To the abbot of St. Peter's, Westminster, in the diocese of London, and the official of Rochester. Mandate, as below. The recent petition of James Dobyll, rector of Denyngton, and Richard Legatt (?) and Thomas Frende alias Sheppherd, laymen, of the diocese of Norwich, parishioners of the said church, contained that [William] Kyng, (fn. 2) rector of Badyngham in the said diocese, falsely alleging that the place or field called ‘Summannysfeld' in the same diocese, which the said laymen possess, and which is within the bounds of the parish of the said church of Denyngton, was within the bounds of the parish of the said church of Badyngham, and that the tithes thereof, which lawfully belong to the said church of Denyngton, belonged to the church of Badyngham, and that the said laymen wrongfully refused to pay them to him, brought them before David WillZ(a)m, locum tenens of the official of Canterbury, who, wrongfully proceeding, promulgated an unjust definitive sentence in favour of the said William, and against the said laymen, from which they, and also the said James for his interest, have respectively appealed to the apostolic see. At the said petitions, therefore, the pope hereby orders the above two to summon the said William and others concerned, hear both sides and, taking cognizance of the principal matter also, decide what is just, without appeal, causing their decision to be observed by ecclesiastical censure. To the abbot of Tracton (de Alboirattu, recte de Albotractu) in the diocese of Cork, the treasurer of Cork, and Donatus Oherlache, a canon of the same. Mandate, as below. The recent petition of Cornelius Yflayn, abbot of the monastery of St. John the Evangelist, Gill Abbey alias St. Finbar's Cave (de Antro (fn. 4) sancti Finbarri), O.S.A., in the diocese of Cork, contained that although provision of that monastery was made to him by Paul II, and although he has since laudably ruled and administered it, and although to him and the convent belongs the choice of the canons thereof, and their confirmation to the abbot and convent of St. Mary's, Cong (de Concha), O.S.A., in the diocese of Tuam, nevertheless Rustardus de Burgo, abbot of St. Mary's, Cong, (fn. 5) and fatherabbot of the said order, and the convent of the same have, without citing him, etc., at least canonically, de facto deprived him of the said rule and administration, and, without any previous election, and against the custom hitherto observed, have received divers persons as canons of the said monastery, and have almost despoiled it of all its moveable goods, and taken them away. At the petition therefore, of the said Cornelius, who alleges that he is still in possession of the said monastery, the pope hereby orders the above three to summon the said abbot Rustardus and convent, and others concerned, and, if they find the facts to be as stated, to revoke all that has been done by the said abbot and convent to the prejudice of the said abbot Cornelius, and cause the said goods to be restored to him, and moreover not to allow him to be molested by the said abbot and convent in regard to the said rule and administration, and cause him to enjoy peaceful possession of the election of the said canons, compelling contradictors by ecclesiastical censure, etc. Humilibus etc. [12/3 pp. See Cal. To John bishop of Beirut (Bericen.), dwelling in the city of London, and the abbot of Corwlond [sic] in the diocese of Lincoln. Mandate, as below. The recent petition of Henry Davers and Richard Haynes, laymen, of London, contained that they, the sole executors of the will of the late Thomas Beleter, layman, of London, brought Richard Gosnore, layman, of London (who was acting as executor of the said will, and was detaining a certain sum of money, etc., belonging to the estate of the said testator, etc.), before Thomas, cardinal priest of St. Ciriac's in Termis, archbishop of Canterbury by papal dispensation, and by reason thereof papal legate in England; and that the said Richard Gosnore, falsely alleging that the said Thomas had bequeathed to him a certain sum of money in the said will, brought the said executors, with the object of having them condemned and compelled to pay him the said sum, before David William, dean of St. Mary le Bow (de Arcubus), London, locum tenens of the court of the said legation; and that although the said executors requested the said David to compel the said Richard Gosnore to desist from the said execution and detention, and offered to pay him any legacy justly due to him, the said David refused to hear them, admitted certain inadmissible articles on behalf of the said Richard Gosnore, and ordered them to answer the same, wherefore they have appealed to the apostolic see, and have petitioned the pope to commit the cause of the said appeal, etc., that of the nullity of the proceedings of the said David, and that of the principal matter, to some upright men in those parts. The pope, therefore, hereby orders the above two to summon the said Richard Gosnore and others concerned, hear both sides, and decide what is just, without appeal, causing their decision to be observed by ecclesiastical censure. To William Plumer, a canon of the priory of St. Mary, Buttele, O.S.A., in the diocese of Norwich. Grant, as below. He was lately dispensed by papal authority to receive and retain for life any two benefices with cure or otherwise incompatible wont to be held by secular clerks, even if parish churches, etc., and to resign them, etc. At his recent petition (containing that no mention was made in the pope's letters of the rectory of Wyrlyngham Magna in the said diocese, wont to be held by canons of the said monastery, which he was holding under a provision made to him by authority of the ordinary, and which he still holds, wherefore he doubts whether the said letters may not be held surreptitious), the pope hereby grants that the said dispensation and letters shall hold good from the date of these presents, as if the said mention had been made, and moreover [dispenses] him to receive and retain for life with the said rectory, or with any other benefice wont to be held by canons of the said order, any other benefice, or without it (absque illo) any two other benefices, with cure or otherwise incompatible, wont to be held by the said clerks. Pius II dispensed him to receive and retain for life with the said church any other benefice, etc., as above, f. 16v. The pope now dispenses him (who holds in virtue of the said dispensation, besides the said church, the chancellorship of London, a non-major dignity, provision of which was subsequently made to him), to receive and retain with them for life (even if the said chancellorship be elective and have cure), or with any two other benefices held by him in virtue of the said dispensation, any third benefice with cure or otherwise incompatible, even if a parish church, etc., and to resign it, etc., provided that of such three incompatible benefices not more than two be parish churches or perpetual vicarages.
