To the dean of Annaghdown (Enachdunen.), and Edmund de Burgo and Maurice Joy, canons of Tuam. Mandate to collate and assign to Richard Omelono, clerk, of the diocese of Tuam (who is illegitimate, being the son of unmarried parents, and who notwithstanding the said defect has been made a clerk by authority of the ordinary) the perpetual vicarage of Rynlacha [sic] in the said diocese, with cure and value 4 marks sterling, so long void that there is no certain knowledge of the way of its voidance and that its collation has lapsed to the apostolic see, although John Yoy [sic], priest, who is to be summoned and removed, has detained possession of it for between two and three years without any title. To the dean and the treasurer of Ossory, and Nicholas Whyt, a canon of the same. Mandate, as below. The pope lately, on the priory of St. Mary, Kells (de Kellis), O.S.A., in the diocese of Ossory, becoming void or its commenda ceasing, made collation and provision thereof to John Karne, a canon of the same, the pope's letters stating that its value did not exceed 120 marks sterling, under pretext of which, as is alleged, the said John took possession, and has detained it for between two and three years. At the recent petition of Thady, bishop of Down and Connor (containing that the value of the said priory amounts to 140 marks, although it does not exceed 160, and that by reason of the long wars, etc. the fruits etc. of the episcopal mensa of Down and Connor are too slight for his maintainance and for keeping up his state as befits the episcopal dignity), the pope, seeing that if the foregoing be true his said letters are surreptitious and the said collation and provision without force, hereby orders the above three to summon the said John and others concerned, and if they find true what is stated in regard to such greater value, to declare the said letters and collation and provision null and void, and in that event to grant the said priory, which is an elective conventual dignity, and which depends on no other regular place or monastery, and which has cure, howsoever void, to the said bishop in commendam for life, inducting him (after first receiving from him the usual oath of fealty according to the form enclosed), or his proctor, and removing the said John and any other unlawful detainer. To the prior of Ballinskelligs (sancti Michaelis de Rupe) in the diocese of Ardfert. Mandate, as below. The pope has been informed by Maurice Osullevayn, clerk, of the diocese of Ardfert that whilst a suit about the perpetual vicarage of Aghadoe (de Achadeo) in the said diocese (provision of which Thady Omulchaha, clerk, of the said diocese, alleged to have been made to him by papal authority, and Phelim (Felimcus) Machaycayn, priest, of the same diocese, to have been made to him by authority of the ordinary) was pending before a certain judge in those parts, the said Thady and Phelim agreed that Phelim should have possession of the said vicarage, and Thady a certain portion of its fruits etc.; and that the said Phelim has alienated and dissipated its moveable goods without lawful cause. The pope, therefore, hereby orders the above prior, if the said Maurice (who is in his twenty-third year, and has been dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to be made a clerk, and has since had himself made a clerk), will accuse Thady and Phelim before the said prior, to summon them, and if he find the foregoing to be true, to deprive and remove them, and in that event to collate and assign the said vicarage, value 8 marks sterling, to Maurice. The pope further dispenses him to be promoted to all holy, even priest's orders and receive and retain it, notwithstanding the said defects of age and birth, etc. Dignum etc. (N. xv. Quinto Id. To the abbot of Holy Cross, Huoctorlana, in the diocese of Cashel. Mandate, as below. The pope has learned that a canonry of Cashel and the prebend called [the prebend] of Kilbracha have been so long void that their collation has lapsed to the apostolic see, although Patrick Purchel, clerk, under pretext of a de facto collation and provision made to him by authority of the ordinary after the said lapse, has unlawfully detained possession for between one and three years. And the recent petition of Richard Botyler, rector of Kilthruayn in the diocese of Cashel contained that he desires, if provision be made to him of the said canonry and prebend, and be get possession of them, the said parish church to be united thereto for as long as he shall hold them. The pope, therefore, hereby orders the above abbot to summon the said Patrick and others concerned, and to collate and assign the said canonry and prebend, value 10 marks sterling, to the said Richard, who is by both parents of a race of barons and earls, and to unite thereto the said church, value 16 marks sterling, removing the said Patrick. To the archdeacon of Cashel. Mandate, as below. The recent petition of Richard de Burgo alias Okahayn, priest, of the diocese of Leighlin, contained that after Paul II's renewal of all sentences of excommunication etc. pronounced by Martin V and Eugenius IV against simoniacs, when, on the voidance of the rectory of Glaschro in the diocese of Ossory, of lay patronage, the true and sole patron was ready to present him thereto, he, who was then litigating in those parts about a certain (certo) deanery of the church of Leighlin, a major dignity, fearing that if he were presented to the said rectory he would lose whatever right he had in or to the said deanery, made a bargain with a friend to get the latter presented to the said rectory by the patron, and instituted by the ordinary, provided that he himself should rule the rectory and take its fruits etc., thereby incurring simony and the sentences of excommunication etc. therefor; that the presentation and institution of the said friend having been made by his means, he has for more than two years, with consent of the rector, ruled the said church, behaving as rector thereof, and taking the fruits etc., and has had himself reputed by all to be rector; that after he gave up the said rectory he received from him to whom provision thereof was made a quantity of woollen cloth for the expenses which he had incurred in the repair of its houses; that he got de facto provision made to him by authority of the ordinary of the treasurership of Ossory, being under the said sentences etc., and under pretext thereof still detains it; and that meanwhile, being under the said sentences, etc., he has celebrated masses etc., not in contempt