Exemplification, omitting subscriptions etc., at the petition of William, bishop of Carlisle, of the letters Domus domini decora, which are beginning to be consumed with age, of Honorius III addressed to Ugo, bishop of Carlisle, and his successors, and dated at the Lateran per manum Magistri Guidonis capellani nostri, 6 Non. May, Indiction 12, in the year of the Incarnation 1223, anno 7. Pope Honorius, at bishop Ugo's prayer, and following in the footsteps of popes Innocent and Adrian, (i) confirms to the said bishop and his successors the bishopric of Carlisle and the diocese (Karleonen. episcopatum et parochiam), as the late Turstinus, archbishop of York, and the chapter of his church, with counsel of the late Henry, king of the English, defined it; (ii) ordains that in the city of Carlisle (Karleolen.), called of old Lugubalia, the episcopal see shall by perpetual right be in the church of St. Mary; (iii) adds that alike in holding synods, and in chapters, judgements and other ecclesiastical institutions, the same ecclesiastical customs shall be observed as prevail in other bishoprics of England in which is the regular observance; (iv) confirms to bishop Ugo and his successors, and through them to the church of Carlisle, the prebend which the said archbishop Turstinus granted to the church of Carlisle in the church of St. Peter, York; (v) confirms to bishop Ugo and his successors all present and future possessions and goods canonically held by the said church, with explicit mention of the church of Meleburn, and its lands, tithes, chapels and all its other appurtenances, the land of Barou upon Trent, 5s. daily by gift of the aforesaid king Henry, all lands, houses or other things in the said city or without which the said bishop Ugo possesses or shall in future be offered to him by kings of England or other faithful; (vi) confirms the ordinance of the possessions and rents of the church of Carlisle made by G[uala], cardinal priest of St. Martin's, then papal legate, and the divisions thereof made, with assent of the parties and accepted by both parties, and formerly confirmed by the apostolic see, between bishop Ugo and the prior and convent of Carlisle, by the abbot of Holmcoltran and the prior of Haugusteldesham by authority of P[andulph, now] bishop, then [bishop] elect, of Norwich and papal legate, who had received special mandate from pope Honorius in the matter, and moreover by the dean, T. a canon, A. official of Carlisle, Master G. de Louthre, and T. son of John, sheriff of Carlisle, co-opted for the purpose by the four aforesaid. Pope Honorius adds that on the death of bishop Ugo, no one shall be appointed to the see surreptitiously or by violence, but he whom the brethren of the said church by common consent, or the sounder part of the brethren, shall elect, and his letter ends with the usual clauses: Si qua igitur … Cunctis autem … Amen. Ex apostolice sedis prouidencia, not only contains a number of slight verbal differences from the text of the letter of Honorius as registered in Reg. Vat. Indult at their recent petition (containing that the late John, bishop of Norwich, founded the said chapel for four chaplains, who should be bound to celebrate daily, the principal chaplain the mass of the said Saint, and the other three chaplains masses for the faithful departed; adding that the devotion of the faithful towards the masses thus reiterated and of the chaplains themselves is dying away, and that the said chaplains cannot well be maintained from the resources of the said chapel; and petitioning for licence to celebrate other masses—that in the said chapel the said principal chaplain shall be bound to celebrate one mass of the said Saint weekly and the said three chaplains another mass every day for the faithful departed, provided that the said principal and other chaplains shall daily celebrate other masses according to the calendar (secundum decursum temporis) and their devotion, with a memorial of the said Saint and faithful. John XXIII dispensed him to hold for ten years with his vicarage of Croprydi any other benefice with cure or otherwise incompatible, even if it were of the patronage of laymen, or were a parish church etc., and to resign both, as often as he pleased, simply or for exchange [Cal. Lett. VI, p. 306]. The present pope, at his petition (containing that he had successively held with the said vicarage of Cropry, and resigned, in virtue of the said dispensation, the parish church of Thernynghe, that of Helmyngh[a]m, in the diocese of Norwich, and the archdeaconry of Stafford, and was then holding with the vicarage of Cropry, likewise in virtue of the said dispensation, the treasurership of Lichfield, a non-major dignity with cure, to which are annexed the canonry and prebend of Sallods (sic) in Lichfield, and that the end of the said ten years was at hand) prolonged the said ten years by five more [above, p. 199]. At the recent petition of Thomas— who is also M.A., has studied theology for ten years at Oxford, and holds canonries and prebends in knosall’ and St. John Baptist's in Stoke, in the dioceses of Lincoln (rectius Lichfield) and Norwich, value with the said treasurership and its annexed canonry and prebend and the said vicarage of Cropry, not exceeding 300 marks—containing that the end of the said period of five years is also at hand, the pope hereby prolongs it by other two. To Philip Macinfilud, canon of Tuam. Mandate as below. The recent petition of Raymond (Remundus) Bremycheam, provost of Tuam, contained that formerly, after the exchange of divers words of contumely between him and Nymeas Oruori, clerk, of the diocese of Tuam, he laid violent hands on Nymeas, but short of the effusion of blood, and that, betaking himself in person to the apostolic see, from the sentence of excommunication which he had incurred he obtained absolution from Master Panthaleo de Breda, doctor of canon law, papal chaplain, auditor of causes of the papal camera, and, relying