To the prior of the monastery of Ballinskelligs (Sancti Michaelis de Rupe), governed by a prior, in the diocese of Ardfert. Mandate, as below. The pope has been informed by Geraldus de Geraldinis, clerk, of the diocese of Ardfert, that Philip Stalk, archdeacon of Ardfert, an open fornicator, has committed adultery and perjury, and has violated ecclesiastical liberty. (fn. 2) The pope, therefore, hereby orders the above prior, if the said Geraldus (who is by both parents of noble birth, is in his twentieth year, and is studying canon law according to the custom of Ireland (fn. 3); and to whom the pope has this day by other letters [below, f. 147d.] ordered provision to be made of the perpetual vicarage of the parish church of Dagyn in the said diocese, value not exceeding 12 marks sterling, dispensing him to receive and retain together for life the said vicarage, if collated to him by virtue of the said letters, and the said archdeaconry [of Ardfert], if collated to him by virtue of these presents, and to resign them, simply or for exchange, when he pleases, and hold instead for life two other incompatible benefices, provided that they be not two parish churches or their perpetual vicarages, or two major or principal dignities in cathedral or collegiate churches, etc.), will accuse the said Philip before him, to summon Philip and others concerned, and if he find the foregoing to be true, to deprive and remove Philip, and in that event to collate and assign to Geraldus, if he be found fit, the said archdeaconry, a non-major non-elective dignity with cure, value not exceeding 24 marks sterling.Dignum [arbitramur] etc. (N. and A. de Cortesiis. | N.xx. To Robert Kerth (recte Keith), (fn. 4) rector of the parish church of Conuech (recte Conueth) in the diocese of St. Andrews. Collation and provision, as below. The pope has this day admitted the resignations which for purpose of exchange have been made to him, through their proctor, Francis Fornerii, clerk, of the diocese of Lyon (Lugdunen.), by the said Robert and Richard Cadi, of the perpetual vicarage of the parish church of Petricoutir in the diocese of Aberdeen, and the parish church of Conueth in the diocese of St. Andrews, respectively, the said Richard having won, in a cause against certain adversaries about the said church of Conueth (provision of which had been made to him by papal authority), three definitive sentences in the apostolic palace before certain auditors, by which sentences the said church (of which he has not yet had possession) was adjudged to him and perpetual silence imposed on the said adversaries, and the last of which sentences has become a res judicata, etc. The pope, therefore, hereby makes collation and provision of the said church [of Conueth] to the said Robert, whom under date of 13 Kal. Dec. anno 3 [19 Nov., 1466], he dispensed on account of defect of age, he being in his nineteenth year, and on account of defect of birth, he being the son of an unmarried nobleman, of a race of earls, and an unmarried woman, to be promoted, after reaching a fitting (ydonea) age, to all, even holy orders and receive and retain any mutually compatible benefices with or without cure, of any number and kind, even if canonries and prebends, dignities (major or principal accordingly, and elective) etc., in cathedral or collegiate churches, and to do so forthwith (ex tunc) if such benefices were without cure, and as soon as he attained his twentieth year if one of them had cure, and to resign them all, simply or for exchange, as often as he pleased.Apostolice sedis circumspecta benignitas. |

Mandate to collate and assign to Geraldus de Geraldinis, clerk, of the diocese of Ardfert (who is by both parents of noble birth, is in his twentieth year, and is studying canon law according to the custom of Ireland, (fn. 5) and to whom the pope has this day by other letters ordered provision to be made of the archdeaconry of Ardfert, a non-major [non-elective] dignity with cure, value not exceeding 24 marks sterling [above, f. 3]), if he be found fit, the perpetual vicarage of the parish church of Dagyn in the said diocese, which is of the patronage of the prior and convent of the monastery of St. Mary, Killagh (de Bello loco), O.S.A., in the said diocese, has cure, does not exceed 12 marks sterling in value, and has been so long void, by the death of Philip Fismoris, that by the Lateran Statutes its collation has lapsed to the apostolic see. To the archdeacon of the church of Aghadoe (de Bachadeo, recte de Achadeo) in the diocese of Ardfert. Mandate, as below. The recent petition of Brandan Mactonchar (recte Macconchar), priest, of the diocese of Ardfert, contained that he was successively dispensed by papal authority on account of illegitimacy, as the son of unmarried parents, (i) to be promoted to all, even holy orders and receive and retain a benefice even with cure, (ii) to resign it, simply or for exchange; that he obtained the perpetual vicarage of the parish church of