To the abbots of Tracton (de Albo tractu) and St. Finbar (sancti Fimbarri) alias St. John the Evangelist de Antro, in the diocese of Cork, and the official of Cork. Mandate, as below. The pope has learned that the treasurership of Cork, and a canonry of the same and the prebend called the prebend of Disertmor, have been so long void that by the Lateran statutes their collation has lapsed to the apostolic see, although Donatus Omerchu, clerk, and John Ohyerlahy the elder, priest, have for some years detained possession of the said treasurership and canonry and prebend, respectively, without any title, at least canonical. The pope, therefore, hereby orders the above three, if, after summoning the said Donatus and John the elder, they find that the said treasurership, which is a non-major dignity, and the said canonry and prebend, which are sacerdotal, yearly values not exceeding 10 and 14 marks sterling, respectively, are void in any ways soever, to collate and assign them to John Ohyerlahy the younger, clerk, of the diocese of Cloyne (Clonen.), who intends to engage in the study of letters, removing the said Donatus and John the elder. The pope further dispenses him to receive the said treasurership and canonry and prebend, and retain them together for life under one and the same roof, and not to be bound for five years to be promoted to deacon's and priest's orders on account of the said benefices, provided that within the first year thereof he be promoted to the order of subdeacon. To Donatus Ograda, John [son] of Thady (Thatei) Macnamara, and Denis Odeagig, canons of Killaloe (Laonien.). Mandate to collate and assign to Donatus Ohanrahayn, clerk, of the diocese of Killaloe (who was lately dispensed by authority of the ordinary on account of illegitimacy, as the son of the prior of a monastery of the order of St. Augustine, expressly professed of the said order and in priest's orders, and an unmarried woman, to be made a clerk, in virtue of which he had himself made a clerk), the perpetual vicarage of the parish church of Duyre in the said diocese, yearly value not exceeding 6 marks sterling, void by the death of Denis Odaly extraR.c., although Laurence [son] of Odo (Odonis) Macnamara, priest, who is to be summoned and removed, has wrongfully held possession of it for between six and eight months without any title or right. To the precentor of Cork, Maurice Odahyll, a canon of Emly, and Thomas Omehygayn, a canon of Cloyne (Clonen.). Mandate, as below. The recent petition of Dermit, [son] of Donatus Ysullevayn, clerk, of the diocese of Ardfert, contained that upon certain mariners (naute) betaking themselves to the island of Scarrys in the said diocese, for the purpose of plundering it and its inhabitants, and carrying off their goods, the said Dermit was present with certain of the said inhabitants in a conflict between the said mariners and inhabitants, in which divers were slain and others wounded, and that, being penitent, he desires to pray for the departed. The pope has also been informed by the said Dermit that John Omulconyr, prior of the priory of St. Michael de Rupe, O.S.A., in the said diocese, has alienated and dissipated its immovable goods, and also its precious movables, and has committed simony and fornication. At the said petition of the said Dermit (who alleges that he took possession of the perpetual vicarage of the parish church of Kilarocari (?) in the said diocese, yearly value not exceeding 12 marks sterling, on its voidance in a certain way, and detained it for some time, without any title or right, taking its fruits), the pope hereby orders the above three to absolve the said Dermit, who alleges that he is of noble birth, from the said excess, enjoining a salutary penance, dispense him on account of irregularity contracted, dispense him to be promoted to all, even holy orders and minister therein, even in the office of the altar, and receive and retain the said priory, if he obtain it in virtue of these presents, and rehabilitate him, and, in the event of their so doing, if he will accuse the said John before them, to summon the latter, and if they find the foregoing to be true, or one of them sufficient for deprivation, to deprive and remove him, receive the said Dermit as a canon in the said monastery, give him the regular habit thereof, and receive his profession, and, in the event of the said deprivation and removal, to collate and assign to him the said priory, conventual, and yearly value not exceeding 60 marks sterling. To the dean and the archdeacon of Clonmacnois (Cluanen), and, Charles Machoclan, a canon of the same. Mandate, as below. The pope has been informed by Bernard Odulayng, a canon