Mandate (the pope having been informed by Robert Glys, scholar, of the diocese of Clonfert, that after a cause had arisen between Thomas Ohanyn, clerk, of the said diocese, and William Ofathy, priest, of the same diocese, about a canonry of Clonfert and the prebend called Deochte therein, they at length divided the said prebend between them) if and after the said Robert, who is in his fourteenth year, accuses the said two before the above official, to summon them, and if he find the foregoing to be true, to deprive them of the said canonry and prebend and of all their right therein or thereto, and to remove them, and in that event to collate and assign the said canonry and prebend, value not exceeding 6 marks sterling, to Robert, if found fit, and after he has been made a clerk. To the prior of St. Andrews. (fn. 3) Decree etc. as below. Calixtus III (upon its being set forth to him by James Renedi (recte Kenedi). (fn. 4) clerk, of the diocese of St. Andrews, that on the voidance of a canonry and the prebend of Kynkel in Aberdeen by the death of John de Schenes, James bishop of St. Andrews, in accordance with ancient custom, presented him to Ingram bishop of Aberdeen, who instituted him, in virtue of which presentation and institution he obtained possession, but doubted for certain reasons whether the foregoing held good) ordered on 4 (fn. 5) Non. July anno 3 (4 July, 1457) a certain judge [not here named] to collate and assign to him, if found fit, the said canonry and prebend, value not exceeding 40l. of old sterlings. Inasmuch as pope Calixtus died before the letters were drawn up, the pope hereby decrees that they shall take effect from the said date, and that these presents are sufficient proof thereof; with mandate hereby to make the collation. To the abbot of St. Mary's, Inisgad, in the diocese of Killaloe (Laonien.), the archdeacon of Killaloe and Donald Occarkiyl, a canon of Cloyne (Clonen.). Mandate to collate and assign to Cornelius Marmahwna (recte Macmahwna), perpetual vicar of Kilkayde in the diocese of Limerick (who was lately dispensed by papal authority, on account of illegitimacy as the son of unmarried parents, to be promoted to all even holy orders and hold the said vicarage in the event of its being collated to him in virtue of letters of Calixtus III; who alleges that Gibun[us] alias Gillibertus Autwr, clerk, of the said diocese, has under pretext of a collation made to him by authority of the ordinary, detained possession for between two and three years; and who from fear of the power of the said Gibunus alias Gillibertus has no hope of obtaining justice in the city and diocese of Limerick) a canonry and the prebend of Downachmor in Limerick, value not exceeding 8 marks sterling, which became void at the apostolic see, and therefore reserved to the said pope Calixtus, who died without disposing thereof, by the death of Matthew [son] of James (Matheus Jacobi) Maccommora, and are still reserved to the present pope; summoning and removing the said Gibunus. To the archdeacon of Cloyne (Clonen.). Mandate to collate and assign to Thomas Ohyminayn, clerk, of the diocese of Cloyne, who is in about his twenty-third year, if found fit, the perpetual vicarage of Trilachleys (recte Tulachleys, as in the above cancelled mandate) in the said diocese, value not exceeding 4 marks sterling, so long void, by the death without the Roman court of Philip Ohyminayn, that by the Lateran statutes its collation has lapsed to the apostolic see. He is hereby dispensed, notwithstanding the said defect [of age] etc., to receive and retain it, and not to be bound, by reason of it, to have himself promoted to deacon's or priest's orders for five years from the date of these presents whilst engaged in the study of letters, provided that within a year from the said date he be ordained subdeacon. To the abbot of Lisgubail in the diocese of Clogher, and Peter Oflannagan and Thomas Olergusa, canons of Clogher. Mandate (the pope having been informed by Charles Macgillacosgli, clerk, of the diocese of Clogher, that after Nemeas Macgillacosgli, a canon of Clogher, had impetrated from Eugenius IV the rectory of Dayrebrosga in the said diocese [which was to become void] by the deprivation, to be made by papal authority, of the late Donald Ofyaich, priest, on account of certain crimes then expressed, and had caused the letters on the subject to be expedited, the said Donald, in order that he might remain in the said rectory in peace, made a bargain with Nemeas after long altercations and by the intervention of friends on both sides, and promised to pay him two marks sterling a year from the fruits of the rectory, which he did for several years, thereby incurring simony and excommunication etc., to the peril of the soul, especially of the said Nemeas; and that upon the death of the said Donald, Roger bishop of Clogher made collation and provision of the rectory, as being void by Donald's death, to Nemeas, thus a simoniac and not rehabilitated by the [apostolic] see) if and after Charles (who was lately dispensed by papal authority, on account of illegitimacy as the son of unmarried parents, to be promoted to all even holy orders and hold a benefice even with cure) accuses Nemeas before the above three, to summon Nemeas, and if they find the foregoing to be true, to declare the said collation and provision null and void, and to remove Nemeas from the said rectory, which he has caused to be erected by authority of the ordinary into a prebend of Clogher, and, in the event of their so doing, to collate and assign the rectory, value not exceeding 6 marks sterling, to Charles.Vite etc. (P. and A. de Tuscanis. | P.
