To the bishop of Sodor. Mandate, as below. The recent petition of John Mauritii. perpetual vicar of the parish church of St. Molrwe in Yle, in the diocese of Sodor, contained that he was dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders, and receive and retain two compatible benefices, even if one of them had cure, and to resign them, simply or for exchange, as often as he pleased, and that, after having been so promoted in virtue thereof, and ofter having obtained by canoncial collation the said vicarage, on the rectory of the parish church of St. Molrwe in the said diocese, with cure and of lay patronage, becoming void because Donald Johannis, after having obtained it by canonical collation, held it for more than a year without having himself ordained priest, and without dispensation for the purpose, John de Yle, layman, of the said diocese, the patron, presented the said John Mauritii to John, bishop of Sodor, who has instituted him. The the said petition adding that he doubts whether the said presentation and institution hold good, the pope hereby orders the above bishop to collate and assign to him, if found fit, the said rectory, value not exceeding 9 marks sterling; whether it be void as above, or by the death of Celestine Donaldi, or in any other way. To the archbishop of Canterbury and the archdeacons (fn. 2) of Canterbury and London. Mandate, as below. The recent petition of William Chaunt, clerk, notary public, dwelling in the city of London, contained that although Henry Burton, prior of St. [Mary's] de Overai, in the diocese of Winchester, had no jurisdiction over him, he, at the instigation of John Clerk, also a notary public, dwelling in the said city, arbitrarily and without citing him, etc., at least lawfully, excommunicated him, and caused him to be publicly proclaimed excommunicate, wherefore, as also on account of other grievances, he appealed to the apostolic see, etc. The pope therefore hereby orders the above three to summon the said John and others concerned, grant to the said William conditional absolution from the said excommunication, and, for the rest, to summon those concerned, hear both sides, and decide what is just, without appeal, causing their decision to be observed by ecclesiastical censure. The recent petition of the chamberlains, warden and brethren of the [con]fraternity of the hospital of Holy Trinity and St. Thomas the Martyr de Urbe, contained that Peter Courtenei, archdeacon of Wilton in Salisbury, John Roger, priest, Robert Ipswell and certain (fn. 3) other clerks and laymen, of the dioceses of Norwich and Lincoln, injure them in respect of certain annual rents, sums of money, goods and other things belonging to the said hospital; and asked for the commission in England of the cause which they intend to bring against those who injure them. To the prior of St. Mary's, Rathgeila, in the diocese of Limerick. Mandate, as below. It has been set forth this day to the pope on behalf of Thomas Artur, clerk, of the diocese of Limerick, that after Calixtus III had dispensed him, then a minor, to receive and retain, as soon as he attained his twenty-third year, any dignity, even if it had cure, provided that it were not a major dignity, in Limerick, or any other cathedral church, William, bishop of Limerick, before the letters of dispensation had been drawn up, made by his ordinary authority collation to him, then a minor, of the treasurership of the said church, a non-major dignity with cure, on its voidance by the death of Philip Loryng, the said bishop and Thomas's father having previously made an agreement, of which Thomas was ignorant, that if the bishop made the said collation, Thomas's said father would give Thomas's sister to the bishop's brother to wife (fn. 4); that under pretext of the said collation Thomas obtained the said treasurership, and has unduly detained possession for about eight years, taking the fruits; that, after Thomas reached the lawful age, he had himself promoted to all holy orders and ministered therein, even in the ministry of the altar; and that after his father's death he has engaged in business like a merchant, against the canons. (fn. 5) At Thomas's petition, the pope has by other letters rehabilitated him, and required him to resign the said treasurership. The said collation being without force, the pope hereby orders the said prior to collate and assign to Thomas, if found fit, the said treasurership, value not exceeding 40 marks sterling, whether it be still void as above, or by the resignation of the said Philip, or of John Curnog, or in any other way.Dignum arbitramur. To Patrick, abbot of Neubotyll', O. Cist., in the diocese of St. Andrews. Grant, as below. Pius II (on its being set forth by him on the said Patrick's behalf that on the voidance of the said monastery by the death of Thomas, the convent unanimously elected him, a monk professed of the said order, and that he consented to the election, but that some hestitated as to the validity of the said election), ordered James, bishop of St. Andrews, his own name not being expressed, if he found the said election lawful and canonical, to confirm and approve it by papal authority, or, if he found the said Patrick fit, to make provision to him of the monastery, the said pope's letters stating that the value of its fruits etc. did not exceed 40l. sterling, marking 100 gold florins of the Camera, as is also found in the books of the papal Camera. The petition of the said Patrick containing that the said fruits etc. are worth more than as above, although not more than 100l. sterling, the pope, in order that he, who in virtue of the said