To the abbots of Wymondham in the diocese of Norwich and Waltlim (recte Walth[a]m) in the diocese of London, and the official of London. Mandate, as below. The recent petition of John Britclim (? recte Britch[a]m), (fn. 5) layman, of the diocese of Norwich, contained that John Baldewin, priest, of the said diocese, falsely alleging that he had defamed him of forgery, (fn. 6) and had therefore incurred sentence of excommunication under a certain constitution of the province of Canterbury [Constitutiones Johannis Peckham, in Wilkins, Concilia, tom. II, p. 35], brought him before David William (or William), holding the place of the official of Canterbury; and that the said David rejected certain lawful exceptions produced on behalf of the said layman, and often openly threatened to deliver a definitive sentence against him and excommunicate him, and cause him to be publicly proclaimed excommunicate, wherefore he has appealed to the apostolic see. The pope, therefore, at the said petition, hereby orders the above three to summon the said priest and others concerned, grant the said layman conditional (ad cautelam) absolution from any sentence of excommunication which may have been pronounced against him by the said David after the said appeal, hear both sides and, taking cognizance of the principal matter also, decide what is just, without appeal, causing their decision to be observed by ecclesiastical censure. To the bishop of Lincoln, and the abbots of Peterborough in the diocese of Lincoln and the abbot of Hyde in the diocese of Winchester. Mandate, as below. The recent petition of John Vinfiey (recte Vmfrey (fn. 7) ), layman, and Elizabeth Rede, mulier, of the diocese of Winchester, co-plaintiffs, (fn. 8) contained that John Bolne, rector of the parish church of Lyngfeldi in the said diocese, falsely alleging that the said Elisabeth had taken from him a certain mortuary, brought her before William Pakenham [sic], auditor-general of the court of causes of Thomas, cardinal priest of St. Ciriac's in Termis, who holds the church of Canterbury by papal grant and dispensation, and is by reason of that church legatus natus in those parts; that, whilst the suit was pending before the said William, the said John Vmfrey applied to be admitted to the suit, and, upon the said William refusing to admit him, appealed to the apostolic see; that the said William, wrongfully proceeding in the cause, promulgated an unjust definitive sentence in favour of the said John Bolne and against the said Elizabeth, condemning her in costs, from which she and the said John Vinfiey [sic] appealed to the said see; that, in contempt of the said later appeal, the said William taxed the said costs at a certain excessive sum, and monished the said Elizabeth to pay them to the said John Bolne within a certain time, under threat of the greater excommunication, wherefore she has appealed to the said see. The pope, therefore, hereby orders the above three to summon the said John Bolne and others concerned, grant the said Elizabeth conditional (ad cautelam) absolution from any sentence of excommunication which may have been pronounced against her, hear both sides, etc., as in the preceding. The recent petition of Richard Spenser, a canon of the priory of St. John Baptist, Briggewater, O.S.A., in the diocese of Wells and Bath, contained that on the voidance in a certain way of the said priory, which is elective, the convent duly elected the said Richard, who consented thereto and requested confirmation thereof, first from the vicar-general in spirituals of the bishop of Wells and Bath, and then from the bishop himself; that they both refused to hear him in the matter, and that the said bishop, who was then without his diocese, committed him to a prison which was not the bishop's prison, (fn. 9) wherefore he has appealed to the apostolic see. The recent petition of William Mulikyn’, perpetual vicar in the church of St. Andrew in Scotland, contained that John Wallette, (fn. 11) clerk, of the diocese of Glasgow, falsely alleging that he owed him certain sums of money, brought him before David Moldrun [sic], official of St. Andrews, who, wrongfully proceeding in the cause, promulgated an unjust definitive sentence in favour of the said John and against the said William, from which the latter has appealed to the apostolic see. The pope, therefore, hereby orders the above three to summon the said John and others concerned, grant the said William conditional absolution from any sentence of excommunication which may have been pronounced against him, hear both sides, etc., as above, f. 129r.
