To all the inhabitants of both sexes near the chapel of St. Mary called Mersschapell situate by the seashore within the bounds of the parish of the parish church of Fulstowe, in the diocese of Lincoln. Grant, as below. Lately, upon its being set forth to the pope on their behalf that the said chapel was distant a mile of those parts from the said parish church, and that by reason of floods and other perils of the way they were often unable to go thither for burials without great difficulty, the pope by other letters granted to them that they might erect a cemetery near the said chapel, and therein, after it had been consecrated by the ordinary or any other catholic bishop of their choice, bury their dead after the manner of the country, the rector of the said church being convoked or his deputy, or any other priest invited by him for the purpose. (fn. 2) At their recent petition (containing that between [them and] the abbot and convent of the Cistercian monastery of Louth Park (de Parco ludo) in the said diocese, to whom the said church is united in perpetuity, a fit portion being reserved for a perpetual vicar presented by them and instituted by the ordinary, various riots and dissensions have arisen because (fn. 3) no mention was made in the said letters of the said union and perpetual vicar, only the rector of the said church, who is in reality a vicar, being named, wherefore the said inhabitants doubt whether the said letters are not surreptitious) the pope hereby grants to them, who allege that in virtue of the said indult they have erected such cemetery and had it consecrated by John bishop of Ardfert (Hartfertensem episcopum), which consecration the pope hereby approves and confirms, that the said letters shall hold good from the date of these presents in all respects, as if full and express mention had been made therein, of the said union and vicar, and not of a rector. The pope further grants them indult that they may invite, if they wish, the vicar of the said church and (ac) the chaplain of the said chapel, or if not, any other priest, for such burials, (fn. 4) without prejudice, however, to the said abbot and convent or parish church. To Eustace de Maxwel, priest, of the diocese of Glasgow. Rehabilitation, as below. His recent petition contained that, after he had been dispensed by papal authority, on account of illegitimacy as the son of unmarried parents, to be promoted to all even holy orders and hold a benefice even with cure, and had had himself in virtue thereof so promoted and had obtained, collated to him by authority of the ordinary, the perpetual vicarage of the parish church of Moiboil in the said diocese, with cure, and had held it in peace for more than two years but less than three, he held together therewith for about a month, without further papal dispensation and against ‘Execrabilis,’ the provostship of the same Moiboil, a principal dignity with cure, canonically collated to him; and that after John Seres, priest, of the said diocese, alleging that he had been presented to the said vicarage by the patrons, the abbess and convent of the Benedictine monastery of North Berwyk in the diocese of St. Andrews, and had been instituted by the ordinary, had obtained possession and (Eustace having been removed therefrom) had held and possessed it for some time, the said Eustace and he, desiring to exchange the provostship and vicarage, resigned them for that purpose to the dean and chapter of Glasgow, the episcopal see being void, who made collation of the provostship to John and of the vicarage to Eustace, in virtue of which collation Eustace again obtained the vicarage, and has detained it for about two years. At the said petition, adding that he has since been removed by papal authority from the vicarage as a detainer, and has utterly resigned it, as well as the provostship, the pope hereby rehabilitates him on account of the foregoing. To Thomas Penven, a canon of Glasgow. Mandate to admit the resignation which Simon de Blakwode proposes to make of his perpetual vicarage of the parish church of Symonton in the diocese of Glasgow, and to collate and assign it, value not exceeding 9l. of old sterlings, to Thomas de Blakwode, priest, of the same diocese, if found fit; and to reserve and assign to the said Simon a yearly life pension of four chaldrons of meal from the tithes of sheaves of the said vicarage, which do not exceed a yearly sum of 3l. of like sterlings, (fn. 6) to be paid to him or his proxy by Thomas and his successors. To John Piret (or Pirot), rector of the parish church of Stone in the diocese of Rochester (Rossen. recte Roffen.). Dispensation to him, who is by both parents of noble birth, and holds the parish church of Stane (sic) in the diocese of Rochester (Rossen.), value not exceeding 100l. of petits tournois, to receive and retain for life with the said church any one other benefice, or without that church any two other benefices, with cure or otherwise incompatible, even if parish churches or their perpetual vicarages or dignities etc., even major or principal dignities, or such mixed etc., and to resign them, simply or for exchange, as often as he pleases, notwithstanding the constitutions of the legates Otto and Ottobon, etc. Nobilitas generis, vite etc. (H. and A. To William Heris, priest, of the diocese of Glasgow. Reservation etc., as below. Seeing that he has this day ceded to the pope the suit, pending before certain judges without the Roman court by commission of the ordinary, between him and Gilbert de Rereck, a canon of Glasgow, about the parish church of Kyrkgunzane in the said diocese, of the patronage of laymen, and all his right in or to the said rectory; and seeing that the pope, admitting the said cession, and calling up the cause to himself and extinguishing it, has by other letters ordered provision to be made of the said church to the said Gilbert, the pope hereby, in order that William may not suffer any loss on account of the said cession, reserves and assigns to him a yearly pension of 20 marks of the money of Scotland, which do not exceed the sum of 5l. sterling, on the fruits etc. of the said parish church, to be paid to him at Glasgow, for life or until he obtain a benefice of the value of 40 like marks, by the said Gilbert, who has consented, and by his successors in the rectory, half at Christmas and the other half on the feast of the Nativity of St. John Baptist; with penalties for delay in payment etc. Nobilitas generis, vite etc.