of the Keys, thereby contracting irregularity. The pope, therefore, hereby orders the above archdeacon to absolve the said Richard from the said simony and sentences etc., enjoining a salutary penance, dispense him on account of the said irregularity, and rehabilitate him, and in that event to receive him as a canon of the priory of St. John the Evangelist by Kilkenny (iuxta Kilkeniam), O.S.A., in the said diocese, give him the regular habit, and receive his profession, and thereupon to collate and assign to him the said priory, which is conventual and has cure, and which depends on no monastery or other regular place, value not exceeding 70 marks sterling, void by the death of William Varing extra R. c., and reserved to the pope under his late reservation of all conventual priories. Mandate to collate and assign to Geoffrey Brennat, perpetual vicar of Kylauerau(n)d alias Metnatenaidi (?) [in the diocese of Tuam], the perpetual vicarage of Tempalnascrine alias Custodia reliquiarum sancti Arlathei, Tuam, value 6 marks sterling, so long void that there is no certain knowledge of the mode of its voidance, and that its collation has lapsed to the apostolic see, although Malachy Odurtan, priest, has without any title de facto detained possession for between twenty and twenty-five years, from fear of whose power the said Geoffrey dares not meet him within the city and diocese of Tuam; summoning and removing the said Malachy. Mandate to grant in commendam to Philip bishop of Ardfert the perpetual vicarage of Chyylhothy (fn. 3) in the diocese of Ardfert, value 8 marks sterling, void by the death extra R.c. of David Stack, and that of Kyllmoille, (fn. 4) in the same diocese, of like value, so long void that its collation has lapsed to the apostolic see, the said bishop alleging that on account of the power of laymen who detain and occupy the fruits and goods of his episcopal mensa, he enjoys them so little that he can hardly live on them (fn. 5) and bear his other burdens, and that he has no other means wherewith to maintain himself as the episcopal dignity requires. Cist., in the diocese of Tuam, who is illegitimate, being the son of an unmarried clerk and an unmarried woman, provision of the said monastery, value 50 marks sterling, void by the death extra R. c. of abbot Malachy Okellyd; summoning and removing William de Burgo, a monk of the same, who has detained possession for between three and five years without any title, and from fear of whose power the said Donald cannot safely meet him within the city and diocese of Tuam. To the prior of Yniseronan [sic] in the diocese of Killaloe (Laonien.), and Donatus Ograda and Denis Odagny, canons of Killaloe. Mandate, as below. The pope has been informed by Cornelius [son] of Thady (fn. 6) Macnamara alias Cunoa, clerk, of the diocese of Killaloe, that William Ohogan, precentor of Killaloe, aspiring by unlawful means to the said precentorship, of which he was then in possession, made a bargain with Maurus Ohewle, priest, of the said diocese, who alleged that he had a right to it, that if Maurus would leave him in peace in the said precentorship he would give and pay him part of its fruits etc. yearly, for the right which belonged to him therein, (fn. 7) which he afterwards paid, thereby incurring simony and the sentences therefor. And whereas subsequently the perpetual vicarage of the place of Inisceltra (fn. 8) in the said diocese became void at the apostolic see by the death there of Donald Ohorul, and therefore reserved to the pope, and whereas the recent petition of the said Cornelius contained that the fruits etc. of the said precentorship are insufficient for its holder to live therewith and bear its burdens, the pope hereby orders the above three, if the said Cornelius (who was dispensed by authority of the ordinary on account of illegitimacy, as the son of unmarried parents related in the fourth degree, both of them of noble birth, even of a race of dukes, to be promoted to minor orders and receive and retain a benefice without cure, and who in virtue thereof has been made a clerk), will accuse the said William before them, to summon the latter, and if they find the foregoing to be true, to deprive and remove him from the said precentorship, and in that event to collate and assign it, a non-major non-elective dignity with cure, value 12 marks sterling, to the said Cornelius, and to unite thereto the said vicarage, of like value, for as long only as he lives and holds the precentorship. The pope further dispenses him to be promoted to all holy orders and receive and retain the precentorship and any other compatible benefices with and without cure, and to resign them all, etc., and also not to be bound for ten years to be promoted to deacon's or priest's orders on account of the said precentorship or other benefice requiring holy, even priest's orders, whilst studying letters in an university, even if such benefice be a parish church, etc., provided that he be promoted to the order of subdeacon within a year from obtaining the said precentorship or other such benefice. And the recent petition of the said Cornelius (to whom the pope has this day ordered provision to be made of the precentorship of Killaloe, and ordered the perpetual vicarage of the place of Inysceltra (fn. 11) in the said diocese to be united thereto, as in the preceding, and who has been dispensed by authority of the ordinary and by the present pope, as ibid) containing that the fruits etc. of the said precentorship are insufficient for its holder to live and bear its burdens, the pope hereby orders the above three, if Cornelius will accuse Matthew before them, to summon the latter, and if they find the foregoing to be true, to deprive and remove him from the said vicarage of Clone, value 12 marks sterling, and in that event to unite it to the said precentorship, of like value, for as long only as the said Cornelius lives and holds it. Prem., has been so long void that its provision has lapsed to the apostolic see, although William Bremessley, archdeacon of Tuam, has without any title or right detained possession for between twelve and thirteen years), to summon the said William and grant in commendam the said monastery, value 15 marks sterling, to Maurus Ockacualud, dean of Annaghdown (Enagdenen.), who was lately dispensed by papal authority on account of illegitmacy, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and receive and retain any mutually compatible benefices with and without cure, and to resign them, etc.; [removing the said William].
