Confirmation, as below. The recent petition of William Knolis, preceptor of the house of St. John of Jerusalem, Torfichem, in the diocese of St. Andrews, contained that recently the late Peter Raymondus (sic) Zacosta, master, and the baiulivii (sic), priors, preceptors and brethren of the said hospital, assembled in their chapter-general at Rome, dispensed, in virtue of letters granted to them by the present pope, the said William, who had already made his profession of the order, so that (notwithstanding the establishments (fn. 2) of the said hospital, by which it is said to be provided that it shall not be lawful for brethren thereof, who have not served for three years in the convent of Rhodes or at least for five years in the said religion, (fn. 3) to seek any preceptorships, and notwithstanding that he had not served in the said convent for three years or the said religion for five years) he might lawfully seek from the said master and convent the preceptorship of the house of St. John, Torfichem, of the said hospital, then void by the death of Henry de Levynsten'; and that they afterwards, in virtue of the said letters, collated and granted to him the said preceptorship for life. The pope therefore confirms hereby the said dispensation and collation and grant, and orders the archbishop of Arles and the bishops of St. Andrews and Dunblane to induct the said William, etc. The pope exemplifies:—

(20 Dec.) anno 3, empowering the master and brethren to receive and admit resignations of priorships, preceptorships or baiulive etc., made simply or for cause of exchange, and to make collation and provision thereof, notwithstanding any constitution etc. to the contrary;

To the abbot of St. Mary's, Middleton (de Choro [Sancti] Benedicti) in the diocese of Cloyne (Clonen.) and Dermit Oleyn and Dermit Okym, canons of Cloyne. Mandate, as below. The pope has learned that the perpetual vicarages of the parish churches of Killchru(m)pyr and Muchrony in the diocese of Cloyne have been so long void that [there is no certain knowledge of the mode of voidance, and that] their collation has by the Lateran statutes lapsed to the apostolic see, although William Ohenassy, who behaves as vicar thereof, has without any canonical title by his own temerity unlawfully detained possession for more than four years but less than five; and the recent petition of Nicholas, abbot of the Cistercian monastery of St. Mary, Fermoy (de Castro dei) in the said diocese contained that the fruits etc. of that monastery are so slight that he cannot be maintained therewith, keep up hospitality and provide for (adsupplere et intendere) the repair of the church, cloister, dorter and refectory of the said monastery, which are threatened with ruin, the said churches being, as the said abbot adds, near the monastery, and the value of the said monastery and vicarages of Kyllchru(m)pir and Muchrony not exceeding 30, 8 and 4 marks sterling respectively. The pope therefore, holding the true and last modes of the voidances of the said vicarages to be expressed by these presents, orders the above three to summon William and others concerned, and if they find the foregoing to be true, to appropriate and unite the vicarages to the monastery [in perpetuity], so that abbot Nicholas or the abbot for the time being may take possession by his own authority, etc. Pastoralis officii debitum. Mandate (the pope having been informed by Peter Canthuel, clerk of the diocese of Ossory, that John Hedyan, archdeacon of Ossory, an open fornicator, has committed simony and alienated a number of goods in which the rents of the said archdeaconry consist) if and after Peter, who is of noble and baronial birth, and is in about his twentieth year, and who from fear of John's power cannot safely meet him within the city or diocese of Ossory, accuses John before the above three, to summon John and others concerned, and if they find the foregoing to be true, to deprive and remove John, and in that event to collate and assign the archdeaconry, a non-major elective dignity without cure, value not exceeding 40 marks sterling, to Peter, if found fit. Mandate (the pope having been informed by Maurice Ohyffirnayn, clerk, of the diocese of Cashel, that John Fwhit, chancellor of Lismore, is an open and notorious fornicator, has dilapidated immoveable goods of the chancellorship, and has committed perjury) if and after Maurice (who was lately dispensed by papal authority, on account of illegitimacy as the son of an abbot and an unmarried woman, to be promoted to all even holy orders and hold a benefice even with cure, in virtue of which he had himself made a clerk) accuses John before the above three, to summon John and others concerned, and if they find the foregoing to be true, to deprive and remove John, and in that event to collate and assign the chancellorship, which is an office, and to which is annexed the perpetual vicarage of the parish church of Clomel in the diocese of Lismore, and which has cure and is non-elective, value with the said annex not exceeding 35 marks sterling, to Maurice, if found fit. Indult, at her petition (to the effect that, when living in