To James Fiela, a canon of Urgel (Urgellen.), and the officials of York and Lincoln. Mandate, as below. The recent petition of Robert Fenton, perpetual vicar of St. Clement's, Therynghton, in the diocese of Norwich, S.T.M., contained that on the voidance of the parish church of St. Michael of the town of Stamford (ville in Stanfordia), in the diocese of Lincoln, by the death of John Elyd extraR. c., the present abbot of Crowland, O.S.B., in the said diocese of Lincoln, presented the said Robert to Thomas bishop of Lincoln, who instituted him, in virtue of which presentation and institution he obtained possession of the said church of St. Michael. The said petition adding that he doubts whether the said presentation and institution hold good, and the pope having learned that the said church is still void as above, he hereby orders the above three to collate and assign to the said Robert (whom the pope lately dispensed to receive and retain for life with the said vicarage one other benefice, or without the said vicarage any two other benefices, with cure or otherwise incompatible, even if two parish churches, etc., and to resign them, etc.) the said church of St. Michael, value not exceeding 24l. petits tournois. To Matthew Obryen and Dermit Okaelly and Donatus Machmohona, canons of Killaloe (Laonien.). Mandate, as below. The pope has learned that the perpetual vicarage of Kyllfyorach in the diocese of Killaloe is void because Eugenius Ohoogonayn, when holding it, obtained by collation of the ordinary the sacristship of the church of Yny[s]kayd in the said diocese, which has cure, and that the said sacristship is void because the said Eugenius without papal dispensation detained it for more than a month with the said vicarage against ‘Execrabilis.’ and is reserved to the pope by the said constitution. The pope, therefore, hereby orders the above three to summon the said Eugenius, and to collate and assign to Dermit Mackahan, priest, of the said diocese (who alleges that the said Eugenius has detained possession of the said vicarage and sacristship for between three and five years after they became void as above, without having acquired any new title; that he (Dermit) has been dispensed by papal authority on account of illegitimacy, as the son of unmarried parents, to be promoted to all, even holy and priest's orders, and hold a benefice even with cure; that he obtained by canonical collation the perpetual vicarage of Cnocgrafoyn in the diocese of Cashel, and, resigning it, was dispensed by the same authority to receive and retain the perpetual vicarage of Kyllroys in the diocese of Killaloe, provision of which was ordered to be made to him by the same authority, and which he duly obtained; that against a definitive sentence delivered by a certain judge, appointed by papal authority in the matter of the said vicarage of Kyllroys, in favour of a certain adversary and against him, he has appealed to the apostolic see, and is within the time for prosecuting his appeal; and that he has been received by the chapter of the said church of Ynyskayd to a portion with cure about to become void (fn. 2) ), the said vicarage of Kyllfyorach, and the said sacristship, which is an office in the said church of Ynyskayd, value 12 and 5 marks sterling respectively, the said Eugenius being removed. The pope further dispenses him to receive the said sacristship and vicarage of Kyl[l]fyorach (if collated to him in virtue of these presents), and to retain them for life, or with one of them only the said vicarage of Kyllroys, if he obtain it peaceably, or with one of all of them any one other benefice, or without them all any other benefices, with cure or otherwise incompatible, even if they be two parish churches or perpetual vicarages, etc., and to resign them, etc. Vite etc. (At the end: Jo. xxx. To the dean of Lismore. Mandate, as below. The pope has learned that the monastery of Jerpoint (de Jeriponte) O. Cist., in the diocese of Ossory, has been so long void that there is no certain knowledge of the way of its voidance, and that its collation has lapsed to the apostolic see, although Thomas Blundel, (fn. 3) a monk of the said order, has detained it for several years without any title or right. The pope therefore orders the above dean to cause Gerald Vatonni (?), clerk, of the said diocese (who notwithstanding his illegitimacy, as the son of unmarried parents, has been made a clerk by authority of the ordinary, and who on account of the said Thomas's power cannot safely meet him in the city or diocese of Ossory) to be received as a monk of the said monastery, and the habit thereof to be given to him, and to receive his profession, and thereupon, if after summoning the said Thomas and others concerned, he find the said monastery to be void, and if he find the said Gerald to be fit, to make provision to him thereof, value 60 marks sterling, and appoint him abbot [the said Thomas being removed]. The pope further dispenses him to have provision made of him to the said monastery, etc., and grants that he may be blessed by any catholic bishop in communion with the apostolic see, without prejudice to the bishop of Ossory, to whom the said monastery is by ordinary right subject. To the abbot of Fermoy (de Castro dei) and the prior of Bridgetown (Ville pontis), in the diocese of Cloyne (Clonen.), and John Whyt, a canon of Cloyne. Mandate, as below. The pope has learned