To the abbots of Paisley (de Pasleto) and Calco, in the diocese of Glasgow and St. Andrews, and the archdeacon of Glasgow. Mandate as below. The recent petition of Thomas Penven, rector of the parish church of Taubarten’ in the diocese of Glasgow, bachelor in decrees, contained that he and the late Adam de Auchinlek, desiring to exchange a canonry of Glasgow and the prebend de Glasgu primo and a canonry of Glasgow and the prebend of Kirkmanchquho (fn. 2) respectively, resigned them to the ordinary, who made the exchange, in virtue of whose collation and provision Thomas obtained the said canonry and prebend of Kirkmanchquho, and is still in possession, but now doubts whether the said collation and provision hold good. The pope therefore (absolving Thomas, as far only as regards the taking effect of these presents, from any sentences of excommunication etc. arising from any cause, and perhaps inflicted by Master Peter de Valle, a chaplain of the present pope and an auditor of causes of the apostolic palaces, in a cause before him by papal commission between the said Thomas and John Donaldi, clerk, of the diocese of Glasgow, about the chancellorship of Dunkeld, and dispensing him on account of irregularity contracted when under the said sentences) orders the above three to collate and assign to Thomas, who is a priest and M.A., the said canonry and prebend of Kirkmanchquho, which is of the patronage of laymen and the patron of which consented to the said collation and provision made to Thomas, as above, and the value of which does not exceed 80l. of old sterlings, whether void as above, or by the death of the said Adam, or in any other way; notwithstanding that he holds the said church, value not exceeding 16l. of old sterlings, and that provision was lately made to him of the said chancellorship, a non major dignity with cure, of which he is not in possession, value not exceeding 20l. of old sterlings, and that he was lately dispensed by papal authority to receiveand retain for life, together with the chancellorship, a dignity etc. or a benefice with cure, in virtue of papal letters ordering provision to be made to him thereof, or any two other benefices with cure or otherwise incompatible, even if dignities etc. and to resign them, simply or for exchange, as often as he pleased, and receive instead two other incompatible benefices and retain them for life, or for two years only in the case of major or principal dignities or one of such and a parish church. To the dean, the archdeacon and the precentor of Cork. Mandate to collate and assign to John Tirry, priest, of the diocese of Cloyne (Clonen.), who was lately dispensed by papal authority on account of illegitimacy as the son of a priest and an unmarried woman, to be promoted to all even holy orders and hold a benefice even with cure, and who was afterwards so promoted the rectory of the parish church of Tempulruayn in the diocese of Cork, with cure and of the patronage of laymen, value not exceeding 7 marks sterling, so long void, because John Bryt, having obtained it by canonical collation, held possession for more than a year without having himself ordained priest, and without dispensation, that by the Lateran statutes its collation has lapsed to the apostolic see: notwithstanding that the present pope has ordered provision to be made to him of the perpetual vicarage of Carigtuathayl and the rectory of Rathcormaik in the said diocese, the value of each not exceeding 6 marks sterling, and by the same letters dispensed him to receive and retain them together for life. He is hereby dispensed to receive the said rectory of Tempulruayn, and retain it for life together with the said vicarage and rectory of Rathcormayk, notwithstanding the said defect etc. Vite etc. (P. and G. To the bishop and dean of Clonmacnoise. (Cluanen.) and the prior of Galynd in the diocese of Clonmacnoise. Mandate (the pope having been informed by Thady Olongayn, clerk, of the diocese of Meath, that Henry Ocynga, rector of the parish church of Achnurcayr in the said diocese, has openly kept a concubine and dilapidated etc. and uselessly consumed the goods of the rectory and committed simony) if and after Thady (who is in about his twenty-third year, and lately had himself made a clerk notwithstanding his illegitimacy as the son of a priest of the order of St. Augustine and an unmarried woman, accuses Henry, who also neglects to reside in the said rectory, and from fear of whose power Thady has no hope of obtaining justice in the city or diocese of Meath, before the above three, to summon Henry and others concerned, and if they find the foregoing to be true, or one of them enough for the purpose, to deprive and remove Henry, and in that event to collate and assign the rectory, value not exceeding 30 marks sterling, to Thady, whom the pope hereby dispenses to be promoted to all even holy orders and receive and retain it, notwithstanding the said defect etc. Vite etc. (H. and G. To the bishop of Kilmore and John Ogoband and Cornelius Maclochlayndyruayre (fn. 3) (rectius Maclochlaynd Yruayrc), canons of the same. Mandate (the pope having been informed by Thady Macgillacosgli, clerk, of the diocese of Clogher, that Nellanus Macmachuna alias Magugri, rector of the parish church of St. Fergus (sancti Forgusii) de Inystatyn (recte Inyscaeyn) in the said diocese, has dilapidated etc. and uselessly consumed the goods of the rectory, openly kept a concubine and committed usury, about which things he is greatly defamed in those parts) if and after Thady (who has for a long time studied in canon law at Bologna and in his own parts, and is now learned, and who lately, notwithstanding his illegitimacy as the son of unmarried parents, had himself made a clerk, and was afterwards dispensed by papal authority to be promoted to all even holy orders and hold the perpetual vicarage of the said church then about to become void, in the event of its being collated to him in virtue of papal letters ordering provision of it to be made to him) accuses Nellanus, from fear of whose power Thady has no hope of obtaining justice in the city and diocese of Clogher, before them, to summon Nellanus and others concerned, and if they find the foregoing to be true, or one of them enough for the purpose, to deprive and remove Nellanus, and in that event to collate and assign the rectory, with cure and value not exceeding 16 marks sterling, to Thady, if found fit; notwithstanding that he is litigating in the apostolic palace about the said vicarage, of which he is in possession, value not exceeding 5 marks sterling. The pope hereby dispenses him (who alleges that the rector and vicar of the said church, on account of the slenderness of the fruits of the rectory and vicarage, cannot be properly maintained therefrom) to receive the said rectory and retain it for life together with the vicarage, if he win it, notwithstanding the said defect etc.Vite etc. (P. and G.
