Mandate to collate and assign to Thomas Bared, perpetual vicar of the parish church of Kyllidgayn in the diocese of Killala (who was dispensed on account of illegitimacy, as the son of a priest and a married woman, by authority of the ordinary to be promoted to minor orders and hold a benefice without cure, and by papal authority to be promoted to all, even holy orders and hold a benefice even with cure, after which he was so promoted and obtained the said vicarage, value 6 marks sterling; and to whom, after he had been received by authority of the ordinary as a canon of Killala, in which church there is not a certain number of canons, the pope ordered provision to be made of the precentorship of the said church, a non-elective office with cure, value 2 marks sterling, which, then void, the pope ordered to be erected into a prebend of the said church; and whom the pope dispensed to receive the said canonry and erected prebend and retain them for life with the said vicarage), the provostship of the said church, a non-major elective dignity with cure, value 16 marks sterling, void and reserved to the pope by ‘Execrabilis,' because Henry Bared, having obtained it by papal authority when holding the rectory of Bredach of the parish church of Maygamnach, (fn. 2) in the said diocese, which has cure, detained them together for more than a month, and has since detained them for between twentyfour and twenty-five years, without any new title and without dispensation; summoning and removing the said Henry. Mandate to grant in commendam for life to Fergallus Machaeghan, (fn. 3) archdeacon of Cloyne, the fruits etc. of whose said archdeaconry, a non-major dignity, do not exceed 8 marks sterling, with which he cannot conveniently maintain himself, the perpetual vicarage of the parish church of Loacluatd alias de Stangno Ciner(um) in the diocese of Cloyne, value 12 marks sterling, of lay patronage, so long void by the death extra R.c. of Fergallus Oglasdigeyt (fn. 4) that its collation has lapsed to the apostolic see. To the abbot of O'Dorney (de Kyrieleyson) in the diocese of Ardfert, and the archdeacon and the official of Ardfert. Mandate, as below. The pope has learned that the perpetual vicarage of the parish church of Kyllonayn in the diocese of Ardfert has been so long void, by the resignation of John Issuleuayn to the late Maurice, bishop of Ardfert, that its collation lapsed to the apostolic see, although Donatus Omulchonary, (fn. 5) priest, of the said diocese, was presented to it by prior John and the convent of Ballinskelligs (Sancti Michaelis de Rupe), O.S.A., in the said diocese (to whom the presentation belongs by ancient custom) to the vicar-general of John, [now] bishop of Ardfert, after the said lapse, and was instituted by the said vicar-general, and has detained it for about eight months. The pope therefore orders the above three to grant the said vicarage, value 10 marks sterling, in commendam for life to Maurice Omulchonray, (fn. 6) a canon of the said monastery, who is a priest and has made his profession of the said order, and who was lately dispensed by papal authority on account of illegitimacy, as the son of a professed canon of the said monastery in priest's orders and an unmarried woman, related in the third degree of kindred, to be promoted to all, [even] holy orders, and hold a dignity of the said order (after which he was promoted to all holy orders), and who cannot easily be maintained from the common fruits of the said monastery on account of their slenderness; summoning and removing the said Donatus. Mandate to collate and assign to Cornelius Omyckan, perpetual vicar of the parish church of Kyltyle in the diocese of Emly, value 3 marks sterling, the perpetual vicarage of the parish church of Kyllynanalyn in the said diocese, value 2 marks sterling, so long void that its collation has lapsed to the apostolic see, although Donald Oyffyrnan has detained possession of it for between one and three years without any title; summoning and removing the said Donald. To the abbot of Abington (de Huonya (fn. 7) ) in the diocese of Emly (Imilicen.), and the official of Emly. Mandate, as below. The pope has learned that the rectory of the parish church of Balegarry in the diocese of Emly is void and reserved to the pope by ‘Execrabilis’ because Magonius Oconnyrchy, when holding the perpetual vicarage of the parish church of Auuenesy (fn. 8) in the diocese of Limerick, obtained the said rectory by canonical collation and detained it with the said vicarage for more than a month against the said constitution, and continued to detain it, without any title or tittle of right, but by his own temerity, for more than six years but less than eight, and still detains it. The pope has also been informed by John Macbreyn, clerk, of the said diocese of Emly, that Laurence Ohyky, precentor of Emly and Denis Ohogan, rector of the parish church of Bryhuse in the said diocese of Emly, when under sentence of excommunication, and publicly proclaimed as such, celebrated masses and other divine offices in contempt of the Keys, and have taken part therein; thereby contracting irregularity, and are also notorious fornicators, that the said Laurence has committed simony