To the bishop of Whiteherne (Candide case) and the abbot of Holyrood without the walls of Edynburgh in the diocese of St. Andrews. Mandate, as below. The recent petition of the provost, bailies etc. of Edynburgh, in which the present king of Scots and many bishops, abbots and other magnates usually reside, contained that with consent of the said king and for the welfare of the souls of him and his progenitors and the bishop of St. Andrews for the time being, especially of the late James sometime bishop of St. Andrews etc., they have founded and erected the parish church of St. Giles, of the said king's patronage, into a collegiate church with a provostship and two offices, namely, those of sacrist and choir minister, and fourteen separate prebends for as many canons, etc., and have endowed it, etc., and have had the said erection etc. confirmed by Patrick bishop of St. Andrews by his ordinary authority. Seeing that the foregoing do not hold good, (fn. 2) the pope at the said petition orders the above two, if they find the foregoing to be true, to make the said erection and foundation anew (de novo), as above. Mandate to collate and assign to John Fenton, a canon of the Premonstratensian monastery of Deyburgh (recte Dryburgh) (fn. 3) in the diocese of St. Andrews, the perpetual vicarage of the parish church of Gulym in the said diocese, value not exceeding 9 marks sterling, belonging to the presentation of the abbot and convent of the said monastery, and wont to be held by canons thereof, void by the death of John Trombul (sic), its perpetual vicar, although David Kalston’ (? recte Ralston’), a canon of the said monastery, has unduly detained possession for about eight years without any title, summoning and removing the said David; notwithstanding that Fenton holds the perpetual vicarage of the parish church of Lauder in the said diocese, value not exceeding 6l. sterling, which he is, as he has offered, to resign upon obtaining possession of that of Gulym. To the abbot of Lindores (de Londor[i]s) in the diocese of St. Andrews. Mandate, as below. The recent petition of Richard, abbot of the Benedictine monastery of Dunfermeline in the diocese of St. Andrews, contained that he, who has been abbot thereof for twenty-four years, and has becomingly furnished it with books and ornaments and other ecclesiastical jewels, and has repaired its buildings to the best of his power, has from a number of pieces of land and yearly rents lawfully acquired by him from moveable goods by means of the said monastery and otherwise by his industry, bequeathed, set apart and assigned 20 marks of the current money of the realm of Scotland to the prior and convent for a low mass to be said daily in the monastery church for the souls of himself and his parents and benefactors, and high mass with music on the day of his death called a requiem, and for certain other private masses and funeral services, to be celebrated yearly for ever by the said prior and convent, to the sacrist 4 like marks a year for the upkeep of a wax candle of 1 pound weight at the high altar near the picture of St. Margaret sometime queen of Scotland, the founder of the monastery, to burn during the divine office, a house for the habitation of the schoolmaster of the town of Dunfermeline and certain pieces of land and divers yearly rents of the yearly value of 11 like marks and more for the maintenance of poor scholars to be taught gratuitously by the said master, and also certain daily alms for two masses every week in the Friars Preachers’ house of Edynburgh and for one in that of Perth, and for the celebration of yearly funeral services in the parish churches of Stuelin (recte St[re]uelin) and Dunfermeline in the said diocese, (fn. 4) as is said to be more fully contained in a certain public instrument. To Henry Kengorn, Thomas Carmechel and David Monypeny, canon[s] (fn. 5) of Moray. Mandate, as below. The recent petition of James Inglis, priest, of the diocese of Glasgow, M.A., contained that Thomas Waus and James Landesay (recte Lindesay) resigned their respective benefices, namely the deanery of Glasgow and the precentorship (cantoriam) of Moray, for purpose of exchange, the said Thomas having obtained special faculty from the apostolic see, to Thomas bishop of Aberdeen (Ebredonen.) (fn. 6) without the Roman court, and that the said bishop carried out the exchange, making collation and provision of the deanery to Lindesay (fn. 7) and of the precentorship to Waus, who, being then under sentence of excommunication, under pretext of the said collation and provision obtained de facto possession and still unduly detains it. The said collation and provision to Waus being therefore without force and the precentorship still void as above, the pope hereby orders the above three to summon Waus and others concerned, and if they find the said precentorship to be void as above, or by the free resignation of the said James Lindesay, or in any other way, to collate and assign it, a non-major non-elective dignity with cure, value not exceeding 40l. sterling, to Inglis. To the abbot of St. Mary's de Claro fonte alias de Muychosgayn in the diocese of Derry (Deren.) and Arthur Mackathmayl and Roger Maconanugi, canons of