To the chancellor of Glasgow. Mandate to collate and assign to Duncan Mont, priest, of the diocese of Glasgow, M.A., if found fit after examination, the perpetual vicarage of the parish church of Inchennen in the said diocese, in the presentation of the Hospitallers priory of Torphicane in the diocese of St. Andrews, and value not exceeding 9l. sterling, void at the apostolic see, and therefore ipso facto reserved, by the resignation made to the pope by John Donaldi through his proctor Thomas Carribres, clerk, of the said diocese [of Glasgow]. To the bishop of Orte, the prior of St. Mary's, Dungebyn, in the diocese of Derry (Deren.), and William Oquervolan, canon of Derry. Mandate to collate and assign to Patrick Ocomolcon, clerk, of the diocese of Armagh (who is illegitimate, being the son of a priest and an unmarried woman; to whom the present pope lately ordered provision to be made of a canonry, with reservation of a prebend and dignity etc., of the church of Armagh, and of a benefice with or without cure in the common or several gift of the archbishop and the dean and chapter etc. of Armagh; and whom the pope dispensed to be made a clerk and be promoted to all, even holy orders, and to receive and retain such canonry and prebend, etc., after which dispensation he was made a clerk) the priory of the Culdees (prioratus Coledeorum) in the church of Armagh, called the precentorship, a non-major dignity, value not exceeding 2 marks sterling, so long void by the death of Donald Occallacan that by the Lateran Statutes its collation has lapsed to the apostolic see. The pope hereby specially dispenses him to receive and retain it, notwithstanding the said defect, etc., and wills that as soon as he has obtained possession, the said earlier letters shall be null as far as regards a dignity etc. in the church of Armagh, or such benefice with cure only. To Thomas Obruachan, Mulerus [son] of David Baret, (fn. 1) and Rory Ocluan, canons of Killala (Aladen.). Mandate, as below. The pope has been informed by Mulerus Baret, canon of Killala, that after the late Bernard, bishop of Killala, had deprived for his faults and demerits Rory Oduda, rector of the parish church of Scrinamanan alias Culkana in the diocese of Killala, and had by his ordinary authority made collation and provision of the said church, thus void, to the late Donald Ochoneli, canon of Killala, and after the latter had by virtue thereof taken possession, Thomas Ochyman, clerk, of the said diocese, obtained from pope Pius II letters addressed to Dermit Oduda, archdeacon of Killala, and certain colleagues, with the ‘you [three], or two or one of you’ clause, ordering them, if the said Thomas would accuse the said Donald before them of certain alleged crimes, and if they found Donald guilty, to deprive and remove him, and collate the said rectory to Thomas; that after Thomas had presented the said letters to the said archdeacon, he made a bargain with the latter that if he collated to Thomas the said rectory by virtue of the said letters he would pay him a certain sum of money; and that the said archdeacon, after having received the money, deprived Donald, and made collation of the said rectory, as being void by such deprivation, to Thomas, who by virtue of such collation obtained and still detains possession, thereby contracting simony and incurring excommunication, etc. The archdeacon's sentence, the deprivation of Donald, and the collation and provision to Thomas being, if the foregoing be true, without force, the pope hereby orders the above three, if the said Mulerus (who alleges that he is of noble parents, and holds a canonry and prebend of Killala and the perpetual vicarage of the parish church of Rabrany in the said diocese, the value of which latter (fn. 2) does not exceed 4 marks sterling, and who was lately dispensed by papal authority on account of illegitimacy, as the son of unmarried nobles related in the simple third degree of kindred, to be promoted to all, even holy orders and hold two compatible benefices with or without cure) will accuse the said Thomas before them, to summon Thomas and others concerned, and if they find that the accusations made by Thomas were true, to declare the archdeacon's sentence and his collation and provision to Thomas to be null and void, and remove him, and in that event to collate and assign the said rectory, value not exceeding 16 marks sterling, whether it be void by such declaration and removal, or by the resignation of the said Thomas, or in any other way, to the said Mulerus, inducting him, and removing Thomas and any other unlawful detainer. The pope hereby specially dispenses Mulerus to receive the said rectory of Scrinamanan, and to retain it, for five years only, together with the said canonry and prebend and vicarage, notwithstanding the pope's late ordinance against holding two parish churches, etc., and notwithstanding Mulerus's said illegitimacy. To Mulerus David, Mulerus [son] of Henry Baret, and William Obruachan, canons of Killala (Aladen.). Mandate, as below. The pope has learned that the perpetual vicarage of the parish church of Oyrcablochacon’ in the diocese of Killala, of lay patronage, has been so long void by the death of Patrick Ofergussa that by the Lateran Statutes its collation has lapsed to the apostolic see, although William Oflaind, priest, of the said diocese, has under pretext of a collation by the ordinary, made after the said lapse, and therefore null, detained possession of it for between one and two years, without any other title. The pope, therefore, orders the above three to collate and assign to Edmund Omurthu, clerk, of the said diocese (who was lately dispensed by authority of the ordinary on account of illegitimacy, as the son of a priest, professed of the order of Hermits of St. Augustine, and an unmarried woman, to be promoted to minor orders only and hold a benefice without cure), the said vicarage, value not exceeding 3 marks sterling; summoning and removing the said William and any other unlawful detainer. The pope hereby dispenses the said Edmund to be promoted to all, even holy orders and receive and retain the said vicarage, notwithstanding the said defect.Vite etc. (F. and Ja. Prats. | F. xv.