that the archdeaconry of the church of Lismore and a canonry and the prebend of Tollachartem therein have been so long void that their collation has lapsed to the apostolic see, although Maurice Stach has detained possession of the said canonry and prebend for between seventeen and eighteen years, and although James Thobym, clerk and deacon, (fn. 4) has detained possession of the said archdeaconry for between nine and ten years, both without any right. The pope, therefore, hereby orders the above three to collate and assign the said canonry and prebend and the said archdeaconry, which is a non-major, non-elective dignity with cure, value 6 and 34 marks sterling, respectively, to William Mondywell, clerk, of the diocese of Lismore, who was lately dispensed by papal authority on account of illegitimacy, as the son of an unmarried noble of knightly rank and an unmarried woman, (fn. 5) to be made a clerk and to be promoted to all, even holy orders, and receive and retain a benefice even with cure, in virtue of which he has had himself made a clerk, and who from fear of the power of the said Maurice and James dares not meet them in the city and diocese of Lismore; summoning and removing the said Maurice and James. To the priors of Monaincha (de Insula viventium) and Lorrha (Fontis vivi de Lora), in the diocese of Killaloe (Laonien.), and the official of Killaloe. Mandate, as below. The pope has been informed by Thady Osannan, priest, of the diocese of Killaloe, that Malachy Olannagan, a canon of Killaloe, when under sentence of excommunication and publicly proclaimed excommunicate, has, not in ignorance thereof, celebrated masses and other divine offices in contempt of the Keys, and has taken part therein, thereby contracting irregularity. The pope therefore orders the above three, if the said Thady will accuse the said Malachy before them, to summon the latter, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said canonry and the prebend of Renete (?), (fn. 6) value 15 marks sterling, to the said Thady. To the prior of Monimuske in the diocese of Aberdeen. Mandate, as below. The recent petition of Alexander Vaus, priest, of the diocese of Whiteherne (Candide case), M.A., contained that after licence and faculty had been granted to Thomas Vaus, [now] dean of Glasgow, then a continual commensal member of the household of William, [cardinal] bishop of Ostia, to resign all his benefices to the ordinaries, etc., extraR.c., simply or for purpose of exchange, and licence and faculty had been granted to such ordinaries etc. to carry out the exchange of such benefices [cf. below, f. 308r.], the said Alexander and Thomas exchanged, respectively, the perpetual vicarage of St. Nicholas's, Aberdin, and the precentorship (cantoriam) of Moray, the exchange being carried out by Martin Vaus, dean of Ross, by papal authority. The said petition adding that the said Alexander doubts whether the collation and provision thus made to him of the said precentorship holds good, and the pope having learned that it is still void as above, he hereby orders the above prior to collate and assign to Alexander the said precentorship, a non-major dignity, value 50 marks sterling, howsoever void, and even if it be specially reserved, or generally reserved because the said Thomas, when holding it, was, as is alleged, a chaplain acolyte of the pope and the apostolic see, or was, when holding it, a continual commensal member of the household of the said bishop of Ostia, and even if it be elective and have cure, etc. Dignum arbitramur. To Matthew Obryen, a canon of Killaloe (Laonien.). Mandate, as below. Lately, on learning that a canonry of the church of Kilfenora (Finoboren. [sic]) and the prebend in the same church of Ogormyc in the diocese of Killaloe, (fn. 8) of lay patronage, and also the perpetual vicarage of Clondagad in the said diocese, had successively become void, the pope by separate letters ordered provision thereof to be made to Donald Obrien, clerk, of the said diocese, who alleged that he was illegitimate, being the son of a married nobleman and an unmarried woman, and that he was in his eighteenth year, the pope successively dispensing him by the same letters to be promoted to all holy even priest's orders, and receive and retain the said canonry and prebend and vicarage, notwithstanding the said defects of birth and age. Seeing that, as his recent petition contained, his mother was a married woman, that he obtained the said canonry and prebend and vicarage in virtue of the said letters, and also got provision made to him by authority of the ordinary, when in his twentieth year, and without any other papal dispensation on account of the said defects of age and birth, of the rectory of the canonically united parish churches of Cluonleidt, Kylogenedyac, Kyltoeyly and Kylsynacthy (fn. 9) in the said diocese, which rectory is also of lay patronage, and that he has detained the said canonry and prebend for about four years and the said vicarage and rectory for between one and two years, without any dispensation to hold them together, and without being promoted to any holy order, and without dispensation for the purpose; and seeing that, in consequence of the foregoing the said letters are without force, and seeing that, as the pope has learned, the said canonry and prebend and also the said vicarage and rectory are still void as above, the pope, rehabilitating the said