To the abbot de Forgio alias de Clar and the prior of Inskronayn, in the diocese of Killaloe (Laonien.), and the archdeacon of Killaloe. Mandate, as below. The pope has been informed by John, [son] of Thady Micnamara, (fn. 3) clerk, of the diocese of Killaloe that John Macnamary, clerk, of the said diocese, consented to a bargain made by his parents with Thady, [now] archdeacon, (fn. 4) then a canon, of the said church of Killaloe, to the effect that if the latter would resign in favour of the said John Macnamari his canonry of the said church and the prebend of Tollachnonasbyg therein, they would pay him a certain sum of money, after which the said Thady resigned to Matthew, bishop of Killaloe, who, in ignorance (as is believed) of the foregoing made collation and provision to the said John Macnamari, under pretext of which he obtained possession, and has detained the said canonry and prebend for between about two and three years, having in the meantime given the tithes belonging to the said canonry and prebend to John, [son] of Rory Macnamary, clerk, of the said diocese, to the end that the said John, [son] of Rory, should cease from a certain judicial inquisition which had been begun against the said John Macnamary (fn. 5); that, moreover, Donald Okonim, who behaves as perpetual vicar [of] Tollachnynasbyg in the said diocese, made a bargain with two clerks that if they would obtain for him provision of the said vicarage, then void by the death of Nicholas Yhida extra R. c., he would pay them 2 marks sterling [yearly] for some years, (fn. 6) after which Donatus, bishop of Killaloe, who was in like manner ignorant, made at the instance of the said clerks (fn. 7)de facto collation and provision to the said Donald, who under pretext thereof obtained possession of the said vicarage, and (as he also did under pretext of papal letters of fresh provision, in which no mention was made of his said simony, and without rehabilitation) has detained it for about seventeen years, and has paid to the said clerks the said sum. At the recent petition of the said John Thatei, containing that the fruits, etc., of the said canonry and prebend are so slight that their holder cannot decently maintain himself, and that if the said vicarage were united to them for his life he could maintain himself more decently, the pope hereby orders the above three, if the said John Thatei (who has been dispensed on account of illegitimacy, as the son of a clerk in minor orders only and an unmarried woman, nobles, related in the fourth degree of kindred, (i) by authority of the ordinary to be promoted to minor orders and hold a benefice without cure, (ii) by papal authority, after he had been made a clerk, to be promoted to all, even holy orders and hold a benefice even with cure), will accuse the said John Macnamara and Donald before them, to summon them, and if they find the foregoing to be true, to declare the said collations and provisions null, and in that event to unite the said vicarage, value 16 marks sterling, to the said canonry and prebend, value 12, for the lifetime of the said John Thatei, and thereupon to collate and assign to him the said canonry and prebend with the vicarage so annexed, removing the said John Macnamara and Donald. He is hereby specially dispensed to hold them, notwithstanding the said defect, and on his resignation of the said canonry and prebend or his death, the said union is to be dissolved. Paul II dispensed him to receive and retain for life with the said church any other benefice, or if he resigned the said church any two other benefices, with cure or otherwise incompatible, even if dignities, etc., or parish churches, etc., and to resign them, simply or for exchange, as often as he pleased [Cal. The pope hereby dispenses him (who in virtue of the said dispensation held with the said church that of Harbaldon in the diocese of Canterbury, collated to him by authority of the ordinary, and who held with the said churches, although for less than a month, that of Wymbaldon in the diocese of Winchester, collated to him by the same authority, and who resigned Harbaldon within the said month from the time of obtaining possession of Wymbaldon, and who at present holds St. Vedast's and Wymbaldon in virtue of the said dispensation, and is a continual commensal chaplain of Thomas, cardinal priest of St. Ciriac's in Termis), to receive and retain for life any third benefice with cure or otherwise incompatible, even if a dignity, etc., or a parish church, etc., and to resign such third benefice, simply or for exchange, as often as he pleases, provided that not more than two of such three incompatible benefices be parish churches or perpetual vicarages. To the prior of St. Mary's, Killagh (de Bello loco), in the diocese of Ardfert. Mandate, as below. The pope has learned that the parish churches of Kyllene and Kyllseami and the parcel of Kyllchomyyn, in the diocese of Ardfert, which are alleged to be united, have been so long void that there is no certain knowledge of the mode of their voidance, and that their collation has lapsed to the apostolic see, although Donald Ofym, priest, of the said diocese, has detained them for between more than twelve and sixteen years, without any title. At the recent petition of John Hosse, clerk, of the said diocese, containing that the fruits, etc., of each of the said churches and parcel are so slight that the rector thereof, called server or governor, (fn. 11) cannot easily maintain himself, but that if they were united for the life of the said John, and provision thereof were made to him, he could more easily live and bear their burdens, and alleging that the yearly value of their fruits, etc., does not exceed 16 marks sterling, and that they have been wont from of old to be held by one man, the pope hereby orders the above prior to summon the said Donald, and if he find the facts to be as stated, to unite the said churches and parcel for the life of the said John (who is of noble birth), and in the event of his so doing to collate and assign them to him, removing the said Donald. To Richard Lake, perpetual vicar of Breerding in the Isle of Wight (in insula Vecta), in the diocese of Winchester. Dispensation, as below. Calixtus III dispensed him to receive and retain for life with the said vicarage any other benefice with cure or otherwise incompatible, even if a dignity, etc., or another parish church, etc., and to resign them, simply or for exchange; (fn. 12) the letters of the said dispensation stating that, the said church and isle being situate between France and England, and being often afflicted