To the archbishop of Cashel and the bishop of Ardfert. Mandate as below. The recent petition of Thomas Macimochuna, archdeacon of Limerick, contained that although he formerly canonically obtained and was in possession of the said archdeaconry, Philip de Geraldinis, clerk, of the diocese of Limerick, alleging that it belonged to him, caused him to be summoned before Jordan, bishop of Cork and Cloyne (Cluanen., rectius Clonen.), who was commissioned for the purpose by Thomas, bishop of Emly, the executor of papal letters obtained by Philip in the matter of provision being made to him; and that, after bishop Jordan had given an unjust definitive sentence adjudging the archdeaconry to Philip and imposing perpetual silence on Thomas, and after Thomas had thought good to appeal to the apostolic see, the said Philip, making no mention of the said sentence and appeal, got his cause against Thomas committed by the present pope to Master John de Cameraco, a papal chaplain and auditor, upon whose death, after proceeding short of a conclusion, the pope gave commission to Master Berardus de Narnia, who has proceeded short of a conclusion. At the said petition, adding that it is very hard for him to litigate in the Roman court from such remote parts, on account of divers costs usual in such causes, the pope hereby calls up to himself the said causes and orders the above archbishop and bishop, seeing that Thomas, on account of his fear of Philip's power, has no hope of obtaining justice in the city or diocese of Limerick, to summon Philip, and take up the said causes as they remained before the said auditor Berardus, and hear and decide them. Exemplification from the register of John XXIII of the letters Vite ac morum, addressed to the bishops of Bangor and Limerick and Robert Okaellagy, canon of Killaloe, dated at Constance, Id. Dec. anno 5 [1414, Cal. Lett. VI, p. 480, with spelling ‘Omydyr‘], whereby that pope ordered them to collate and assign to Thady Omigyr, clerk, of the diocese of Killaloe (who had been dispensed by papal authority, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice with cure) the rectory of Dru[m] cleyb in the said diocese, without cure and value not exceeding 3 marks, void by the death of Maurice Ograda, notwithstanding that he had lately ordered provision to be made to Thady of the perpetual vicarage of the same church, value not exceeding 7 marks; at the same time dispensing him, on account of the said defect etc., to hold the said rectory. Martin V dispensed him to hold for seven years with his parish church of Cheyham in the diocese of Winchester one other benefice with cure or otherwise incompatible, even if another parish church or a dignity etc., and resign them, simply or for exchange, as often as he pleased; and the present pope dispensed him (who asserted that he had resigned Cheyham and the parish church of Bedrington in the said diocese [of Winchester], which he had obtained during the said seven years, and that he was holding the parish churches of Aldington and Hamylden in the dioceses of Canterbury and Lincoln) even after the lapse of the said seven years to hold the said two churches or any two benefices with cure or otherwise incompatible, and to do so for life, and resign them, simply or for exchange, as often as he pleased. At his recent petition, containing that at the date of the pope's said letters he was not holding Hymylden, but that, having a short time before resigned it, he was holding in its stead the archdeaconry of Est Ridding in York, a non-major dignity with cure, value not exceeding 200 marks, of which no mention was made in the said letters, the pope grants to him, who is still holding Aldyngton and the said archdeaconry and a canonry of Stok in the diocese of Norwich with the prebend called of the fourth stall on the left side of the choir, that the said letters shall hold good from the present date as if the said mention had been made.