England she, constrained by very many sufferings and tribulations, made divers and almost innumerable vows, impossible of fulfilment by her on account of her weak health, for example many fastings, the observance of which vows very often involves fasting four or five times a week and several pilgrimages to divers places unsafe for her, or rather inaccessible for her without manifest bodily peril, wherefore, as also because she is deprived of her moveable goods, she cannot conveniently fulfil, as is becoming and as she desires, the aforesaid and may other vows taken by her) (fn. 10) to choose a fit secular or regular priest as her confessor who, after having heard her confession, may grant her absolution, once only, for her crimes, excesses and sins and perjuries and transgressions of any vows, and also from all sentences of excommunication etc., even in cases reserved to the apostolic see, except offence against ecclesiastical liberty, violation of interdict imposed by the said see, crimes of heresy, any offence of disobedience or rebellion or conspiracy against the person or estate of the Roman pontiff or the apostolic see, etc., and, in general, in the casesx contained in the usual bull of Holy Thursday, (fn. 11) and in other cases not reserved to the said see absolution as often as opportune, enjoin salutary penance and commute into other works of piety all her vows, past and future, which she is or shall be unable conveniently to observe, except only the vow of Crusade, (fn. 12) and moreover that the said confessor or other of her choice may grant to her, being penitent and having confessed, plenary remission of all her sins, once in life and once in the hour of death, sic tamen quod idem confessor etc.ut in forma confessionalis. To the bishop, the archdeacon and the chancellor of Kilfenora (Finaboren.). Mandate, as below. Upon its being set forth to Nicholas V on behalf of the abbot and convent of the Cistercian monastery of St. Mary O'Dorney (de Kyrieleison) in the diocese of Ardfert that the late James de Geraldinis, earl of Desmond, and the late Patrick Frytzmores (sic), chief of his sept and certain other laymen, subjugated the said monastery to their jurisdiction and temporal rule as if it were their own patrimony, imposed and exacted from the abbot and convent and the monastery feudal dues, stipends, tallages, commons etc. against ecclesiastical liberty, sent their men and subjects at their own expence to the wars, and afflicted them with other grievances, (fn. 14) thereby incurring sentences etc., the said pope ordered the abbot of Corcomroe (de Petro [sic] fertili) in the diocese of Kilfenora and the dean and chancellor of Kilfenora to summon the said earl and others concerned, and if they found the foregoing to be true, to monish them and their abettors and accomplices to desist therefrom and restore to the abbot and convent what they had taken away from them, or to make a composition with them, under pain of the said sentences etc. The recent petition of the present abbot and convent to the present pope contained that the said earl, perhaps from fear of the said censures, ceased for some years from such rapines and insolences, but that, he being dead, his son Thomas de Geraldinis, earl of Desmond, and Thomas Frytzmores (or Feytzmores), now chief of his sept, (fn. 15) son of the said Patrick and marshal of those parts under the said earl, contemning the said censures and pains, commit not only the aforesaid but many other crimes etc. against the said abbot [and] convent and monastery, etc., the pope hereby orders the above three to summon the said earl and others concerned and do by papal authority what is lawful, and if they find that processes, monitions and citations cannot be safely published to the said earl etc., to publish the same by public edict affixed when necessary in neighbouring places, the which processes etc. shall be binding as if personally served.Romanus pontifex precipuus iusticie conservator. Mandate (the rectory and perpetual vicarage of the parish church of Letyr in the diocese of Cloyne, which are of the patronage of laymen, and each of which has cure of souls, being, as the pope has learned, void because William Canton the yellow (Flavus) held possession of them, canonically collated to him, for more than a year without being ordained priest and without papal dispensation, and having been void so long that by the Lateran Statutes their collation has lapsed to the apostolic see, although the said William has detained the said vicarage for three other years after the said year, also without being promoted to any holy orders, and although Maurice Roche, clerk, of the said diocese, has unduly detained the said rectory for about eight years without any title; and the recent petition of the abbot and convent of the Cistercian monastery of St. Mary Fermoy (de Castro dei) in the said diocese containing that the fruits etc. of their said monastery are so slender that they cannot be becomingly maintained therewith, and cannot conveniently provide for the repair of the cloister and other places of the monastery which, by reason of wars and other misfortunes