To John Ryder, rector of Stone in the diocese of Rochester. Dispensation to him—to whom the pope lately ordered provision to be made of the parish churches of Stone and Hakeney, in the dioceses of Rochester and London, dispensing him to hold them together for two years, on condition of meanwhile exchanging one of them for a compatible benefice, and if not of thereafter resigning Stone; whose recent petition contained that he obtained the said churches by virtue of the said provision, and that the end of the said period is at hand; who is a resident private chaplain (capellanus continuus commensalis) of Richard, bishop of London, and holds the said churches, value not exceeding 140 marks, and the canonries and prebends of Iseldon in London, St. Botolph in Lincoln, and Kayre in Llandaff, value not exceeding 20, 7 and 10 marks respectively; and to whom provision was lately [see above, p. 50] made by papal authority of the canonry and prebend of Taghmon (Theamen.) in Ferns (Ilernen.), value not exceeding 30 marks, of which he has not got possession—upon resigning, simply or for exchange, before the expiry of the said period, one of the said churches, to receive in its stead a dignity, provided that it be not major nor principal, and to hold it for three years together with the church retained. After having made provision to him of the said see, the pope granted him indult [above, p. 46] to continue to hold therewith, on account of its impoverishment by wars etc., for two years after his consecration or the lapse of the canonical period for consecration, his canonry and prebend of St. Botolph in Lincoln and parish church of Schyryngton in the diocese of Lincoln, value altogether not exceeding 40 marks; and after he had resigned the said canonry and prebend, the pope [above, p. 120] prolonged the said period by a further two years in respect of the said church. At his recent petition, containing that there is no hope of sufficiently recovering or bettering the fruits etc. of the episcopal mensa within ten years, the pope hereby prolongs the said second period of two years by a third. Mandate (at the petition of Dermit Micgillaruaid, canon of Elphin, containing that a moiety of the tithes and first fruits within the bounds of the parish churches of Fuaran, Dunymgan, Kyllbegnatha and Cluayncummaisg in the diocese of Elphin and a number of other rights belong by ancient custom to the capitular mensa, but that by the neglect of certain canons they have been for more than twenty years in the hands of a number of ecclesiatics and laymen, and are in danger of being perpetually alienated, and that Dermit proposes, if they be granted to him, to recover them at his own expense) to summon the said chapter, canons and detainers etc., and if he find the above to be true, to grant the said moiety and rights, value not exceeding 18 marks, to Dermit, to be held by him for life together with his canonry of Elphin and prebend called the rectory of Fydartha and Kyllcomnatha and the perpetual vicarage [not named] which is united to the said prebend, and with the perpetual vicarage of Kyllmacnagyn in the said diocese, of which he has not got possession; sufficient guarantee being given by him that after his death the said moiety and rights shall revert to the said mensa. To John Were, canon of Glasgow, bachelor of canon law. Decree etc., as below. At the beginning of his pontificate the pope ordered that all who accepted benefices by virtue of expectative graces should within a month after their acceptance cause provision to be made to them by the executors, and that within three more months they should publish such acceptances in their benefice; if not, the grace, acceptance and provision should be null [Ottenthal, Reg. Cane. Apost., No. 44 of the Reg. Mart. V, i.e. No. 41 of the Reg. Jo. XXIII]. Subsequently, on 6 Kal. Feb. anno 1 [1418, above, p. 101] the pope made provision to Were, appointing executors, of a canonry with reservation of a prebend and dignity etc. in Glasgow and of a benefice with or without cure in the gift of the bishop and the prior and chapter of St. Andrews. At his recent petition (containing that by virtue of the said letters he accepted within the lawful time the parish church of Fortevyot in the diocese of St. Andrews, then void, and caused provision to be made to himself thereof, and did not publish such acceptance and provision in the said church, although he obtained from a certain papal auditor a citation against a certain claimant to the said church; that he is of royal race, and that he has in presence of a notary public and witnesses abandoned the said suit on the ground of his having no right to the said church on account of the aforesaid) the pope hereby restores the said grace to the state in which it was before