provision has obtained possession of the administration, may not be molested, grants to him, at the petition also of James, king of Scots, that the said letters and their consequences shall hold good from the date of these presents, as if they stated that the said value did not exceed 100l. sterling. Dispensation to him, who is illegitimate, being the son of a priest and an unmarried woman, is a priest, and has made his profession of the said order, to receive and retain any administrations, offices or benefices of the said order, with and without cure, wont to be governed by canons of the said order, and to resign them, simply or for exchange, as often as he pleases, provided that they be not major dignities in cathedral churches or conventual (fn. 6) dignities. To the abbot of Holyrood near Edynburg, the provost de Linclowden, and the dean of St. Baya de Dumbar, in the dioceses of St. Andrews and Glasgow. Mandate, as below. The recent petition of William Hadington, abbot of Inchaffray (Insule Missarum), O.S.A., in the diocese of Dunblance, contained that although provision was made to him by papal authority of the said monastery on its voidance in a certain way, and although in virtue thereof he obtained possession of the rule and administration, nevertheless George Murreff, a canon of the said monastery, has with the help of certain other of its canons and a number of laymen of the said diocese, in many ways disturbed him; that, moreover, the said George defamed him, as being excommunicate etc., on the ground that, upon the said George falsely alleging that provision had been canonically made to him of the said monastery, the said abbot did not give him possession. At the said abbot's petition, therefore, the pope hereby orders the above three to summon the said George and his accomplices, and others concerned, conditionally absolve the said abbot, and, for the rest, to hear both sides, etc., as above, f. 187d. Dispensation to him (whom the pope lately dispensed to receive and retain any benefices with cure, wont to be governed by secular clerks, even if it were a parish church or its perpetual vicarage, or a chantry, a free chapel, a hospital, or an annual service, or were of lay patronage, and to resign it, simply or for exchange, as often as he pleased) to receive together with such benefice any one other benefice, or without such benefice any two other benefices, with or without cure, wont to be held by secular clerks, even if they be parish churches or their perpetual vicarages, or chantries, free chapels or hospitals, or be of lay patronage, and to retain whichever of them he prefer for life as a title, and the other therewith in commendam, and to resign them, simply or for exchange, as often as he pleases, etc. Religionis zelus, vite etc. (Hug. and A. de Cortesiis. | Hug. l. To the abbot of Abyngdon in the diocese of Salisbury. Mandate, as below. The recent petition of the abbot and convent of St. Mary's, Heyles, O. Cist., in the diocese of Worcester, contained that its fruits etc. are too slight for their maintenance and for customary hospitality; and added that it would be a relief if they could have the perpetual vicarage (which has been wont to be secular) of the parish church of Rodbourne Chanew (fn. 7) in the diocese of Salisbury (which is united to the said monastery) served in future by a monk of their monastery, to be presented by them to the ordinary, and by him instituted. The pope therefore orders the above abbot to summon those concerned, and if he find the facts to be as stated, to grant to the said abbot and convent of the said monastery, value not exceeding 300 marks sterling, that they may in future have the said vicarage, value not exceeding 10 marks sterling, served as above. To the abbot of Merevale (de Miravale) in the diocese of Coventry and Lichfield, the dean of Lichfield, and the prior of Coventry. Mandate, as below. Lately, upon its being set forth to the pope on behalf of the prior and convent of Repingdon, O.S.A., in the diocese of Coventry and Lichfield, that the fruits etc. of the parish church of Willingeton in the said diocese did not exceed 5l. sterling of the money of England, that its cure and the administration of the sacraments and sacramentals had been wont to be exercised by a secular priest, that the bishop of Coventry and Lichfield (considering the slenderness of the said fruits etc., and the fact that the said church was united in perpetuity to the said priory, and was not more than half a mile distant therefrom, that the said prior and convent kept up great hospitality in the said priory, and that the said 5l. was not sufficient for the maintenance of the said priest) had granted them licence and faculty to have the said church governed in future and its cure exercised by one of their canons, as was said to be more fully contained in the letters of the said bishop, the pope granted by other letters that they might in perpetuity have the said church governed and the sacraments and saciamentals administered, by a fit canon of the said priory, appointed and removed at the pleasure of the prior. At their recent petition, containing that the said bishop granted the said licence and faculty, not by his letters, but verbally, the pope, lest his said letters be therefore held to be surreptitious, hereby orders the above three to summon those interested, etc., and to decree and grant that his said letters shall hold good from the date of these presents, as if it had been stated therein that the said bishop had granted his said licence and faculty verbally, and not by his letters, and as if no mention of such letters had been made.