on the said absolution, obtained, by authority of papal letters, with papal dispensation in regard to holding them together in perpetuity [see above, pp. 160, 161], collation of the provostship of Tuam, a non-major non-elective dignity without cure, then void in a certain way, and the rectory of Dunmor in the said diocese, then void by the death of James Hachyt, William Bremicheam, priest, of the said diocese, being removed from his unlawful possession of the said rectory; that the said William promised by oath not to molest Raymond in respect of the said rectory, but that he subsequently, falsely asserting that Raymond was, at the times of the impetration made by him and of the collation made to him of the said rectory, and still remained, under the said sentence of excommunication, claimed the rectory and Raymond's removal, and brought him before Cornelius, abbot of Knockmoy (Collis victorie) in the said diocese (sub-commissioner appointed by the above Nymeas, the judge specially deputed in the case by the apostolic see), who gave an unjust sentence in favour of William and against Raymond; that subsequently Raymond and William, in order to bring the suit to a more rapid conclusion, and to save trouble and expense, chose as judges and arbitrators Magonius Othedura, an Augustinian friar, John Ranny, a Friar Minor, and others, and promised under oath and a money penalty to abide by their judgement; that before the said judges William repeated the above argument of the invalidity of the said impetration and collation, to which Raymond replied that at the dates thereof he had been absolved, producing the letters of absolution of the said Panthaleo with his seal attached as auditor of the said court; but that the said judges, asserting that, whereas lawful proof was forthcoming of the said sentence, there was a doubt as to the power of the said auditor to grant such absolution, and that the said seal was unknown to them, gave a definitive and unjust sentence against Raymond. At the said petition of Raymond, adding that on account of his said oath he is prevented from prosecuting his right to the rectory, the pope orders the above canon to summon the said William and others concerned, and if the facts be as stated, to declare that the said auditor's absolution was and is lawful, to relax Raymond's said oath and the money penalty, · to restore him to the position in which he was therebefore, and to hear and decide the cause without appeal. The recent petition of the perpetual chaplains in the church of St. Mary, Sowthwel, in the diocese of York, living therein in common, contained that each and all of them, on account of their perpetual benefices called chantries in the said church, are deemed to be bound, in accordance with the original institutions and endowments thereof, to celebrate mass daily and be present at all the canonical hours by night and day, and that the custom has been further introduced and observed, subsequent to the said institutions and endowments, that they do not perform or accept annual offices and services (obscquia) in the said church, so that the fruits etc. of the said benefices being very slight, they lack the means of maintenance and supporting their burdens. At the said petition (which added that if it were specially granted to them to be able to accept and perform the said offices and services, a number of the faithful would from time to time give them obventions and emoluments for such performance), the pope orders the above treasurer, if he find that the said means are insufficient for the maintenance of the said chaplains, to grant that they may perform the said offices and services, and receive such obventions and emoluments. The recent petition of Carbricus Y[f]ergail, priest, of the diocese of Ardagh, contained that after he had received papal dispensation, as the son of an unmarried man and an unmarried woman, nobles, related in the fourth and fourth degrees of kindred, to be promoted to all, even holy orders and hold a benefice even with cure, and in virtue thereof had been so promoted and had obtained the perpetual vicarage of Theachsynacha in the said diocese, he, on the voidance of the perpetual vicarage of Killfyelan in the said diocese by the resignation of Richard Ofergail, having resigned the said vicarage of Theac[h]synacha, but without obtaining further dispensation, was presented by the patron of Killifyelan (sic), Joan, Cistercian prioress of St. Mary's, Lochsidi, in the diocese of Meath, to [Bernard, as in the following letter], official of Ardagh, deputed [in spirituals and temporals, as ibid.] by the chapter during voidance of the see, and, after paying the said official a sum of money, was instituted by the same, obtaining possession in virtue of the said presentation and institution. Mandate, at the recent petition of John Aldam, perpetual vicar of Southwyk in the diocese of Lincoln—containing that Henry, archbishop of Canterbury. learning in the course of a metropolitical visitation of the city and diocese of Lincoln that the fruits etc. of the said vicarage were insufficient for the support of the vicar, summoned and obtained the consent of the Augustinian prior and convent of Huntingdon, to which the said church is united, and ordained by his metropolitical authority that the vicar should receive from the fruits etc. of the church 6 marks of English money a year in addition to the portion already assigned, to be paid by the prior and convent at Michaelmas, Christmas, Lady Day and the Nativity of St. John Baptist, and should have the manse (mansum) formerly assigned to the said church with its garden and lands, and that the prior and convent should bear the burdens ordinary and extraordinary; and that in the event of their failing to pay on any of the said feasts, the fruits etc. of the said church belonging to them should after a week be sequestrated—after inquiry, to confirm the said ordinance, and to compel its execution.
