To the treasurer of Dublin. Mandate, as below. The recent petition of Walter Lodlowe, a canon of the priory of St. John Baptist, called the hospital of the Cruciferi, without the New Gate, Dublin, O.S.A., (fn. 2) contained that on the said priory becoming void in a certain way the convent duly elected him, professed of the said order, as prior, that he consented to the election, and had it confirmed by authority of the ordinary, and in virtue thereof obtained possession of the priory, and has held it for about two years. His said petition adding that he doubts whether the said election (fn. 3) and confirmation hold good, and the pope having learned that the said priory is still void, as above, he hereby orders the above treasurer to collate and assign it, conventual and elective, and value not exceeding 60 marks sterling, to the said Walter, and, after receiving from him the usual oath of fealty according to the form enclosed, to induct him. To William Oduygyn, a canon of Killaloe (Laonien.). Mandate, as below. The priory of St. Mary, Rathkeale (de Rathgrala [sic]), O.S.A., in the diocese of Limerick, which is conventual, has become void because David [son] of John Dubyly de Geraldinis has transferred himself to the house of Athar of the order of Friars Minors, called [the friars] of the Observance, (fn. 4) in the said diocese, and has assumed and at present wears therein the habit wont to be worn by the friars of the said order of Friars Minors, (fn. 5) and is reserved, under the pope's late reservation of all conventual priories, then void and to be void. The pope, therefore, hereby orders the above canon to cause Thady Oflathif [sic], perpetual vicar of Khilscanyll in the said diocese (who was lately dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all even holy orders and hold a benefice with or without cure, in virtue of which he holds the said vicarage, value not exceeding 6 marks sterling) to be received as a canon of the said monastery and the habit thereof to be given to him and receive his profession, and in the event of his so doing to collate and assign to him the said priory, value (with its annexes) not exceeding 12 marks sterling, whether it be void as above, or by the death of William Yketh extra R. c., or in any other way. The pope further dispenses him to receive it in titulum, even without taking the habit and making his profession, until he obtains peaceful possession, and to retain with it the said vicarage in commendam for life, even after he makes his profession and takes the habit, notwithstanding the said defect, etc. (fn. 6) As soon, however, as he obtains possession, he is to take the habit and make his profession: if not, these presents shall in no wise profit him. To the chancellor of Dublin, and Ysac Omalala, a canon of Elphin, and Nicholas Wyth, a canon of Ossory. Mandate, as below. The recent petition of Thomas Purcell, clerk, of the diocese of Cloyne, contained that after he, alleging that he was the illegitimate son of a priest and an unmarried woman, had been dispensed by papal authority to be promoted to all even holy orders and hold a benefice even with cure, upon a canonry of Ferns and a prebend therein, called [the prebend] of Fithard in the diocese of Ferns, becoming void in a certain way, the late John, bishop of Ferns, alleging that by custom he could do so, made de facto collation and provision of them by his ordinary authority to the said Thomas, who had no other dispensation on account of the said defect, and who under pretext of the said collation and provision obtained possession of the said canonry and prebend, and has detained them for between three and four years. Seeing that, as the said petition added, when the father of the said Thomas begat him he was a bishop, and that, as has newly come to Thomas's knowledge, the said bishop and Thomas's mother were related in the third and fourth, or the third and third degrees of kindred, of which (fn. 7) no mention was made in the said dispensation, wherefore it and the said collation and provision are without force, and seeing that the said canonry and prebend are therefore still void as above, the pope, rehabilitating the said Thomas (who alleges that he has had himself promoted to all even holy and priest's orders, and that he was utterly ignorant of the said relationship), hereby orders the above three to collate and assign to him the said canonry and prebend (which is sacerdotal), value 20 marks sterling. The pope further dispenses him to minister in the orders which he has received, even in the priesthood, and to receive and retain for life the said canonry and prebend, and with them one other benefice, or without them any two other benefices, with cure or otherwise incompatible, and also any compatible benefices, even if such incompatible benefices be two parish churches, etc., and to resign them all, etc., notwithstanding the said defect, etc., but before proceeding to execute these presents he is to resign the said canonry and prebend. To the archbishop of Patras, the abbot of Kilcooly (de Auricampo, recte de Aruicampo) in the diocese of Cashel, and Ysach Omullalayd, a canon of Elphin. Mandate to collate and assign to John Brenach, perpetual vicar of Leydmoaioc [sic] in the diocese of Cashel (who was lately dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all, even holy and priest's orders, and hold a benefice with or without cure, and who in virtue thereof has been made a clerk, and has obtained by canonical collation the vicarage of the said parish church, to which the vicarage of Burgesle (fn. 8) in the said diocese is annexed, and holds it at present), the archdeaconry of Cashel, a non-major dignity, value (with its annexes) 30 marks sterling, void by the death of James Canthuell extra R. c.; whether it be so void, or be void by the consecration by the pope's order of John, bishop of Ossory, at the apostolic see, or be void in any other way. Mandate to collate and assign to James Walche alias Brenach, perpetual vicar of the canonically united parish churches of Kyllatthy and Kyllbecog in the diocese of Ossory, the perpetual vicarage of the parish church of the place of Kylltogichayn (fn. 9) in the said diocese, of lay patronage and value 7 marks sterling, so long void that there is no certain knowledge of the way of its voidance, and that its collation has lapsed to the apostolic see, although Philip Occalachyn, (fn. 10) priest, has without any title detained possession of it for a long time, whereof likewise there is no certain knowledge, and still detains it, the said Philip being summoned and removed. To the abbot of St. Mary's, Fermoy (de Castro dei). in the diocese of Cloyne, the precentor (cantori) of Cloyne, and William Ohenasse, a canon of the same. Mandate, as below. The pope has learned that the priory of St. Mary, Bridgetown (ville pontis), O.S.A., in the diocese of Cloyne, has been so long void that its collation has lapsed to the apostolic see, although Dermit Oleyni has detained possession for between ten and twelve years without any title. He, therefore, orders the above three to cause Philip Roche, dean of Cloyne, to be received as a canon of the said priory and the regular habit to be given to him, and to receive his profession, and moreover if, after summoning the said Dermit and others concerned, they find that the said priory, conventual, elective and with cure, value 80 marks sterling, is void, to collate and assign it to the said Philip, the said Dermit being removed. Mandate to collate and assign to Gilbert Omygyr, priest, of the diocese of Killaloe, the parish church of Drumcleayb, called a rectory, (fn. 12) in the said diocese, value 2 marks sterling, so long void that there is no certain knowledge of the way of its voidance, and that its collation has lapsed to the apostolic see, although John Macorman, clerk, of the said diocese, has detained the said rectory for between five and six years, without any title, the said John being summoned and removed; whether it be void by the death of Thady Ymyr, or howsoever it be void. Mandate to collate and assign to John [son] of Edmund de Geraldinis, clerk, of the diocese of Cloyne, who is in his eleventh year, a canonry of Cloyne and the prebend de Kyllmodono therein, value 16 marks sterling, so long void that there is no certain knowledge of the last way of its voidance, and that its collation has lapsed to the apostolic see, although Egimundus Roche, clerk, has detained them for between four and five years without any title, from fear of whose power the said John cannot safely meet him in the city and diocese of Cloyne, and who is to be summoned and removed.
