To Cornelius Osgingin, Thomas Macraywaynd and Odo Odermaday, canons of Tuam. Mandate, as below. The recent petition of Malachy Ykonceanayd, priest, of the diocese of Tuam, contained that after he had got provision made to him by papal authority of the rectory of the parish church of Cillcoryrin in the said diocese [on its voidance] by the deprivation made by the said authority, of Thomas Ykonceanayd, and had been almost coerced, in accordance with an arrangement by certain clerks and laymen, to allow the said Thomas a moiety of the fruits, etc., for about three years, he has obtained by authority of the ordinary the restoration of the said moiety, still paying the said Thomas a certain other sum of money, and that, for greater quietness, and even beyond his legal obligation, he paid to the executors of the papal letters of deprivation, likewise almost against his will, the legal expenses (fn. 2); and that he afterwards obtained the union and appropriation to the said rectory for his life, by authority of the ordinary, of the perpetual vicarage of the parish church de Calceo, (fn. 3) and, resigning it, obtained the like union, etc., of the perpetual vicarage de Maglachia, [both] in the said diocese, in virtue of which he got possession of the said vicarages, taking the fruits thereof. The said petition adding that he fears lest on account of the aforesaid he has incurred simony and the sentences of excommunication, etc., therefor, the pope hereby orders the above three to absolve him from the said simony and sentences, enjoining a salutary penance, dispense him on account of any irregularity contracted, and rehabilitate him, and in the event of their so doing, to collate and assign to him the said rectory, and to unite and appropriate thereto, for his lifetime, the said vicarage de Maglach[i]a, yearly value together not exceeding 18 marks sterling. To Malachy Oconcenaynd, Thomas Machrissin, and John Ocynlis, canons of Tuam. Mandate, as below. The recent petition of Thomas Machiawayn, priest, of the diocese of Tuam, contained that by papal authority he got provision made to him, on its voidance, of the perpetual vicarage of the parish church de Cyllosgobo in the said diocese, and the union and appropriation thereto for his lifetime of a certain other perpetual vicarage in the same diocese; and that as the result of the said union he had a lawsuit against the then commendatary and convent of the monastery of Knockmoy (Collis victorie), O.Cist., in the said diocese, and that, in accordance with an arrangement made by certain arbitrators, he received a certain sum of money from the said commendatary and convent, and left them in peaceful possession of the said united vicarage; that afterwards, upon Cornelius Om[u? ]lchio(n)vyll, priest, threatening to go to law against the said Thomas about the said vicarage de Cyllosgobo, (fn. 4) and to impetrate apostolic letters against him in the matter, he promised by oath to pay to the said Cornelius a certain yearly pension from the fruits, etc., of the said vicarage de Cyllosgobo, but has always refused to pay it. The said petition adding that the said Thomas, who has held the said vicarage de Cyllosgobo for between six and seven years, taking the fruits thereof, fears lest he has incurred simony and the sentences of excommunication, etc., therefor, the pope hereby, with the consent of the said Thomas, dissolves the said union, and orders the above three to absolve him from perjury and from the said simony and sentences, etc., enjoining a salutary penance, dispense him on account of any irregularity contracted, and rehabilitate him, and decree that he cannot in future be deprived of the said vicarage de Cyllosgobo on account of the foregoing, nor be molested in respect thereof, and that he is not bound to observe the said agreement, and, in the event of their so doing, to collate and assign to him the said vicarage de Cyllosgobo, yearly value not exceeding 4 marks sterling.
