To the bishop of Arezzo (Aretin.), the abbot of Paisley (de Pasleto) in the diocese of Glasgow, and William Elfynston, canon of Glasgow. Mandate to collate and assign to John Valas', clerk, of the diocese of Glasgow, who is by both parents of noble birth, the perpetual vicarage of the parish church of Dundonalde in the said diocese, value not exceeding 40l. of the usual money of Scotland, void by the resignation of Duncan Bownche to Andrew, bishop of Glasgow; whether it be void as stated, or in any other way, etc. Nobilitas generis, vite etc. (N. and F. de Gualbis. | N. xx. To Richard Cadi, perpetual vicar of the parish church of Petircoutir in the diocese of Aberdeen. Collation, etc., as below. His recent petition contained that he won three definitive sentences in a cause, ventilated for some time in the apostolic palace before divers auditors, about the parish church of Conveth in the diocese of St. Andrews, provision of which had been made to him by papal authority on its becoming void in a certain way, the last of which sentences became a res judicata. Seeing that, without the said last sentence having been executed, and without having had possession of the said church, Richard has this day resigned it, and that Robert Keith has resigned the said vicarage of Petircoutir, the resignations having been made to the pope, for the purpose of exchange, by their proctor, Francis Fornerii, clerk, of the diocese of Lyon (Lugdunen.), the pope hereby makes collation and provision to Richard of the said vicarage, which has cure of souls, and the value of which does not exceed 8l. sterling. Apostolice sedis circumspecta.

To the abbots of Buysham [sic] and Hallessoweyn, in the diocese of Worcester, and the treasurer of Wells. Mandate, as below. The recent petition of John, bishop of Worcester, contained that he repeatedly (sepius) caused William Strenger, (fn. 2) of the diocese of Worcester, to be cited to appear in person before him on account of certain excesses and crimes, afterwards excommunicating him for contumacy, and causing him to be publicly proclaimed excommunicate; that the said William wrongfully appealed from the said bishop to the court of Canterbury, and caused the bishop to be summoned before John Boteler, dean of St. Mary's le Bow (de Arcubus), London, lieutenant of the official of the said court; and that the said lieutenant, proceeding wrongfully, absolved the said William from the said excommunication, wherefore the bishop appealed to the apostolic see, and afterwards petitioned the pope to commit the cause of the said last appeal for hearing in England. The pope therefore hereby orders the above three to summon the said William and others concerned, hear both sides, and decide what is just, without appeal, causing their decision to be observed, in the case of the said bishop by the pope's authority, and in the case of the others by ecclesiastical censure. To Lewis, bishop of Anglona (Anglonen.), residing in the Roman court. Mandate, as below. The recent petition of John Lokart, priest, of the diocese of Glasgow, M.A., contained that a cause arose between him and David Ray, clerk [no diocese], about the treasurership of Dunblane, which, upon its becoming void by the death of John Atheray, the said John Lokart (in virtue of letters by which the present pope lately ordered provision to be made to him of one or two benefices, even if one of them had cure or were a rural deanery or archpriestship, which is an extra-cathedral dignity with cure, or were a dignity etc. in a cathedral or collegiate church, etc., even an elective dignity, etc., with cure, in the common or several gift of the bishop and the chapter etc. of Dunblane) accepted within the lawful time, and provision of which he caused to be made to him, in virtue of which acceptance and provision he obtained possession, and which acceptance and provision the said David unjustly opposed, as he still does, etc.; and that the pope committed the cause, although not lawfully devolved to the Roman court, at John's instance, to the above bishop, who has taken certain proceedings. The said petition adding that it is alleged that neither John nor David has a right to the said treasurership, the pope hereby orders the said bishop, if by the event of the suit he find this to be the case, to collate and assign the said treasurership, which is a non-major dignity, value not exceeding 18l. sterling, to the said John, inducting him, etc. As soon as he obtains possession by virtue of these presents, the pope's said other letters and their consequences shall be null, as far as regards one of the benefices comprised therein, etc. Litterarum scientia, vite etc. (P. and Ja. To the bishop of Sodor, the abbot of Ey in the diocese of Sodor, and the archdeacon of Sodor. Mandate, as below. The recent petition of Malco[l]m [son] of Solomon David, clerk, of the diocese of Lismore, contained that on the deanery of Lismore, a major dignity, becoming void by the death of Beanus Mauritii, whereby it became ipso facto reserved in virtue of Pius II's reservation of all major dignities then void and to become void, George bishop of Lismore, perhaps in ignorance of the said general reservation, made collation and provision thereof to Malco[l]m de Dunblana, and, upon the latter's resignation to the said bishop, made collation and provision to Robert Mwyr, who under pretext thereof has detained possession for between eight and ten years. The said collations and provisions being therefore without force, and the said deanery still void, as above, and the present pope having maintained the reservations of his predecessor, etc., the pope hereby orders the above three to collate and assign the said deanery, non-elective, and value not exceeding 8l. sterling, to the said Malco[l]m, who was lately dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to receive and retain any mutually compatible benefices with or without cure, even if major dignities, etc., and who cannot safely meet the said Robert in the city or diocese of Lismore; summoning and removing the said Robert and any other unlawful detainer. To John Abberneti, (fn. 3) rector of the parish church of Tanades in the diocese of St. Andrews, M.A. Dispensation, as below. He was by the ordinary, under pretext of a certain indult, but after the revocation thereof, dispensed on account of illegitimacy, as the son of a married man and an unmarried woman, to be promoted to all, even holy orders and hold two compatible benefices, and by virtue of the said dispensation was made a clerk and promoted as far as the order of acolyte. Subsequently the present pope dispensed him to act as a clerk and minister in the orders which he had received, and to receive and retain the above parish church, provision of which the pope had by other letters ordered to be made to him. The pope now, out of regard for James, king of Scots, who has also petitioned on John's behalf, dispenses him to receive and retain for life together with the said church of Tanades one other benefice, or without that church any two other benefices, with cure or otherwise incompatible, even if canonries and prebends, etc., and to resign them, simply or for exchange, as often as he pleases.Litterarum scientia, vite etc. (Jo. and A. de Cortesiis. | Jo. lxxv. To Richard Cadi, perpetual vicar of the parish church of Petircoutir in the diocese of Aberdeen. Grant, as below. The pope recapitulates the said Richard's exchanging of his rectory of Conveth with Robert Keith for the above vicarage, and the pope's collation and provision to him of the latter, as above, f. 130 (here with a mention of the value of the parish church of Conveth, viz. not exceeding 40l. sterling), and, in order that by the said exchange he may not be a loser, hereby grants him a yearly pension for life of 13l. sterling on the fruits etc. of the said parish church, to be paid by the said Robert or his successors by half yearly payments on Christmas and St. John Baptist's days, with the usual sanctions, etc. Vite ac morum.
