To the abbots of O'Dorney (Kyryeleyson) and Rastiue (?), (fn. 2) in the diocese of Ardfert, and the dean of Ardfert. Mandate, as below The pope has learned that [a canonry] of the church of Killaloe and the prebend called Iniscayg therein, value 30 marks sterling, are void by the death extra R.c. of Donatus Obreyn, and that the perpetual vicarage of Kilkoys in the diocese of Killaloe, value 10 marks sterling, is void by the death extra R.c. of Maurice Omadigan, and that both of them have been so long void that their collation has lapsed to the apostolic see, although Theodericus Obreyn, clerk, has for between five and six years unlawfully detained possession of the said canonry and prebend, and Dermit Mackayn, (fn. 3) clerk, for between six and seven years possession of the said vicarage, both without any title. The pope, therefore hereby orders the above three to summon the said Theodericus and Dermit, and unite the said vicarage to the said canonry and prebend for the lifetime of Donatus Macmohona [sic], (fn. 4) clerk, of the said diocese (who is by both parents of noble birth, and who from fear of the power of the said Theodericus and Dermit cannon safely meet them in the city and diocese of Killaloe), and to collate and assign to him the said canonry and prebend and vicarage thus united; whether the former be void by the death of Cornelius Ygyayg or Donatus Macerayg, or whether they and the vicarage be void in any other way. Non. Oct.
(7 Oct.)
St. Peter's, Rome.
(f. 187v.)
To the archdeacon of St. Andrews, William Mowat, a canon of Moray, and the official of St. Andrews. Mandate, as below. The recent petition of Alexander Vimes, priest, of the diocese of St. Andrews, bachelor of theology, contained that Thomas Kanedi resigned the perpetual vicarage of Disart in the said diocese, and that John Kanedi, then rector of the said church, alleging that the presentation to the vicarage belongs to the rector, presented the said Alexander to Robert Heumes, a canon of St. Andrews, appointed vicar-general in spirituals of the chapter (archbishop Patrick being then excommunicate), and that the said Robert de facto admitted the said resignation and instituted the said Alexander who, under pretext thereof, and without any title or right, took possession of the vicarage, and still detains it, taking the fruits. The said presentation and institution being therefore without force, the pope, hereby rehabilitating the said Alexander, orders the above three to receive and admit the said resignation for this turn only, and to collate and assign to him the said vicarage, value 3l. sterling; whether it be void as above, or by the resignation of Alexander Crafurd or Michael Oliphant, or be void in any other way. Before they proceed to execute these presents, he is to resign the vicarage. Solet apostolice sedis clementia. (N. xxviii. Septimo Idus Aprilis anno septimo. Garilliati.) [2¾ pp.]