To Robert Penwen, clerk, of the diocese of St. Andrews. Reservation etc., as below. Seeing that he has this day ceded to the pope by a certain proctor (not here named) all right belonging to him in or to a canonry of Glasgow and the prebend de Glasgu primo therein (about which a cause was feared between him, who alleged that provision was made or ordered to be made to him by papal authority, and Thomas de Forsyth a canon of the said church) in pursuance of an agreement arrived at between them as the result of the intervention of Andrew bishop of Glasgow and a number of their friends for the sake of peace; and that the pope, admitting the said cession, granted to the said Thomas that the collation and provision made to him, also by papal authority, of the same canonry and prebend, and their consequences should hold good, the pope, in order that Robert may not suffer any loss on account of the said cession, reserves and assigns to him a yearly pension of 20l. of the money of Scotland, which do not exceed the sum of 8l. sterling, on the fruits etc. of the said canonry and prebend, to be paid in Glasgow, half at Christmas, half at the Nativity of St. John Baptist by the said Thomas, who has consented, and by his successors the holders of the said canonry and prebend, for seven years or until, with the help of the said Thomas (fn. 8) provision has been made to him by the said bishop of a benefice of a yearly value of 20l. of the money of those parts; with penalties for non-payment etc. Vite etc.

Dispensation to receive and retain for life together with the said church, value not exceeding 50l. of petits tournois, any one other benefice, or without the said church any two other benefices, with cure or otherwise incompatible, even if parish churches or their perpetual vicarages or dignities etc., even major or principal dignities, or such mixed, etc., and to resign them, simply or for exchange, as often as he pleases; provided that if parish churches or perpetual vicarages, the value of each of them (fn. 9) shall not exceed 100 gold florins of the camera. Grant to him, to whom the pope has this day made provision of the said church, to retain in commendam for life therewith, even after his consecration, and after he has got possession of the rule and administration, the parish churches of Wenslowe in the diocese of York and Fonditton in that of Ely, value together not exceeding 100 marks sterling, which he was, and is still, holding together by papal dispensation.   • 1. On the back of the volume is the usual modern description in Italian: ‘Pio ii. 1464. Anno to. Lib. 3’ and on a modern flyleaf is Mgr. Wenzel's ‘An. 6 to. 3.’ A contemporary flyleaf has, in different contemporary hands, the description: ‘Tertius de diversis anno vio domini nostri domini Pii pape ii,’ the order: ‘R(ecipe) Jo. P. [i.e. P. de Varris],’ and the corresponding: ‘Rubricatus [est] per me Johannem Monroyg,’ etc., e.g. the frequently occurring ‘Quesit(us).’ A like contemporary description ‘Tertius …’ occurs also, as usual, on the bottom edge of the volume. The text extends from f. i. to f. cccviiii.

  • 5. The MS. Indice to the Lateran Registers of Pius II has under the letter ‘G’ the following, as occurring in Lib. iii. an. vi. (i.e. Reg. DXCVIII), f. 59: ‘Glasgnensis (sic), Thomas de Blackwode. Vicaria per resignationem.’ The ‘f. 59’ of the Indice is evidently an error for ‘f. 62’ as below, p. 224.