Donald, and decreeing that the said letters and dispensation on account of illegitimacy, and their consequences, shall hold good from the present date, as if it had been expressed in them that he was the son of a married woman, etc., hereby orders the above canon to collate and assign to the said Donald, who alleges that he is in his twenty-second year, the said canonry and prebend, vicarage and rectory, value 13, 8 and 15 marks sterling, respectively, provided that the patrons of the said prebend and rectory consent. He further dispenses him to receive and retain the said vicarage and rectory for life, and not to be bound for seven years to be promoted to deacon's or priest's orders on account of the said vicarage and rectory, provided that within a year he be ordained subdeacon, notwithstanding the said defects of age and birth. Mandate to collate and assign to John de Burgo, clerk, of the diocese of Annaghdown (who, although up to his twenty-eighth year he was held and reputed to be legitimate, is now stated, and especially by his mother, to be illegitimate, as the son of a married man and an unmarried woman, (fn. 10) and who has been made a clerk), the perpetual vicarage of Furanmor in the said diocese, of lay patronage, and value 6 marks sterling, so long void that there is no certain knowledge of the way of its voidance and that its collation has lapsed to the apostolic see. Mandate to collate and assign to John Oloynsigh, priest, of the diocese of Ardfert (who, notwithstanding his illegitimacy, as the son of a priest and a married woman, was made a clerk, and promoted to all holy even priest's orders, and obtained the perpetual vicarage of Killaha in the said diocese, canonically collated to him, which he afterwards resigned; and who from fear of the power of the below-named Donatus dares not meet him in the city and diocese of Ardfert), the perpetual vicarage of Killchumyn, situate within the bounds of the deanery of Aghadoe (de Acadco), in the said diocese, value 8 marks sterling, so long void that there is no certain knowledge of the way of its voidance, and that its collation has lapsed to the apostolic see, although Donatus Oleyn, priest, of the said diocese, who is to be summoned and removed, has detained possession of it for between one and two years, without any title. To Reynaldus Oherladre, a canon of Cork. Mandate, as below. The pope has learned that the perpetual vicarage of Killarne in the diocese of Ardfert has been so long void that there is no certain knowledge of the way of its voidance, and that its collation has lapsed to the apostolic see, although Thomas Omulkatha, clerk, of the said diocese, has without title detained possession of it for between one and two years. And the recent petition of John Ymulkatha, clerk, of the said diocese, contained that lately, (after he had been dispensed by the pope's penitentiary (fn. 11) on account of illegitimacy, as the son of a clerk and an unmarried woman, to be promoted to all even holy and priest's orders and hold a benefice even with cure, in virtue of which he had himself made a clerk and obtained the said vicarage by collation of the ordinary), he held it for six years without having himself promoted to the priesthood, taking the fruits etc., although but few, thereby incurring irregularity. The said John alleging that he has accidentally lost both the said letters of the penitentiary and the dispensation made to him in virtue thereof, and also the letters of his being made a clerk, so that he cannot produce any proof of them, (fn. 12) and that he subsequently gave up the said vicarage, the pope hereby rehabilitates him, and orders the above canon (inasmuch as from fear of the power of the said Thomas the said John dares not meet him in the city and diocese of Ardfert), to summon the said Thomas, and to collate and assign the said vicarage, value 12 marks sterling, to the said John, the former being removed. The pope further dispenses him to act as a clerk and be promoted to all other, even holy and priest's orders, and to receive and retain the said vicarage, notwithstanding the said defect, etc. Sedes apostolica pia mater. To the official of Moray. Mandate, as below. The recent petition of Martin Vaus, dean of Ross, contained that on the voidance of a canonry of Aberdeen and the prebend of Murtile therein by the resignation of Thomas Vaus to the late Thomas, bishop of Aberdeen, in virtue of a papal indult granted to him to resign his benefices, simply or for purpose of exchange, to the ordinaries etc., and for the ordinaries to carry out the exchange of such benefices [cf. above, f. 143r.], the said bishop by papal authority made collation and provision of the said canonry and prebend, thus void, to the said Martin, who has perhaps obtained possession. The said petition adding that he doubts whether for certain reasons the said collation and provision hold good, and the pope having learned that the said canonry and prebend are still void as above, he hereby orders the above official to collate and assign to him the said canonry and prebend, value 18l. sterling, howsoever void, even if they be specially reserved, or generally reserved because, as is alleged, the said Thomas was at the time of holding them a chaplain acolyte of the pope and the apostolic see and a continual commensal member of the household of William [cardinal] bishop of Ostia, the pope's chamberlain.