Derry. Mandate, as below. The pope has been informed by Meanalaus Mackarmaix [sic], clerk, of the diocese of Raphoe, that William Macgillabride, dean of Raphoe, when about to give his vote in the chapter as dean for the making of collation and provision (fn. 9) of the then void perpetual vicarage of the parish church of Cluyandacorkach (recte Cluayndacorkach) in the diocese of Raphoe, the collation and provision of which belongs in common to the bishop and the dean and chapter of the church of Raphoe, made a bargain with a certain clerk, who had postulated for provision thereof to be made to him, and to whom provision was thereafter made, that if (fn. 10) William gave his vote in his favour he would deliver to William a certain quantity of goods, the which goods William afterwards exacted and received, thereby incurring simony and the sentences of excommunication etc. for simony; and that, although monished by the said bishop to reside in the church of Raphoe he has long neglected and still neglects to do so. The pope therefore orders the above three, if and after Meanalaus, who has no hope of obtaining justice in the city or diocese of Raphoe, accuses William before them, to summon him and others concerned, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the deanery, a major elective dignity with cure, value not exceeding 30 marks sterling, to Meanalaus, whether void by such deprivation and removal or by the deprivation of Donald Micmeanmanydomnayll, made by papal authority, or by the free resignation of the said William, or in any other way. Mandate (the pope having heard that the rectory of the parish church of Donacmor in the diocese of Armagh is void by the free resignation of John Olucaran to John archbishop of Armagh, although the college of the church of Armagh have unduly detained possession for about six years but less than seven, under pretext of a union made de facto by authority of the ordinary, on its being void as above, to the collegiate men(sa) of the said church of Armagh, without any cause and in a way that was null), to summon the said college and others concerned, and to collate and assign to Thady Oduuyli, clerk, of the said diocese (who alleges that the said detention is to the no small displeasure of the parishioners of the said church, which has a great parish, and that he has no hope of obtaining justice in the city or diocese of Armagh) the said rectory, value not exceeding 12 marks sterling, inducting him and removing any unlawful detainer. The pope hereby dispenses Thady not to be bound, whilst engaged in the study of letters in a place where that study is carried on, (fn. 11) to be promoted to deacon's or priest's orders by reason of the said rectory or any other parish church or benefice with cure or otherwise requiring holy orders, for seven years from the time of obtaining the same, provided that within the first of such seven years he be promoted to subdeacon's orders. Mandate (the pope having been informed by William Ocarayn, priest, of the diocese of Cashel, that Donatus Mackraych, rector of the parish church of Kylconyll in the said diocese, of the patronage of laymen, in order to obtain the said church on its voidance, committed simony with the patron by promising temporal goods in order that he should present him, and has committed perjury, and has by his negligence allowed a certain woman, a parishioner of the said church, to die without the sacraments) if and after William accuses Donatus before the above three, to summon Donatus and others concerned, and if they find the foregoing to be true, to deprive and remove Donatus, and in that event to collate and assign the said church, value not exceeding 10 marks sterling, to William; whether void by such deprivation and removal, or by the deaths of William Ybeargy or Patrick Ycorboy, or in any other way. Mandate (the pope having been informed by Tholmeus Obygill, clerk, of the diocese of Derry, that Cornelius Ocomultan [recte Otomultan], rector of the parish church of Ardsratha in the said diocese, has committed perjury and simony) if and after Tholmeus, who is illegitimate, being the son of a married or an unmarried man and an unmarried woman, and has been made a clerk, accuses Cornelius before the above three, to summon Cornelius and others concerned, and if they find the foregoing to be true, to deprive and remove Cornelius, and in that event to collate and assign the said rectory, with cure and value not exceeding 10 marks sterling, to Tholmeus. To the archdeacon of Killaloe (Laonien.). Mandate, as below. The pope has learned that the Augustinian monastery of St. Mary, Inisgayd, in the diocese of Killaloe, is void because Laurence Ohykya, precentor of Emly, in virtue of a special faculty from the apostolic see, deprived for his faults and demerits Dermit Macgillapadrig then abbot thereof, by a definitive sentence which (Dermit's appeal therefrom having become abandoned because he did not prosecute it within the lawful time) has become a res judicata, although the said Dermit has since, without any title or title of right, (fn. 12) unduly detained it for seven years. The pope therefore orders the above archdeacon to summon the said Dermit and others concerned, and (if he find the said monastery to be void as above, or because Thomas Macmahona, a canon of the said order, to whom provision, on voidance as above, was said to have been made by the said precentor by papal authority, has ceded all right in or to the rule and administration, or to be void in any other way) to receive and cause to be received Denis Oheay, perpetual vicar of the parish church of Kyllmallyre in the said diocese (who was lately dispensed by papal authority, on account of illegitimacy as the son of a canon professed of the said order, in priest's orders and an unmarried woman, to be promoted to all even holy orders and hold a benefice even with cure) as a canon of the said monastery, give him the regular habit and receive his profession, and thereafter, if the archdeacon find him fit, to make provision to him of the said monastery, value not exceeding 24 marks sterling, and moreover, to unite and appropriate to the said monastery, for the lifetime of Denis and as long as he shall be abbot, the said vicarage, value not exceeding 4 marks sterling, whether it be then void by such profession or in any other way, so that Denis may take possession of the fruits etc. thereof by his own authority, etc. The pope hereby dispenses him to be appointed abbot etc., notwithstanding the said defect etc., and also grants that he may be blessed by any catholic bishop. To the dean of Cork and Dermit Okeywe and Donatus Omongan, canons of the same. Mandate, as below. The monastery of St. Mary de Antro sancti Fymbarii alias St. John the Evangelist in the diocese of Cork, of the order of St. Augustine, has become void at the apostolic see by the death there of Donald Mackcallacayn, and therefore ipso facto reserved to the pope; and Cornelius Ylayn, a canon of the Congregation of St. John Lateran, of the said order [of St. Augustine] (fn. 13), alleges that Richard Walche, a canon of Cork, meddling de facto with the rule and administration, under pretext of certain surreptitious papal letters, has, also de facto, without any canonical title or tittle of right, detained the said monastery in commendam for about a year. Further, on the perpetual vicarage of the parish church of Clonmyn in the diocese of Cloyne (Clonen.), value not exceeding 8 marks sterling, becoming void, and its having been void so long that by the Lateran statutes its collation had lapsed to the apostolic see, the said Cornelius, before he assumed the habit of the said Congregation, and before he made his profession as a canon thereof, obtained it de facto, collated to him by authority of the ordinary, and held and possessed it for about three years without any canonical title, taking the fruits, afterwards, however, resigning it. The pope therefore, hereby absolving Cornelius and rehabilitating him on account of disability contracted by taking the said fruits, orders the above three, if they find Cornelius fit, to summon Richard and others concerned, and make provision to Cornelius of the said monastery, the provision and appointment to which, when there are no papal reservations, belong to the abbot and convent of Cong, of the said order, in the diocese of Tuam, and the yearly value of which does not exceed 50 marks sterling, the said Richard and any other detainer being removed. The pope further grants that Cornelius may be blessed by a catholic bishop of his choice; without prejudice to the bishop of Cork, to whom the said monastery of St. Mary is by ordinary right subject.Suscepti cura regiminis. To the abbot of Mothel (de Motallia) and the prior of Chayr, in the diocese of Lismore, and Thomas Oflatwan, a canon of Lismore. Mandate, as below. On the expected voidance of the rectory or plebania of the parish church of Dungarwan in the diocese of Lismore, of the patronage of laymen, by the promotion made by Pius II of John [now] bishop of Ardfert to that church, and by the consecration which was to be administered to him, the said pope by divers letters successively ordered provision thereof to be made (fn. 14) to John Slaback and William Horre, priests, of the dioceses of Ardfert and Lismore, the said letters stating that the fruits etc. of the rectory did not exceed 60 marks sterling. At the recent petition of Oddo Macco[n]mara, clerk, of the diocese of Lismore, containing that the said fruits etc. are worth much more and exceed a yearly value of 80 marks sterling, the pope (seeing that, if this be so, both the said letters are surreptitious, and that the said rectory is still void as above, although the said John Slaback under pretext of the said letters has without any title or tittle of right unduly detained possession for several years; and having further learned that a canonry of Lismore and the prebend of Kyllrossanta therein are void by the death of Philip Wiot, although John Colyn, priest, of the diocese of Waterford, has without any title or title of right unduly detained possession for several years) hereby orders the above three to summon the said John Slaback and John Colyn and others concerned, and to collate and assign the said rectory, with cure, and the said canonry and prebend, value not exceeding 100 and 12 marks sterling respectively, provided that the consent be given of one of