To the bishop of Ciudad Rodrigo (Ciuitaten.), and the precentor and chancellor of Killaloe. Mandate to collate and assign to Cornelius Okynnedyd, clerk, of the diocese of Killaloe (who lately had papal dispensation, as the son of a deacon and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure), the rectory of Magdrim in the said diocese, of the patronage of a layman, value not exceeding 7 marks, to which, on its becoming void because the late William Mackassyn held it for more than a year without having himself ordained priest and without dispensation, he was presented by the patron, Walter Bremychcen, donsel, of the diocese of Tuam, and instituted by bishop Donatus, by his ordinary authority. He doubts whether the presentation and institution hold good. The collation is to be made whether the rectory became void as stated, or by the death of Cornelius Ykennedich, or otherwise. To Master Frederick Deys, papal chaplain and auditor. Mandate as below, at the recent petition of Donatus Olucharean, rector of Acheochaille in the diocese of Connor, containing that a cause arose between Denis Ochulean, dean of Armagh, and the late John Olucharean about the rectory of St. Patrick's, Dompnachmor, in the diocese of Armagh, the cure of souls of which is exercised by a perpetual vicar, on its voidance by the resignation of Thomas Oluchearean, John claiming that he had resignation of Thomas Oluchearean, John claiming that he had had provision of it by papal authority and had canonically obtained it, and Denis opposing the provision and preventing John's peaceable possession, claiming that the rectory lawfully belonged to him; that at John's instance the Council of Constance committed the cause, although not lawfully devolved to the apostolic see (corrected in margin from court), to Master Henry Fleckel, papal chaplain and auditor, who proceeded short of a conclusion; that the present pope committed the cause to the above Master Frederick, and that whilst it has been pending before him the said John, to whom, being in possession of the said rectory, the pope recently made provision of the see of Connor, has died before his consecration. The pope therefore orders the said auditor to surrogate Donatus (who is a priest, and who lately had papal dispensation, as the son of a priest and an unmarried woman, to be promoted etc. as above, f. 15, and who has been rehabilitated on account of having, after obtaining and resigning the rectory of Achalunga in the said diocese, obtained without further dispensation the rectory of Aregaldacherog in the same diocese, both by collation of the ordinary [see above, pp. 67, 68], and to whom the pope has ordered provision to be made of the above rectory of Acheocaille and the chancellorship of Armagh, a non-major dignity without cure, dispensing him to hold them) to whatever right was possessed by the said elect at the time of his death, and thereafter, if in the course of the suit he find that neither Denis nor Donatus has any right to St. Patrick's, to collate and assign it, value not exceeding 12 marks, to Donatus; notwithstanding that Donatus (whom the pope has dispensed to hold the said church of Acheochaylle with the said chancellorship for life, and to resign them, simply or for exchange, as often as he wishes) holds Acheochaille, value not exceeding 14 marks, and that he has lately had provision made to him of the said chancellorship, value not exceeding 8 marks, by virtue of the pope's said mandate of provision. He is hereby dispensed to hold together for life St. Patrick's and the said chancellorship, and to resign them, simply or for exchange, etc. Upon obtaining St. Patrick's under these presents, he is to resign Acheochaylle.
