De Beneficiis Vacantibus.

1467.
7 Kal. June.
(26 May.)
St. Mark's, Rome.
(f. 36.)
To the abbot of St. Mary's, Middleton (de Choro benedicti) and the prior of St. Mary's, Bridgetown (Ville pontis), in the diocese of Cloyne (Clonen.), and Dermit Okywe, canon of Cloyne. Mandate (the pope having been informed by John [son] of Maurice de Geraldinis, clerk, of the diocese of Cloyne, that Cornelius Ocothyg, rector of the parish church of Kyllia in the said diocese, has laid violent hands on a certain religious who was carrying papal letters to those parts, and violently took them from him, and, being under sentence of excommunication therefor, has for more than three years celebrated masses and other divine offices, and taken part therein, incurring irregularity, and thereby rendering himself unworthy of the said church and of the vicarage of the same, which are canonically united and are of the patronage of two laymen, each of whom claims to be the patron of the said church and vicarage), if the said John, who alleges that he is of noble birth, will accuse the said Cornelius before them, to summon Cornelius and others concerned, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said church and vicarage, value not exceeding 24 marks sterling, to John. Nobilitas generis, vite etc. (P. and A. de Cortesiis. | P. xx. Idibus Junii Anno Tertio. de Varris.) [3½ pp. See also below, Reg. Lat. DCL, f. 289.]

St. Mark's, Rome.

To the abbots of St. Peter's, Westminster, St. Albans, and St. Edmund's, Bury, in the dioceses of London, Lincoln and Norwich. Mandate, as below. The recent petition of prior Nicholas and the convent of Castellacre, O. Clun., in the diocese of Norwich, contained that William Cokkys, perpetual vicar of the parish church of St. James, Castellacre, falsely alleging that the said prior and convent, the patrons of the said church, took every year so many of the fruits etc. belonging to the perpetual vicarage of the said church, which they hold to their own uses, that with the residue the said William could not be maintained, etc., brought the said prior and convent, claiming an augmentation of his portion, before the official of Norwich; and that although from certain grievances inflicted on them by the said official they appealed to the apostolic see, as well as to the court of Canterbury, etc., nevertheless, at the said William's instance, the bishop of Norwich, in contempt of the said appeal, etc., whereof he was not ignorant, monished and ordered them to augment the said portion, and caused them to be cited before him, etc., wherefore they again appealed to the said see, etc. The pope therefore orders the above three to summon the said William and others concerned, hear both sides, and decide what is just, without appeal, causing their decision to be observed by ecclesiastical censure. Humilibus supplicum votis. (P. and A. de Cortesiis. | P. xii. de Varris.) [12/3 pp.]