and has dilapidated the immoveable goods of the said precentorship: and that the said Denis has allowed the roof and walls of the said church of Brynhuse [sic] to fall so much to ruin that it has no roof and that the rain comes in as far as its high altar. The pope therefore orders the above two, if the said John (who has been made a clerk, notwithstanding his illegitimacy, as the son of a priest and an unmarried woman by both parents of noble birth) will accuse the said Laurence and Denis before them, to summon them, and if they find the foregoing to be true, to deprive Laurence of the said precentorship and Denis of the said rectory of Bryhuse, and remove them, and in that event to collate and assign the said precentorship (which is a non-major non-elective dignity with cure, value not exceeding 12 marks sterling) and rectory of Bryhuse (which is of lay patronage, value not exceeding 8 marks sterling), and also, after summoning the said Magonius and others concerned, and removing him, the said rectory of Balegarri (which when void belongs to the presentation of the abbot and convent of St. Muyllhanuha, O.S.A., in the diocese of Lismore, and the value of which does not exceed 5 marks sterling), to the said John, whether the said three benefices be void as above, or in any other way, and provided that the consent of the said patrons of Bryhuse be given. The pope hereby dispenses the said John to be promoted to all, even holy and priest's orders, and to receive and retain together for life the said precentorship and rectories, or, without them, any three other benefices with cure or otherwise incompatible, and also any benefices of any number and kind, compatible with one another and with the aforesaid, even if they be canonries and prebends, dignities, etc., and two of them be parish churches or perpetual vicarages, and to resign them, simply or for exchange, as often as he pleases, provided that not more than two of such three incompatible benefices be parish churches or perpetual vicarages, nor such dignities be major or principal, etc. Vite etc. (P. lx. Mandate to collate and assign to Matthew Omulkryan, perpetual vicar of the parish church of Sulcoth in the diocese of Emly, value 8 marks sterling, the chancellorship of Emly, a non-major dignity, value 5 marks sterling, so long void that there is no certain knowledge of the mode of its voidance, and that its collation has lapsed to the apostolic see, although John Orryuidayn (? recte Orrgurdayn), priest, has detained possession for between about one and two years without any title; summoning and removing the said John. Mandate to collate and assign to Dermit Macbreyn, scholar, of the diocese of Emly (who is illegitimate, being the son of a priest and an unmarried woman, [both] of noble birth, and who desires to be a clerk), the church called the rural [church] of Laraglaen in the said diocese, of lay patronage and without cure, value 8 marks sterling, so long void that there is no certain knowledge of the mode of its voidance, and that its collation has lapsed to the apostolic see, although Edmund Ohedegan, clerk, has detained possession for between twelve and fourteen years, without any title; summoning and removing the said Edmund. The pope hereby dispenses him to be made a clerk and to be promoted to all, even holy and priest's orders, and receive and retain for life the said church, and with it any compatible benefices, notwithstanding the said defect, etc. Laudabilia dilecti filii. To Edmund Okayll, a canon of Emly. Mandate, as below. The pope has been informed by Donatus Machbryen, scholar, of the diocese of Emly, that John Oheyn, rector of the [parish] church of Agliscormyc in the said diocese, has cruelly committed homicide and, being publicly excommunicated, has taken part in masses and other divine offices, wittingly and in contempt of the Keys, to the shame of the priestly dignity. The pope therefore orders the above canon, if Donatus (who is illegitimate, being the son of a priest and an unmarried woman, and who desires to be made a clerk), will accuse the said John before the above canon, to summon John, and if he find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said rectory, without cure and value 5 marks sterling, after he has been made a clerk, to the said Donatus, whom the pope dispenses to be made a clerk and be promoted to all, even holy orders, and receive the said rectory, and to retain with it for life any compatible benefices, notwithstanding the said defect, etc. Laudabilia dilecti filii. Cist., in the diocese of Raphoe, made in Rome before Nicholas Lombo, priest, of the diocese of Reims, notary public, and to grant the said monastery, value not exceeding 21 marks sterling, in commendam for life to John Olasci, who has been created a canon of Raphoe by authority of the ordinary; notwithstanding that he holds the parish church of Auchones in the said diocese, which, as he has offered, he is to resign. The recent petition of Denis Ohelli, priest, of the diocese of Tuam, contained that lately, on the voidance of the perpetual vicarage of the parish church of Kyllonegane alias Racurmayn in the said diocese by the resignation of Maurice Ycullenan to Donatus, archbishop