which in times past afflicted those parts, are in great part threatened with ruin) to summon the said William and Maurice and others concerned, and if they find the foregoing to be true, and provided that the said patrons consent, to incorporate and unite in perpetuity the said rectory and vicarage, value not exceeding 8 and 10 marks sterling respectively, to the said monastery, value not exceeding 30, so that the abbot and convent may take possession by their own authority, etc. Pia devotione. Mandate at the recent petition of David Canton, clerk, of the diocese of Cloyne (containing that although the rectories of the parish churches of Cloyndalayn and Killchrompit (recte Killchrompir) and Muchrony, belonging to the monastery of St. Mary, Glasargy, of the order of Tiron, (fn. 17) in the diocese of Ferns, and wont from time immemorial to be granted to farm to secular clerks by the prior of the said monastery, have been held by him for more than ten years at a yearly cess, by grants made to him for five years at a time by the said prior, nevertheless, inasmuch as he has repaired and restored at his own expense the said church of Mucrony, then in ruin, and has brought into better condition that of Cloyndalayn, he fears lest in future he may be molested) to summon the prior and the convent of the said monastery from fear of whose power David cannot safely meet them within the city and diocese of Ferns, and others concerned, and if they find the foregoing to be true, to grant the said rectories to David, who alleges that he is of the stock of the founder of the said monastery and is of noble birth, for life at the said farm, without prejudice to the said monastery, and to preserve him in possession, provided that he pay the said cess. Mandate to collate and assign to Master Fergus Magdowel, clerk, of the diocese of Whiteherne, a notary of the pope, who is by both parents of a noble race of barons and has been sent to the pope by James king of Scots as his orator, the parish church de Caueris in the diocese of Glasgow, of the patronage of laymen, value not exceeding 40l. sterling, so long void, by the resignation of the late William Forestar before a notary public and witnesses, that by the Lateran Statutes its collation lapsed to the apostolic see, although the present abbot of the Cistercian monastery of Melros in the said diocese of Glasgow, and a number of his predecessors, and the convent thereof, taking possession by their own authority without a tittle of any right, and without any title, have unduly detained possession for more than forty years but less than forty-seven years since the said lapse; admitting by papal authority the said resignation, if they find that it was lawful and if it has not been already admitted, and summoning and removing the said present abbot and convent. To the dean of Leighlin and Patrick Obroyn and Malachy Ochogly, canons of the same. Mandate as below. The pope has learned that Patrick Obryn, clerk, of Ferns, desires to enter the Augustinian monastery of St. Mary, Ferns; and has been informed by the said Patrick that Thomas Odruffyn, abbot of the said monastery, has committed perjury and, being under sentence of excommunication and proclaimed as such, and remaining thereunder for several years, has celebrated masses and other divine offices, thereby incurring irregularity. Seeing that the deprivation and removal of the said abbot from the rule and administration (of which he was despoiled de facto by Donald Omurthy, a canon of the said order, under pretext of certain letters granted to him by Pius II, the execution of which was proceeded to after the death of that pope on the vigil of the Assumption in the year of out Lord 1464, which letters were impetrated by the said Donald more than a year and a half before the said death) are null, the pope hereby orders the above three, if and after Patrick (who alleges that he is illegitimate, being the son of unmarried parents, and that the said Donald has without any canonical title for more than two years but less than three, unduly detained possession of the said monastery, under pretext of the said letters and processes, and that from fear of the power of Thomas and Donald he cannot safely meet them within the city or diocese of Ferns) accuses Thomas before the said three, to summon Thomas and Donald and others concerned, and if they find the foregoing to be true, to deprive Thomas, and remove both him and Donald, and in that event, and if they find Patrick fit, to receive him and cause him to be received as a canon of the said monastery and receive his regular profession, and thereupon (extunc) to make provision to him of the said monastery, value not exceeding 16 marks sterling, whether it become void by such deprivation and removal, or be void by the death of Patrick Imurthy, or in any other way. The pope hereby grants that he may, in that event, be blessed by any catholic bishop, and dispenses him to be appointed abbot and exercise the rule and administration, notwithstanding the said defect, etc. Apostolice sedis providentia. To John Spalding, dean of Brechin, M.A. Reservation etc., as below. The pope has