of Clonfert, that Cornelius Odalay, perpetual vicar of the parish church of St. Mary, Athluan, in the diocese of Clonmacnois, has dilapidated and alienated its goods, movable and immovable, has committed notorious fornication, and does not reside in the said church. And the recent petition of the said Bernard contained that if the said vicarage were united to a canonry of Clonmacnois and to the prebend of which, on its voidance, the pope recently ordered provision to be made to him, for as long as he holds the said canonry and the said prebend, if he obtain them, he could be better able to maintain himself, etc. At the said petition, therefore, of the said Bernard (who alleges that the yearly value of the said canonry and prebend and of the perpetual vicarage of Lochluatha, in the said diocese, which the pope has also by other letters ordered to be similarly united to the said canonry and prebend for the lifetime of the said Bernard, does not exceed 16 marks sterling, that of the said vicarage of St. Mary not exceeding 8), the pope hereby orders the above three, if he will accuse the said Cornelius before them, to summon the latter and others concerned, as regards such deprivation, and those whose interest it is, as regards such union, and if they find the foregoing to be true, or one of them sufficient for deprivation, to deprive and remove the said Cornelius from the said vicarage of St. Mary, and in that event, and if they find to be true what is alleged in regard to the said union, to unite the said vicarage of St. Mary to the said canonry and prebend, if the said Bernard obtain the latter, for as long as he shall hold them. Confirmation, at the recent petition of John de Burgo, canon of Tuam, of the erection by Donatus, archbishop of Tuam, of the parish church of St. Mary the Virgin, Athnaryg, in the diocese of Tuam, into a collegiate church, with a chapter of a warden (the said John for his lifetime) and eight priests, with an endowment of the rectory and perpetual vicarage of the said church, which rectory and vicarage the said John was holding and still holds by papal dispensation, etc. The pope moreover, pro potiori premissorum robore, himself makes the said erection anew, etc. Ad perp. rei mem. Mandate to collate and assign to Cornelius Ochonbay, clerk, of the diocese of Cloyne (who was lately dispensed by authority of the ordinary on account of illegitimacy, as the son of unmarried parents, to be made a clerk, after which he was made a clerk), the perpetual vicarage of the parish church of Kyllsanayg in the said diocese, yearly value not exceeding 8 marks sterling, so long void that by the Lateran statutes its collation has lapsed to the apostolic see, although Thady (Thaterus) (fn. 2) Osykayn, priest, has detained possession for several years without any canonical title, the said Thady (fn. 3) and others concerned being summoned, and the said Thady (fn. 4) removed. The pope further dispenses the said Cornelius to be promoted to all holy, even priest's orders, and receive and retain the said vicarage, notwithstanding the said defect, etc. Vite etc. (Gratis pro deo. To the archdeacon of Cork, and John Barri and John Ocionyn (?), canons of the same. Mandate, as below. The pope has learned that a canonry and the chancellorship of the church of Ross and the prebend de Insula inyscum (?) therein have been so long void that by the Lateran statutes their collation has lapsed to the apostolic see, although Matthew Olance and John Ohuolachayn, clerks, have for some years detained possession of the said chancellorship and canonry and prebend, respectively, without any canonical title, and still detain them. And the recent petition of John Oheaa [sic], (fn. 5) priest, of the diocese of Ross, contained that, after the perpetual vicarage of the parish church of Nayrd in the said diocese had been so long void in a certain way that its collation had similarly lapsed, the late Donald, bishop of Ross, made him collation and provision of it, and that under pretext thereof he obtained possession and has detained it for several years, taking the fruits. The said vicarage being therefore still void, as above, and the said petition adding that if the said chancellorship be collated to him in virtue of these presents he will not be able to live on its fruits, etc., and therefore supplicating for the union thereto, for as long as he shall hold it, of the said vicarage, the pope hereby rehabilitates him on account of the foregoing, and orders the above three to summon the said bishop in the matter of such union, and for the rest the said Matthew and John Ohuolac[h]ayn and others concerned, and, if they find to be true what is alleged in