Dystat (fn. 7) in the said diocese, which has cure of souls; that he detained it for more than twelve years without having himself ordained priest, taking the fruits; that on the voidance of the rectory of the said church by the resignation of John Macconsur [sic], (fn. 8) priest, of the said diocese, Brandan's father, to the late Nicholas, bishop of Ardfert, that bishop, with the consent of its lay patron, united it to the said vicarage on account of the slenderness of the fruits of the latter, (fn. 9) under pretext of which union the said Brandan detained the said rectory for about six years, during which he was ordained priest, taking the fruits of both vicarage and rectory; that on the voidance of the rectory and vicarage of the parish church of Kyllyntyerna (fn. 10) in the same diocese, which are of lay patronage, by the death of Dermit Oconchur, who held them as united (tanquam insimul unitas) on account of the slenderness of their fruits, the late (fn. 11) Thomas, earl of Desmond, patron of the said rectory and vicarage, presented the said Brandan (then being under disability on account of the taking of the said fruits) to John, [the present] bishop of Ardfert, who admitted the said presentation as far as regarded the said rectory; that Thomas Macconsur [sic], then archdeacon of Ardfert (the institution to both rectory and vicarage belonging by ancient custom to the archdeacon of Ardfert), instituted the said Brandan to the rectory only; and that, having resigned the aforesaid rectory and vicarage [of Dystat], he has, under pretext of the said presentation, admission and institution, for about four years unduly detained possession, as being united (tanquam unitas), of the said other rectory and vicarage [of Kyllyntyerna], as he still does, taking the fruits. The said presentation, admission and institution being therefore without force, and the said rectory and vicarage of Kyllyntyerna (fn. 12) being still void as above, and there being a doubt as to the force of the union of the said rectory of Kyllyntyerna, the said Brandan (who alleges that he is over his seventieth year, that he has with very great labours and perils betaken himself in person to the Roman court, and that the values of the vicarage and rectory of Kyllyntyerna, the former of which has cure, do not exceed 3 and 6 marks sterling, respectively) has petitioned the pope to unite the said vicarage of Kyllyntyerna to the rectory of the same, for Brandan's lifetime only. The pope, therefore, hereby rehabilitates him, etc., and orders the above archdeacon to collate and assign to him the said rectory, and if, after summoning those concerned, he find to be true what is alleged concerning the slenderness of its fruits, to unite thereto, for Brandan's lifetime only, the said vicarage, inducting him into corporal possession of both; the pope hereby specially dispensing him to receive and retain them both, notwithstanding the said defect etc. Upon his death, or his resignation of the said rectory, the said union shall be ipso facto dissolved, and the said vicarage shall revert to its original state, and before the above archdeacon proceeds to execute these presents, Brandan shall resign to him the said rectory and vicarage of Kyllyntyerna. To the abbot of the monastery of SS. Choanus and Broganus, Mothel (de Moralia, recte Motalia), in the diocese of Lismore, Donatus Macconmuara, canon of Lismore, and the official of the same. Mandate, as below. The pope has been informed by Odo Omulgurym, clerk, of the diocese of Limerick, that William Oronayn, perpetual vicar of the parish church of Corchimohyt in the said diocese, has not resided in person in the said church, nor appointed any one to exercise the cure of the vicarage, and has not returned thereto after having been canonically monished to do so, wherefore by his negligence three men have died in the parish without the sacraments of the church, and very many persons of both sexes are buried every day by laymen of the parish without the blessing of the corpse and other wonted sacraments, like beasts, that he has caused oxen and other beasts to be slaughtered and their flesh to be sold, has engaged in other secular business, and has caused and allowed horses and other animals to be fed and stabled in places of the said church consecrated to God, to the shame of the priestly dignity, etc. The pope, therefore, (fn. 13) hereby orders the above three, if the said Odo, who is in his twenty-second year, and who from fear of the power of the said William cannot safely meet him within the city and diocese of Limerick, will accuse William before them, to summon William and others concerned, and if they find the foregoing to be true, to deprive and remove William, and in that event to collate and assign the said vicarage, with cure, and value not exceeding 12 marks sterling, to Odo, whom the pope hereby specially dispenses to receive and retain it, notwithstanding the said defect, etc. Vite etc. (N. and P. de Godis. | N. xx.