this day, upon learning that Richard Wily, archdeacon of Brechin, desired to enter the Benedictine monastery of St. Mary, Calco alias Kelso, in the diocese of St. Andrews, ordered certain judges [not here expressed] to receive or cause him to be received as a monk thereof and to cause the regular habit to be given to him, and to receive his regular profession, the pope's will being that as soon as he had received the habit and made his profession, or as soon as the year of his probation had elapsed etc., he should resign all his benefices. The perpetual vicarage of the parish church of Dunde and the parish church alias the rectory of Ki[n]nel, in the dioceses of Brechin [and] St. Andrews, which the said Richard was and is holding by papal dispensation, being therefore about to become void, the pope (at the petition of James king of Scots, whose counsellor and confessor and master of whose chapel royal the said John is, alike in the respect of the present matter and also of his promotion to the church of Dunblane, then void), reserves to his own gift the said vicarage and church of Kinnel, the value of each of which does not exceed 30l. sterling, for collation to John, who was lately dispensed by papal authority to receive any two benefices with cure or otherwise incompatible, even if parish churches or perpetual vicarages or dignities etc., and to retain them for seven years if they were parish churches or perpetual vicarages, or for life if they were other incompatible benefices, and to resign them, simply or for exchange, as often as he pleased etc., and who holds inter alia the deanery of Brechin, a major elective dignity. The pope hereby dispenses him to receive the said vicarage and church, and retain them together with the said deanery for three years, and to resign all three, simply or for exchange, as often as he pleases, etc. Litterarum sciencia, vite etc.

The recent petition of abbot Richard and the convent of the Benedictine monastery of St. Egwin (sancti Eguini), Evesham, immediateley belonging to the Roman church, in the diocese of Worcester, contained that formerly John bishop of Worcester (considering that, inasmuch as the Benedictine monastery of Alcester (de Aluicestria) in the said diocese, founded and endowed by the progenitors of Edward king of England and of the patronage of that king by reason of his duchy of Lancaster, was by the neglect etc. of divers of its abbots etc. so much decayed that the abbot alone remained therein, without a convent, and that its fruits etc. were so much reduced that they were not sufficient for the becoming maintenance of the statutory number of monks and the observance of hospitality etc., the said king had, for the foregoing reasons, given and granted in frankalmoin the patronage and advowson of the said monastery to the said abbot and convent of Evesham, in order that divine worship might be the more honourably performed in the said monastery of Alcester etc.), after deliberating with the chapter of Worcester, and with consent of them and of the archdeacon of Worcester, gave commission in the matter of uniting the said monastery of Alcester to that of Evesham to Henry Pant, clerk, licentiate in decrees, who, after due inquiry and with consent of the said king, united and appropriated Alcester to Evesham, in such wise that the abbot and convent of the latter might on the voidance of Alcester, take possession etc.; and ordained, moreover, that a monk of Eversham, in priest's orders, should be constituted prior or warden in Alcester, and that two other monks of Evesham, also in priest's orders, all three removeable at the pleasure of the abbot and convent of Evesham, should along with the said prior celebrate masses and the canonical hours in Alcester, the three to receive competent maintenance from the said abbot and convent for the keeping of hospitality and exercising other works of piety etc., and to be subject and obedient to the said bishop and his successors, the said bishop and his successors to exercise over them (fn. 19) and the said monastery of Alcester and the churches and places belonging to it from of old the [same] visitation and correction and every respect of jurisdiction as he had hitherto exercised, and the said abbot and convent to pay yearly at Michaelmas to him and his successors, in recognition of superiority, 13s. 4d. and to the prior and chapter of Worcester 6s. 8d., and to the said archdeacon and his successors also 6s. 8d., as is said to be more fully contained in authentic letters or public instruments of the said king, bishop and commissary. At the said petition, adding that they desire the said union and appropriation to be made anew (de novo) by papal authority, the pope hereby appropriates and unites in perpetuity the said monastery of Alcester with its churches etc. to that of Evesham, so that on the resignation or death etc. of the present abbot of Alcester the said abbot and convent may take possession by their own authority etc., and furthermore ordains that there shall be in Alcester a prior and two monks from Evesham, with the provision for subjection to the bishop, yearly payments, etc. as above.
