To the abbot of St. Peter's, Armagh, the prior of St. Leonard's, Dundalk, and Henry Corcrain, (fn. 1) canon of Armagh. Mandate, as below. The pope has been informed by Peter Oronaga, clerk, of the diocese of Dromore, that Magonius Osygayl, canon of Dromore, aspiring to a canonry of that church and the prebend of Clo[y]ndallayn therein, made, when he was received as a canon of the said church, a bargain with John Magynd, also a canon of Dromore and commissary in the diocese, that he would accept no prebend on account of his canonry until provision had been made of two prebends to two sons of the said commissary, after which bargain he at the time of his reception as a canon refrained from (fn. 2) accepting one prebend in favour of the first son of the said commissary, and then a second in favour of the second son, receiving from the latter a quantity of tithes; that on the voidance of a third prebend, that of Cloyndallayn, which requires priest's orders, he obtained it, held it for more than a year without being ordained priest and without dispensation, and has detained it for about another three years, using its fruits for himself and the concubine whom he openly keeps. The pope, therefore, orders the above three, if Peter (who was lately dispensed by authority of the ordinary on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to minor orders and hold a benefice without cure, and who has been made a clerk) will accuse Magonius before them, to summon Magonius, and if they find the foregoing to be true, to deprive and remove Magonius, and in that event to collate and assign the said canonry and prebend, value 6 marks sterling, to Peter, who is hereby dispensed to be promoted to all even holy orders and hold them, and to resign or exchange them for another benefice even with cure. To the abbot of Tychefeld in the diocese of Winchester. Mandate, as below. It was lately set forth to the pope by David Hausbond, rector of Brixton alias Brighteston (etc. as above, p. 21, here with the following variants: … with John Fych, then rector of Herbrandston alias Herbenston … chapel called Mawdelenis hospital … the parish church of Bideden [sic] in the diocese of Canterbury … that, resigning Bidenden … the parish church of Elyngdon alias Elyndon, in the diocese of Salisbury, and held it with Brighteston and the said canonry and prebend of St. Mary's. The said statement having added that David feared lest in virtue of the statutes of the legate Ottobon the said collations were void, and that he had incurred simony etc., the pope ordered John Lascy, canon of Wells, to absolve him from such simony, etc. (as ibid.), granted that the said presentations, etc. (as ibid.), and dispensed him to retain the said churches of Brighteston and Elyngdon with the said canonry and prebend of St. Mary's for life. At his recent petition, containing that, inasmuch as the said canon John was not in holy orders at the time of the pope's said letters, it is doubted whether he can execute them; and containing other matters (here related) which had been omitted in his former statement, the pope hereby orders the above abbot to proceed to execution of his former mandate, as if it had been originally addressed to him.