of Tuam, the latter made collation and provision of it to the said Denis, who in virtue thereof obtained possession, and still holds it, but doubts whether the said collation and provision hold good. The pope therefore orders the above three to collate and assign to him the said vicarage, value 3 marks sterling, whether still void as above, or by the non-promotion [to the priesthood] of the late Odo Yruechan, or void in any other way. To John, [bishop] elect of Llandaff. Dispensation, as below. The pope recently made provision to him of the said church of Llandaff on its voidance by the resignation to the pope of John, [now] a bishop in the universal church, and reserved to the said John a certain yearly pension for life from the fruits etc. of the episcopal mensa. At the recent petition of the said elect, containing that at the time of the said provision he held, and still holds, certain canonries and prebends of St. Davids and Albergwille [sic], (fn. 13) and that the said fruits etc. are so much diminished through the wars etc. with which those parts have long been afflicted, that he cannot easily keep up his episcopal state and pay the said pension, etc., the pope hereby decrees that the said canonries and prebends, value not exceeding 12l. sterling, are not void by the said provision, etc., or by the consecration which is to be conferred on him, etc., and dispenses him so that, even after obtaining possession of the said church [of Llandaff] he may continue to hold them in titulum for life, and also hold in commendam for life with the said church and canonry [sic] and prebend [sic] as many other benefices with or without cure, even if they be dignities, etc., as do not, with the said canonries and prebends, exceed in yearly value 100l. sterling (provided that not more than two of the said benefices have cure or be otherwise incompatible with one another), and may resign them and the said canonries and prebends, simply or for exchange, as often as he pleases, etc. Personam tuam. Confirmation, etc., as below. The pope recapitulates (without exemplifying, and therefore without dates)
(1) a bull of Alexander III, taking the Cistercian monastery of St. Mary, Thame (de Thama), in the diocese of Lincoln, under the protection of St. Peter and his own, confirming all their possessions, present and future, and mentioning by name the place in which the abbey itself was founded, with its adjacent lands, etc., the granges of Scipduna, Otheleia, Chestredona, Stoches, Wifalda, Sandretona, with all their appurtenances, and granting the usual Cistercian exemptions from tithes, and other usual monastic privileges;
(2) a bull of Honorius III, taking the said monastery under the protection of St. Peter and his own, and ordaining all the foregoing, and furthermore forbidding any of its brethren, after making his profession, to depart without licence of the abbot, forbidding the alienation of its lands and benefices without consent of the chapter or of the greater part thereof, forbidding its monks or lay brothers to be surety for any one or receive a loan of money from anyone, without licence of the abbot and convent, beyond the amount appointed by the chapter, granting that in their own causes, civil or criminal, etc. the abbot and convent should use the testimonies of their own monks, forbidding bishops etc. to compel the abbot and convent to [go to] outside synods or conventions, (fn. 14) and forbidding them to go to the houses of the abbot and convent for holding ordinations, (fn. 15) or to hinder the regular election of the abbot, etc. [not in Pressutti, Regesta Honorii Papae III, according to the Index];
as is more fully contained in the letters of the said popes. At the petition of the said abbot and convent, the pope hereby approves and confirms the said letters and all their contents, and moreover grants that the abbot and monks, present and future, shall not be bound to abstain from eating flesh from Septuagesima and Sexagesima to Quinquagesima Sunday, except on the usual abstinence days. (fn. 16) Furthermore, he grants in perpetuity to all faithful, being truly penitent and having confessed, who on the feast of the Assumption, from the first to the second vespers, visit the chapel of St. Mary near the gate of the said monastery and lawfully belonging thereto, and give alms for the maintenance (fn. 17) of the said chapel with ecclesiastical ornaments, and the conservation, upkeep and repair of the buildings of the said monastery, a relaxation of seven years and seven quarantines of enjoined penance, and ordains that the abbot for the time being may choose some fit priest, secular or regular of any order, to hear the confessions of the said faithful and absolve them from all their sins etc., except in cases reserved to the apostolic see, and enjoin on them a salutary penance. If similar indulgence, perpetual or for a certain time not yet elapsed, have been granted by the present pope, the present letters shall be null and void, as far only as regards the said indulgence. The next following bull in the register (on f. 61r.) is in fact dated at Rome, apud Sanctam Mariam Maiorem (corrected from Sanctum Petrum), 1476, 8 Id. June anno 5. Cf. also f. 122r. below.
