To the bishop of Lismore, the prior of the monastery of Ardehattan (de Archaten) and the provost of the church of Kilmai(n)e, in the diocese of Lismore. Mandate, as below. The recent petition of Angus, bishop of Sodor, contained that upon Elizabeth, countess of Ross, falsely relating to John, bishop of Dunblane (who she said had been appointed to her as judge by authority of certain papal letters) that the said bishop Angus owed her a certain sum of money, the said bishop John, without citing the said bishop Angus, at least lawfully, promulgated an unjust definitive sentence by which he condemned him in costs (which he afterwards taxed at an excessive amount), and monished and warned him to pay the said sum to the said countess, wherefore he has appealed to the apostolic see. The pope, therefore, hereby orders the above three to summon the said countess and others concerned, hear both sides and, taking cognizance of the principal matter also, decide what is just, without appeal, causing their decision to be observed by ecclesiastical censure. The pope lately (upon learning that Matthew Obryen, clerk, of the diocese of Killaloe, after for some time holding peaceful possession of the above vicarage, had been despoiled thereof by Gilbert Omyer, priest, of the said diocese, with the help of lay power, and had resigned it before Robert Dondon, clerk, of the diocese of Limerick, a notary public by imperial authority, and witnesses) ordered the said resignation to be admitted, and provision thereupon to be made to the above Thady, by letters which have been executed. At his recent petition, containing that it is alleged that the said vicarage became and is void otherwise than as above, the pope hereby grants to him (who alleges that in virtue of the said letters he obtained the said vicarage and at present holds it) that the said letters and their consequences shall hold good from the date of these presents, in whatsoever way the said vicarage, value 10 marks sterling, be void, etc. Vite etc. [1½ pp. See above, p. 391.]

To the bishop of Norwich. Mandate, as below. The recent petition of John Yelverton, a monk of the church of Norwich, O.S.B., contained that he left and remained without the said church, without giving up the habit, and still so remains, thereby incurring apostasy and the sentences of excommunication, etc., therefor. The said petition adding that he is penitent and desires to re-enter the said order, the pope hereby orders the above bishop to absolve the said John from the said apostasy and sentences, etc., enjoining a salutary penance, dispense him on account of irregularity contracted, if any, by celebrating masses, etc., when under the said sentences, not in contempt of the Keys, and rehabilitate him. In the event of the bishop's so doing, the pope further dispenses the said John to receive and retain for life any benefice with or without cure wont to be held by secular clerks, even if a parish church, etc., and to resign it, etc. Apostolice sedis indefessa clementia. To Dermit (Dermisio) Obryen and Denis Odeagyd, canons of Killaloe (Laonien.), and the official of Killaloe. Mandate, as below. The recent petition of Gilbert Omigyir, perpetual vicar of Drumcleyb in the diocese of Killaloe, contained that he obtained the said vicarage by collation made to him by papal authority; that after he had held it for about twelve years, upon Matthew Obryen, priest, of the said diocese, falsely suggesting to the pope that the said vicarage was then void, the pope, thus circumvented, ordered the abbot of Clar[e] in the diocese of Killaloe if, after summoning the said Gilbert and others concerned, he found that the said vicarage was void in any way, to collate and assign it to the said Matthew; that the latter, falsely alleging that it was void and belonged to him by the said letters, brought the said Gilbert under pretext thereof before Milerus, abbot of the said monastery, who wrongfully proceeding, promulgated an unjust definitive sentence in favour of the said Matthew and against the said Gilbert, from which the latter appealed to the apostolic see; that afterwards, whilst the said appeal was pending, they made a canonical and non-simoniacal agreement about the said vicarage; that Matthew, not without fraud, resigned it before a notary public and witnesses in the Roman court; that the pope, ordering the said resignation to be admitted, ordered the prior of the secular and collegiate church of Ynischay[d] in the diocese of Killaloe and Dermit Okaelly and Theoderic Obrien, canons of Killaloe, if they found the said resignation to have been lawfully made, to admit it by papal authority, and collate and assign the said vicarage to Thady Macormayn, priest, of the said diocese [above, pp. 391–2]; that the latter, falsely alleging all the foregoing to be true, and that the said vicarage belonged to him, brought the said Gilbert before the said Dermit, who, wrongfully proceeding, promulgated an unjust definitive sentence in favour of the said Thady and against the said Gilbert, from which the latter appealed to the said see, and obtained papal letters in the matter of his appeal to the abbot of Kyltena in the diocese of Kilfenora (Finaboren.) and the dean of Kilfenora (inasmuch as from fear of the said Thady's power he could not safely meet him in the city or diocese of Killaloe), and caused the said Thady to be summoned before Cormac, abbot of Kyltena, who, duly proceeding in this latter appeal cause, promulgated a definitive sentence by which he revoked the sentence of the said Dermit; that afterwards the said Thady, under pretext of certain letters from Matthew, bishop of Killaloe, a kinsman of his, unjustly despoiled the said Gilbert of the said vicarage and intruded himself, and is so intruded at present, wherefore Gilbert has appealed to the said see, and has petitioned the pope to commit the cause of this last appeal and of the principal matter, etc., to some upright men in those parts. The pope, therefore, hereby orders the above three to summon the said Thady and others concerned, hear both sides, and, taking cognizance of the principal cause also, decide what is just, without appeal, causing their decision to be observed by ecclesiastical censure.
