vicarage, and has permitted the said church to be reduced to profane uses and its roof to fall into ruin, (fn. 11) to the shame of the priestly order) if and after the said Dermit Odonnagayn (who was lately dispensed by papal author ity by means of (per) a certain sub-collector of the papal camera in Ireland, who alleged that he had sufficient power from the apostolic see, on account of illegitimacy as the son of a priest and an unmarried woman, to be promoted to all even holy orders and hold a benefice even with cure, after which he had himself so promoted) accuses the said Dermit Ofnothorayn (sic) before the above three, to summon Osnotharayn (sic), and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said vicarage, value not exceeding 6 marks sterling, to Odonnagayn; whether it become void by such deprivation, or be void by the resignation of the said Dermit Yfuothorayn or Roderick Yfuothorayn, or in any other way. To Thady (Tatheo) Odubayn, a Premonstratensian canon of St. John Baptist's de Cella parva in the diocese of Annaghdown. [Rehabilitation etc.] His recent petition contained that on the voidance by the death of Malachy Odubayn, a Premonstratensian canon, the said Thady's father and his immediate predecessor, of a certain vicarage or chaplaincy in the church of Annaghdown, wont to be assigned to secular clerks and sometimes wont to be governed by Premonstratensian canons, who believe this to be lawful to them in consequence of dispensations granted in accordance with certain privileges of that order, (fn. 12) collation was by authority of the ordinary made thereof to him, who had obtained no dispensation on account of illegitimacy as the son of the said Malachy, a priest openly professed of the said order, and an unmarried woman, and that under pretext of such collation he detained it for several years, taking the fruits, and that, having been deprived and removed therefrom by the ordinary, he has resigned it … Sedes apostolica, pia mater. Mandate (the pope having learned that the perpetual benefice without cure, called the rectory of the townland of the rural lands of Clonchumoisig in the diocese of Elphin, which benefice is situate within the bounds of the parish church of Kyllmaccuagin in the said diocese, (fn. 13) is void because Maelerus de Burgo, an Augustinian canon of St. Catherine's, Eachdruym Omayne, in the diocese of Clonfert, then a secular clerk and holding the said benefice, entered the said monastery and made his regular profession as a monk thereof, and has been void so long that by the Lateran statutes its collation has lapsed to the apostolic see) to collate and assign to William Oriegayn, perpetual vicar de Calseto in the diocese of Tuam (who alleges that the said benefice was formerly said to be part of the goods of the community of Elphin, who is a priest, and who was lately dispensed on account of illegitimacy, as the son of a married man and a married woman, by authority of the ordinary to be promoted to minor orders and hold a benefice without cure, and afterwards by papal authority to be promoted to all even holy orders and hold another [benefice] with cure [and resign both, simply or for exchange, as often as he pleased, and hold two other] benefices compatible with one another, in virtue of which dispensations he was promoted to minor orders and afterwards to all the said holy orders and obtained the said vicarage [de Calseto]) the said benefice, value not exceeding 2 marks sterling, whether void as above, or by the resignation of the said Maelerus, or in any other way; notwithstanding that he holds the said vicarage, value not exceeding 3 marks sterling. Mandate (the pope having been informed by David Macgillavanach, priest, of the diocese of Kilmacduagh (Duacen.), that John Ohallayd, perpetual vicar of Newtown (de Nova villa) in the said diocese, has publicly kept a concubine in his house, committed manslaughter upon a certain clerk and, being under the greater excommunication on account of the said manslaughter, has celebrated masses and other divine offices and taken part therein, contracting irregularity, to the shame of the clerical order) if and after David (who was lately dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman related in the second and second degrees of affinity, to be promoted to all even holy orders and hold a benefice even with cure, after which, having been so promoted, he obtained the rectory of Dunkalleyin in the said diocese, collated to him by papal authority, although he has been despoiled thereof by a certain adversary, and who, on account of the inordinate favours which the said John has in the city and diocese of Kilmacduagh, has no hope of obtaining justice therein) accuses John before the above bishop, to summon John, and if he find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said vicarage, value not exceeding 2½ marks sterling, to David; whether it become void by such deprivation, or be void because the late Roderick Macgillavanach held it [for more than a year] without having himself ordained priest and without dispensation, or be void in any other way, and notwithstanding that provision was lately ordered to be made to him by papal authority of the said rectory, with cure, and of a canonry of Kilmacduagh and the prebend of Kilhaenayn therein, of which he is not in possession, the value of all which does not exceed 3½ marks sterling, he being at the same time dispensed to receive and retain the said canonry and prebend.
