To Rory Macgilladuilih (rectius Macgilladuibh), perpetual vicar of Killaglaissi in the diocese of Killala. Grant as below. Martin V, being informed by the said Rory that Cormac Oduba, then holding the said vicarage, had been guilty of dilapidation, simony, perjury and non-residence, ordered certain judges, if Rory would accuse Cormac before them, to summon Cormac and others concerned, and if they found the above or enough thereof to be true, to deprive Cormac, and in that event to collate and assign the said vicarage, whether void by such deprivation or in any other way, to Rory [above, p. 102]. At Rory's recent petition, containing that it is asserted that the vicarage became and is void otherwise than as above, and that he fears lest the said letters may be held surreptitious because they stated that the value did not exceed 6 marks, whereas it is greater, but not more than 8 marks, the pope grants that the said letters, which have been fully executed, and in virtue of the proceedings arising wherefrom he has obtained the vicarage, shall hold good from the present date, even if the vicarage be void by the free resignation of the said Cormac, made to and admitted by bishop Fergallus by his ordinary authority, or in any other way, and as if the value had been correctly stated.Vite etc. (An. and Ja. To the abbot of Holy Trinity, Ballintober (de Fonte Sancti Patricii), in the diocese of Tuam. Mandate, at the recent petition of Philip Macinsile, perpetual vicar of the Holy Apostles, Kilmeadayn, in the diocese of Tuam, containing that the late John, archbishop of Tuam, on account of the insufficiency of the fruits etc. of the said parish church and that of St. Brandan in the said diocese, upon the voidance of the vicarage of St. Brandan's, belonging to the gift of the archbishop for the time being, united, with consent of the chapter of Tuam, the said vicarage of St. Brandan's to that of Kilmeadayn, value not exceeding 2 and 3 marks respectively, so that they should be served by one vicar, and that the parishioners of St. Brandan's should, as far as convenient for them, be bound to go for the sacraments etc. to the church of Kilmeadayn; and that John, the present archbishop, has in the course of a visitation ratified and confirmed the said union, which has taken effect. Prolongation by three years of the not yet expired two years during which Martin V dispensed him, who is a licentiate of canon law by examination and is studying at Rome (in Urbe), to hold with the said church any benefice with cure or otherwise incompatible, after which he obtained the parish church of Phillack (Sancte Felicitatis) in the said diocese, which he still holds with Calstok, value not exceeding 36l. and 28l. sterling respectively. Rehabilitation, at his recent petition, containing that after he had been dispensed by papal authority, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders, and hold a benefice even with cure, and had obtained the perpetual vicarage of Fynath in the diocese of Killaloe, he resigned it and, without other dispensation, obtained, and has detained for more than two years under pretext of a collation and provision made to him by bishop Thady, by his ordinary authority, the perpetual vicarage of Thomfyndlocha in the same diocese, on its voidance by the death of Odo Meccamara. Mandate, at the recent petition of John Hay, rector of Hampreston in the diocese of Salisbury—containing that the bodies of its parishioners are by ancient custom buried in the collegiate church of Wymborne Meynster, called a free chapel, but that, on account of the distance of the said parish church from the said collegiate church, two English miles, sometimes, especially in winter, during floods, the said bodies are not buried within four days and more; and adding that if the said bodies were buried in the said parish church or its cemetery it would be a great relief to the said parishioners—if he find the facts to be so, and after the said parishioners have made a fitting compensation to the said collegiate church, to grant to the said rector and parishioners licence to have the said parish church and its cemetery consecrated by a catholic bishop, and to have buried in them the bodies of all the said parishioners. Declaration, at the recent petition of Adam Moleyns, rector of the parish church of Kemsei in the diocese of Worcester—containing that formerly, whilst the regular church of Worcester, of the order of St. Benedict, was secular and was governed by a secular chapter and by canons, the said parish church was canonically united, annexed and incorporated to one of the prebends of the said church of Worcester, and that although the said parish church, whose cure is exercised by a perpetual vicar, a secular clerk, after the said union etc. was and is ruled, as if by a secular canon, like a prebend of the said church of Worcester (et licet ipsa parochialis ecclesia, cuius curaanimarum, post unionemprefatas, tanquam prebenda ipsius ecclesie Wigornien. velud per secularem canonicum recta fuerat prout eciam regitur de presenti …) it is doubted by some whether the holder of the said parish church can hold with it a benefice with cure or a dignity, personatus or office without papal dispensation—that the rectory of the said parish church so far assumed the nature of a prebend (adeo naturam prebende sortitam fuisse et esse), by reason of the said union etc., that it may be held, without any papal dispensation, together with any benefice with cure or dignity, personatus or office. To John Preen, priest, of the diocese of Armagh, I.U.B. Rehabilitation, at his recent petition, containing that (after Martin V had dispensed him to hold with his perpetual vicarage of Tremonfegyn in the diocese of Armagh any benefice with cure or otherwise incompatible for two years, and after provision had been made to him by papal authority of the perpetual vicarage of Drogheda in the said diocese, previously reserved to the apostolic see, and the said two years had been prolonged by the said authority by other four) he (who had meanwhile obtained the said vicarage of Drogheda in virtue of the said provision, and had held it and that of Tremonfegyn together for some time) and Nicholas Alisander resigned respectively to archbishop John the said vicarage of Drogheda and the archdeaconry of Armagh, a non-major dignity with cure, for purpose of exchange, which the said archbishop carried out by his ordinary authority, in virtue of which the said John obtained the said archdeaconry, and, wrongly believing himself to have been sufficiently dispensed by papal authority, has held together for some time the said archdeaconry and vicarage of Tremonfegyn, taking their fruits for about three years.