by incursions of the French, he was thrice captured and carried away captive and imprisoned, and obliged to pay more than 1,000 [gold] florins [of the Camera] for his liberation, wherefore, being unable to satisfy the creditors to whom he had become bound in the said sum on account of the said ransom, he dared not reside in the said church and keep wonted hospitality therein, etc. (fn. 13) [Cal. Papal Lett. XI., p. 317.] At his recent petition (containing that he was not made prisoner three times, nor imprisoned, and did not pay the said sum for the said liberation, although he has been made prisoner elsewhere, and paid for his said liberation a sum of money not expressed, and that he therefore fears lest the said dispensation may be held fruitless and surreptitious), the pope hereby grants that the said letters shall hold good from the date of these presents, as if they did not state that he had been thrice taken prisoner and imprisoned and [paid] for his liberation more than 1000 florins, etc. Vite etc. (At the end: F. xx. Paul II dispensed him (who had been dispensed by papal authority on account of illegitimacy, as the son of a priest professed as a monk of the Cistercian [sic] order and a married woman, (i) to be promoted to all holy orders and hold a benefice even with cure, and (ii) to minister in the orders which he had received, and hold another benefice without cure in a cathedral, even (fn. 15) a metropolitan church, or in a collegiate church), to receive and retain for life with the perpetual vicarage of Pitington in the diocese of Durham, which, as he alleged, he was then holding, any (fn. 16) other benefice, or if he resigned the said vicarage any two other benefices, with cure or otherwise incompatible, even if parish churches, etc., or dignities, etc., and to resign them, simply or for exchange, as often as he pleased. His recent petition contained that in the said letters there is no mention of the said church of Tornthon [sic] in Pikringleythe, which he was holding at the date of the said letters, and that it was after the said date that he was presented to the said vicarage of Pithington [sic] by the prior and chapter of Durham, and instituted by the ordinary, but that he has not obtained possession, wherefore he doubts whether the said letters may not be held surreptitious. The pope, therefore, hereby grants that the said letters shall hold good from the date of these presents, and that he may hold the said church of Tornthon [sic] and vicarage (if he obtain it), or, without them, any two benefices with cure or otherwise incompatible as expressed in the said letters, as if mention had been made therein of the said church of Thornton (fn. 17) [and] not of the said vicarage. The pope has recently ordered the administration of the monastery of St. Thomas the Martyr, Abberbrothoc, O.S.B., in the diocese of St. Andrews, void by the death of abbot Alexander extraR.c., to be granted for five years, and more, at the pleasure of the apostolic see, to Patrick, archbishop of St. Andrews, who has recently departed from the Roman court. In order to save him the labour and expense of returning to the said court, the pope hereby orders the above three to receive from him the usual oath of fealty, according to the form enclosed, and to send it by his letters patent, sealed with his seal, by their own messenger. The pope has learned that the perpetual vicarage of Kyllnaheind (fn. 21) in the diocese of Achonry is void by the resignation of Malachy Ycluan to bishop Cornelius; and it is alleged by William Oelnam, clerk, of the said diocese, that on the voidance of the said vicarage by the resignation of Rory Yara to the said bishop, collation thereof was made by the said bishop by his ordinary authority to the said William, without his having obtained any dispensation on account of illegitimacy, as the son of a clerk and an unmarried woman related in the fourth degree of kindred, that he obtained possession, and that he has detained it for between two and three years without having himself promoted to the priesthood, the said bishop receiving the fruits in the first year, those of the second year being converted by the said William to the fabric of the said church, whilst in the third year he received little or nothing, wherefore he was deprived by the said authority and resigned. The pope, therefore, hereby rehabilitating the said William on account of the foregoing, etc., orders the above three to collate and assign to him the said vicarage, value 6 marks sterling, and dispenses him, who has been made a clerk, to act as such, be promoted to all, even holy and priest's orders, and receive and retain the said vicarage, notwithstanding the said defect, etc.Vite etc. (At the end: F. xx. To James Levineton, perpetual vicar of Ennerlichton in the diocese of Glasgow, M.A. Dispensation, as below. Calixtus III dispensed him, (i) to receive and retain for life with the perpetual vicarage of Leswade in the diocese of St. Andrews one other benefice, or if he resigned the said vicarage two other benefices, with cure or otherwise incompatible, even if dignities, etc., and even if one (alterum)) of such benefices were a parish church or a perpetual vicarage, and to resign them, simply or for exchange, as often as he pleased, provided that he did not hold two major or principal dignities, or two parish churches or perpetual vicarages, or one of each, (ii) to receive with the treasurership of Dunkeld and the said vicarage of Leswade any other benefice, or, if he resigned them, three other benefices, with cure or otherwise incompatible, even if two of them were parish churches etc., or major or principal dignities, etc., and, in the case of two parish churches or perpetual vicarages, or one of each, to retain them for seven years, or for life in the case of other incompatible benefices, not being two parish churches or two major or principal dignities, and to resign them, simply or for exchange, as often as he pleased, etc. [Cal. The pope hereby, at the petition of James, king of Scots and that of the said James, who holds under the said dispensations the precentorship of Dunkeld (a non-major non-elective dignity without cure) and the parish church of Fortiweot and the perpetual vicarage of Ennerlichton, in the dioceses of St. Andrews and Glasgow, the value of all of which does not exceed 90l. sterling, prolongs the said seven years to the term of the life of the said James, in regard to parish churches or perpetual vicarages, provided that of such three incompatible benefices not more than two be parish churches or perpetual vicarages.
