To Patrick, archbishop of St. Andrews. Annulment of the exemption of the churches of St. Salvator at St. Andrews and St. Giles, Edinburgh, as below. His recent petition contained that the late James, bishop of St. Andrews, founded the church of St. Salvator near the [now] archiepiscopal palace of St. Andrews, to be his episcopal chapel, and endowed it from the rectories of parish churches in the diocese and possessions of the [now] archiepiscopal, then the episcopal mensa; and that he himself (considering that the church of St. Giles, Edinburgh, was situate in a famous place, that on account of the sea between it and the city of St. Andrews, he kept officials and held the synod of a great part of his diocese in it), erected the said church of St. Giles into a collegiate church; that it seems unbecoming (fn. 1) that the said church of St. Salvator (thus founded and endowed by his predecessor so near the said palace, and the parsons (fn. 2) thereof daily dwelling in his sight and in the sight of the archbishop for the time being), and that the said church of St. Giles (thus decorated by him), should be exempt from his jurisdiction and that of the archbishop for the time being; and that the said alleged exemptions are a cause of dissoluteness and incontinence etc. and the diminution of divine worship and murmuring of scandal amongst the people. The pope, therefore, hereby annuls the said exemptions, in so far as they prejudice the said archbishop's ordinary jurisdiction, and restores the said churches to their former state; grants that he and the archbishop for the time being may visit the said churches and the chapters, etc. thereof, and exercise their ordinary jurisdiction, as if they had not been exempted. To John Valtres, rector of both portions (fn. 3) of the parish church of Cattfeld in the diocese of Norwich, wont to be ruled by two rectors. Confirmation, etc., as below. His recent petition contained that on the voidance of the second (fn. 4) portion of the said church, of lay patronage, by the resignation of its rector, Henry Stevenesson, to the vicar-general in spirituals of Walter, bishop of Norwich, the sole patron thereof presented the said John, then rector of the first (fn. 5) portion, to the said bishop, who instituted him, and who furthermore (seeing that although the fruits etc. of the said church were formerly abundantly sufficient for the maintenance of several ministers therein, so that it had been ordained that it should be ruled by two rectors, with equal shares of the said fruits, etc., they were no longer enough for two rectors; and also on account of the scandals which continually arose through the mingling (fn. 6) of the lands from which the rectors received the tithes, and the confusion of their boundaries, and the division of the oblations in the said church between the rectors) dispensed him to retain for life the first (fn. 7) portion, which he was holding, together with the said resigned portion, since which time he has held them both. At the said petition, which added that there is a doubt as to the force of the said dispensation, the pope hereby confirms it, and dispenses him, pro potiori cautela, to retain the said two portions together for life. Confirmation, with exemplification, of the letters Comparuerunt coram nobis of brother Baptista de Ursinis, master of the hospital of St. John of Jerusalem, and the convent of Rhodes, dated in the convent at Rhodes on 22 Dec., 1472, citing brother William Tornay, (fn. 8) prior of England, to appear before them in person at Rhodes within nine months from the serving of the said letters, and justify his accounts for the six years ending on the feast of St. John in the [then] current year (fn. 9) [24 June, 1472], in which accounts certain very grave discrepancies have been found, amounting to a large sum of money, e.g., inter alia, in respect of expenditure which he alleges was made in gifts for obtaining graces, and in payments of lawyers and envoys (fn. 10) when the priory of England became void during the said six years, payments made by him for the debts of the late brother John Langstrothier, and expenditure which he alleges that he has made in the house of Clertenveld (sic), which are held to be excessive and exorbitant, especially seeing that the priory was void and half of the rents were sufficient, etc. Ad fut. rei mem. (Auluden.), doctor of decrees, a papal notary, (who has been sent by Edward, king of England, as his ambassador for the purpose of making the usual obedience to the pope and the apostolic see), (fn. 17) to receive forthwith any benefices without cure, even if they require priest's or other holy orders, or are wont to be held by older persons, (fn. 18) and as soon as he attains his eighteenth year to receive and hold, with or without such benefices, any benefice with cure or otherwise incompatible, even if a parish church etc., and retain both together for life, and to resign or exchange them, etc., notwithstanding the said defect of age etc. Vite etc. (In the margin: Maij.)