the said acceptance and provision, and decrees that he may, in virtue of the said letters, accept a prebend and dignity etc., and benefice, as above, and that the said executors may and shall make provision to him as if the said acceptance and provision had not taken place. To William Baret, priest, of the diocese of Ferns. Rehabilitation, at his recent petition containing that formerly the then bishop of Ferns created by his ordinary authority, for the life of a certain person, a canonry and prebend called Kilsconran, endowing them with the fruits etc. (which had hitherto belonged to the rector) of the parish church of Kilsconran in the diocese of Ferns, and that he reserved therefrom for a perpetual vicar too small a portion; that on the death of the said person the same bishop suppressed the said canonry and prebend and, the vicarage and vicar continuing to exist, erected by the said authority the said parish church into a rectory and instituted a rector therein; that on the voidance of the rectory by the death of John Aynesor, bishop Patrick, considering the smallness of the said portion, but making no change in regard to the said vicarage and rectory, nor expressly restoring the said church to its original condition, made collation and provision of the rectory to the above William, who was holding the vicarage, and who, without obtaining dispensation, continues to hold them both together. To the prior of St. Mary's, Deruach, in the diocese of Meath. Mandate as below. Lately Boniface IX—at the petition of the majority of the inhabitants of the country (patria) of Fercall (de Fearakyeall’) in the diocese of Meath, containing that by reason of the distance of their said country, six (cf. Cal. Lett. V, p. 314) English miles, as well as of wars etc., access to their parish church of St. David, Achanurcyr, in the said diocese, for divine offices and the sacraments, baptisms and burials, was very difficult, especially in the winter and rainy season; and that, if to the chapel of St. Colman, Lynnela (cf. ibid.), in the said country, were subjected the chapels, in the same country, of Rachayn, Kylleacy, Raliffen, Habuge (cf. ibid.), Drumculynd and Eglays, all daughter chapels of and annexed to St. David's, it would be fit for erection into a parish church; and that its fruits and those of the said other chapels were sufficient for a rector and a vicar, the latter to have the cure of the said inhabitants and to pay the episcopal and other dues—ordered the bishop of Termoli and the priors of Duruake and Seirkieran (de Sygro) in the dioceses of Meath and Ossory (cf. ibid. pp. 314 and 407), to separate from St. David's all the said chapels, to erect that of St. Colman into a parish church, to subject thereto the others as daughter chapels, notwithstanding that they had cure, to assign to it the said country as its parish, and to grant that St. Colman's, even if it or any other of the said chapels were of lay patronage, might have font, cemetery and other parochial insignia. At the recent petition of the said inhabitants (containing that Anthony, bishop of Termoli, proceeding alone, separated the said chapel of St. Colman and the others from St. David's, erected the chapel of St. Colman into a parish church, assigned to it the said chapels as daughter chapels and the said country as parish, and granted that it should have font etc.) the pope orders the above prior to summon the rector of St. David's and others concerned, and if he find that the statements of the inhabitants be true, and that the rector of St. David's can be maintained from the rest of the fruits of that church, and pay the episcopal dues etc., to confirm the separation, erection etc. made by the said bishop. Mandate to continue to obey as commendatary of their monastery Robert, bishop of St. Asaph, to whom, then abbot of Valle Crucis, the late Baldassar, bishop of Tusculum, then called John XXIII, to whose obedience those parts belonged, made provision of the said see [Cal. Lett. VI, p. 198], granting him the abbey for ten years in commendam, on the approach of the end of which period the present pope—in consideration of the fact that bishop Robert (who had already, whilst abbot, repaired the monastery on its destruction by fire) had during his commenda likewise in great measure repaired the church of St. Asaph, which had also been destroyed by fire, even to the walls, and that he desired to complete the restoration—has prolonged it by five years [above, p. 117]. CCXIII, f. 278] by papal authority, obtained the same by authority of the ordinary, without having obtained any other dispensation, even on account of his said illegitimacy, and detained it for more than a year, as he still does, without having himself ordained priest and without having obtained dispensation.