regard to such union by the said John Ohega (who from fear of the power of the said Matthew and John Ohuolac[h]ayn dares not meet them in the city and diocese of Ross) and if they find the said vicarage, canonry and prebend, and chancellorship (which is a non-major non-elective dignity with cure), yearly values not exceeding 8, 8, and 4 marks sterling, respectively, to be void in any way, to unite the said vicarage to the said chancellorship for as long as the said John Ohega shall hold the latter, if he obtain it in virtue of these presents, and, moreover, to collate and assign to him the said chancellorship and canonry and prebend and vicarage to be united, removing the said Matthew and John Ohuolachayn and any other unlawful detainers, etc. Sedes apostolica pia mater. To Bernard Odalayd, (fn. 6) Eugene Magoncogrit, and Andrew Makeyalin, canons of Ardagh (Ardakaden.). Mandate, as below. The pope has been informed by Maurus Mackay, priest, of the diocese of Ardagh, that John Ocongayl, rector of the parish church of Ardgayce, alias Ballepyaris, (fn. 7) in the diocese of Meath, of lay patronage, has allowed the said church to fall into ruin and, although lawfully requested, has allowed certain parishioners to die without the sacraments, and has received money for the administration of such sacraments, thereby incurring simony. The pope, therefore, hereby orders the above three, if the said Maurus will accuse the said John before them, to summon the latter and others concerned, and if they find the foregoing to be true to deprive and remove him, and in that event to collate and assign the said church, yearly value not exceeding 5 marks sterling, to the said Maurus. To Donatus Ograda, a canon of Killaloe (Laonien.), and Matthew Macgyllyssachdy, a canon of Kilfenora (Fyniboren.). Mandate, as below. The pope has learned that the rectory of the parish church of Kylleyleach and Vchtforny, alias Glaey, in the diocese of Kilfenora, of lay patronage, and the perpetual vicarage of the parish church of Rathblanye in the diocese of Killaloe, have been so long void that by the Lateran statutes their collation has lapsed to the apostolic see, although John Madanchach (recte Maclanchach), clerk, and Denis Ocuyn, priest, have without any title and right detained possession of the said rectory and vicarage, respectively, for between four and five years, and one and two years, respectively. And the recent petition of Dermit Ibreyn the younger, a canon of Kilfenora, contained that the fruits, etc., of the canonries and prebends of Kilfenora and Killaloe, which he holds inter alia, are too slight for his maintenance, etc. At the said petition, therefore, of the said Dermit, who alleges that he is by both parents of noble birth, and that the yearly values of the said rectory, vicarage, and canonries and prebends do not exceed 10, 6 and 31 marks sterling, respectively, the pope hereby orders the above two to summon the said John and Denis and others concerned, and if they find the foregoing to be true, and the said rectory, which has cure of souls, and vicarage to be void in any ways, or the said rectory to be still void by the death of Bernard Yconcwar (? recte Yconcubar), to unite them to the said canonries and prebends of Kilfenora and Killaloe, respectively, for as long as the said Dermit shall hold the latter. To the priors of Holy Cross, Monaincha (de Insula viventium), and Lorrha (Fontis vini [sic] de Lochara), in the diocese of Killaloe (Laonien.), and the official of Killaloe. Mandate, as below. The pope has learned that the perpetual vicarage of the parish church of Aithenid (?) in the diocese of Killaloe has been so long void that by the Lateran statutes its collation has lapsed to the apostolic see, although Oddo Machkynayg, priest, has detained possession for between one and three years, without any title or right. At the recent petition of John Imera, clerk, of the said diocese (who was lately dispensed by papal authority on account of illegitimacy, as the son of a canon, warden of a monastery of the order of St. Augustine, in priest's orders, (fn. 8) and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, and who in virtue thereof has had himself made a clerk), the pope hereby orders the above three to summon the said Oddo and others concerned, erect a canonry in the church of Killaloe, and the said vicarage into the prebend thereof for the life of the said John, provided that the chapter consents, and to collate and assign such canonry and prebend, yearly value not exceeding 6 marks sterling, to the said John. The pope further dispenses him to receive and retain them, notwithstanding the said defect, etc. Ex iniuncto nobis. [6⅓ pp.]
