Dispensation to him, who is a priest, and the names and values of whose benefices, including the said church, the pope holds to be sufficiently expressed by these presents, to receive and retain for life any two benefices with cure or otherwise incompatible with one another, even if dignities etc., even if two parish churches or their perpetual vicarages or chantries. or such mixed, etc., and to resign them, simply or for exchange, as often as he pleases, provided that the fruits of one of such parish churches (fn. 3) do not exceed a yearly value of 100 gold ducats of the Camera, etc. Vite etc. (Her. and Ja. To Richard, bishop of Killala (Aladen.). Dispensation to him, who cannot from the fruits etc. of his episcopal mensa of Killala, which is in Ireland, keep up his state, especially when in England, where on account of wars and other calamities he is at present residing, and who cannot go to his church without very great peril, to receive and retain for life in commendam with the said church, and as long as he is bishop thereof, any benefice with or without cure wont to be held by secular clerks, even if a parish church or its perpetual vicarage, chantry etc., or a dignity etc., provided that such dignity be not major in a cathedral or a metropolitan or principal in a collegiate church, and to resign it, simply or for exchange; notwithstanding that he is a professed monk of the Carthusian order etc. Personam tuam. To Thady Magillacosgli, a canon of Clogher, and the official of Clogher. Mandate, at the recent petition of Malachy Macmachuna, clerk, of the diocese of Clogher (containing that a fourth part of the tithes and other ecclesiastical obventions, and a parcel of lands called the grange of Lisdroma, in the plebs of Muindeirstephayn, which belong to the Augustinian monastery of SS. Peter and Paul, Cloaneois, in the said diocese, have been wont to be by the abbot and convent given or granted to farm or rent for a certain yearly cess, especially to laymen; and that if the said fourth part of the tithes and obventions and parcel of the grange were granted to the said Malachy to farm or rent or pension he would pay yearly a greater cess than has hitherto been paid therefrom, whereby the condition of the monastery would without doubt be improved (fn. 4) ) to summon the said abbot and convent and others concerned, and if they find the facts to be as stated, and that such grant would be to the evident utility of the said monastery, to grant the said fourth part of tithes and obventions and parcel of the grange, (fn. 5) for a greater yearly cess than the monastery or the abbot and convent have hitherto received, to Malachy, provided that the abbot and convent shall not wish to retain them for themselves. To Henry Kingornn, perpetual vicar of the parish church of Obyne in the diocese of Aberdeen. Dispensation to him, who is a priest and was chamberlain (camerarius) of the late Mary queen of Scots, and holds the said vicarage, a canonry of Moray with the prebend of Kingusi, and a canonry of Aberdeen with the prebend of Inueruothi (recte Inuernochi), value not exceeding 9l., 20l. and 13l. sterling respectively, to receive with the said vicarage any one other benefice, or without it any two other benefices, with cure or otherwise incompatible, even if two parish churches or their perpetual vicarages or dignities etc., even major or principal dignities, or such mixed, etc., and to retain them for ten years if parish churches or their perpetual vicarages, or such mixed, for life if other incompatible benefices, and to resign them all, simply or for exchange, as often as he pleases.Vite etc. (H. and G. To the bishop of Silves (Siluen.), and the chancellor and the treasurer of Ardfert. Mandate, as below. The recent petition of Hobertus Dondini, clerk, of the diocese of Ardfert, contained that after he had been by John Pihyk, (fn. 6) then appointed [collector] of fruits etc. due to the papal camera in the province of Ireland, and having, as he alleged, special power for the purpose, dispensed by papal authority, on account of illegitimacy as the son of a priest and an unmarried woman, to be promoted to all even holy orders and hold a benefice even with cure, he caught a thief one night in his house, delivered him to the burgesses and to the provost of the town of Ardfert, as the true bailiff and officer of the bishop of Ardfert, to whom the jurisdiction of the said town belongs, but not with the intention that the thief should be put to death, and that the said burgesses and officer handed over the thief to a certain temporal lord, their comburgess, as their chief, to whom belonged the punishment of the thief, and who, in accordance with the law etc. of the said town, put him to death (fn. 7); that afterwards, upon the voidance of the perpetual vicarage of the parish church of Ryndbeara in the said diocese because Maurice Fyssemoris, having obtained it by canonical collation, held possession for more than a year without having himself ordained priest and without papal dispensation, John bishop of Ardfert made collation and provision of it to him by his ordinary authority, under pretext of which he took possession, and has held possession for more than three years but less than four, as he does at present, and that he has moreover had himself promoted to all holy orders and ministered therein for more than the said three years. The said collation and provision being therefore without force, and the vicarage still void as above, the pope orders the above three to absolve Hobertus, who alleges that he was not to blame otherwise than as above for the death of the said thief, for which he grieves from his heart, from the said excesses, enjoining penance, dispense him on account of any irregularity contracted, and dispense him to minister in his orders, even in the office of the altar, and rehabilitate him, and in the event of their so doing, to collate and assign to him the said vicarage, value not exceeding 8 marks sterling. The pope hereby dispenses him to receive and retain it, and to resign it, simply or for exchange, once only, notwithstanding the said defect of birth etc., but before they proceed to execute these presents he is to resign it to them.