the two who claim to be the true patrons of the said rectory, to Oddo, any unlawful detainer being removed. To the archdeacon and Thady Odiy (recte Oduy) a canon of Ardfert, and the official of the same. Mandate, as below. The recent petition of David Yreda, priest, of the diocese of Ardfert, contained that formerly, on the voidance of the perpetual vicarage and the rectory of the parish church of Nothowayl in the said diocese, because David Macchonchuyr, an alleged clerk, of the same diocese, had held them for more than a year without being ordained priest and without dispensation, John bishop of Ardfert by his ordinary authority united them for the lifetime only of the said David Yreda, and by the same authority made to him collation and provision of them thus united, and that under pretext of the said union and collation and provision he obtained possession and has unduly detained them for more than two years but less than three, taking the fruits. The said union and collation and provision being therefore without force, and the vicarage and rectory still void as above, the pope, hereby rehabilitating David on account of the foregoing, orders the above three to confirm the said union or to make it anew for David's lifetime, and in that event to collate and assign them to him, with cure and value not exceeding 8 marks sterling, whether void as above, or by the free resignation of the said David Macchonchuyr, or in any other way. To the bishop of Orte, the dean of Lismore and John Oboayn (or Obrayn), a canon of the same. Mandate, as below. The recent petition of Rory Ycamayn, a canon of the Augustinian monastery of St. Broganus, Mothel (de Motalia), in the diocese of Lismore, contained that the said monastery having become void, and ipso facto reserved to Pius II, by Thady Omurissa (fn. 15) [now] prior of the Augustinian priory of St. Catherine, Waterford, obtaining possession of that priory, collated to him by papal authority, and the said pope having died without disposing of it, Edward king of England, on the alleged ground of custom or privilege, presented the said Rory to the bishop of Lismore [not named], who instituted him as abbot, in virtue of which presentation and institution he held and possessed the monastery for about five months, taking the fruits; and that afterwards the said ordinary, informing himself of the foregoing, removed a certain Maurice Oronayn, a canon of the said monastery, as an unlawful detainer thereof, and, perhaps ignorant of the said reservation, made provision to Rory by the said ordinary authority and appointed him abbot, in virtue of which provision and appointment Rory obtained possession of the rule and administration and has been abbot for about a year and two months, similarly taking the fruits, being afterwards duly blessed. (fn. 16) The said presentation, institution, provision and appointment being therefore without force, and the monastery therefore still void as above, and having been so long void that by the statutes of the [Lateran] General Council the provision lapsed to the apostolic see, and that it is still reserved to the present pope, the pope, hereby rehabilitating Rory on account of the foregoing, orders the above three to make provision to him, if found fit, of the said monastery, value not exceeding 40 marks sterling, whether void as above, or by the death of Maurice Ykeallayd, or in any other way, and grants that he may freely use the said blessing. Mandate (the pope having been informed by Arthur Ogalleabar, a canon of Raphoe, that Roger Magmiguil, holding the rectory of the parish church of Cylleahtaig in the diocese of Raphoe, a notorious fornicator, has committed simony and dilapidated and converted to evil and depraved uses, even those of his concubine and his family, (fn. 18) the fruits etc. of the said rectory, and committed perjury) if and after Arthur (who is an expert in canon law, and was lately dispensed, on account of illegitimacy as the son of unmarried parents, to be promoted to all even holy orders and hold a benefice even with cure) accuses Roger before the above official, to summon Roger and others concerned, and if he find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the rectory, without cure and value not exceeding 3 marks sterling, to Arthur; notwithstanding that he holds a canonry of Raphoe and the prebend of Cillmicneanayn (fn. 19) in that church, value not exceeding 9 marks sterling. Absolving him, to whom the pope intends to make this day provision of the said monastery, from any sentences of excommunication etc., as far only as regards the taking effect of such provision, and rehabilitating him and dispensing him on account of any irregularity incurred by celebrating or taking part in masses etc., not in contempt of the Keys, when under such sentences. To the same. (fn. 23) Faculty to him, to whom the pope has recently made provision of the above abbey, to be blessed by any catholic bishop, and for such bishop to administer the blessing. The same bishop is thereafter to receive from him the usual oath of fealty according to the form enclosed, and Henry is to send it by Henry's letters patent sealed with Henry's seal by his own envoy as soon as possible to the pope.
