To Edmund Awsteyn, archdeacon of Kildare, B.C.L. Collation and provision to him, a priest, of the said still void archdeaconry, a non-major non-elective dignity with cure, value not exceeding 20 marks sterling, which became void and ipso facto reserved by the present pope's promotion [above, p. 358] of William, bishop of Kildare to that see, and by his consecration, performed by the pope's order without the Roman court, in ignorance, perhaps, of which the said bishop, as Edmund's recent petition contained, made collation and provision of the said archdeaconry to Edmund (who had been dispensed by papal authority, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold any compatible benefices of any number and kind, with or without cure, even if canonries and prebends, dignities etc., and to resign them, simply or for exchange, as often as he pleased), under pretext of which null collation and provision he, likewise ignorant, obtained possession and still detains it; whether it became void as above, or by the resignation of Patrick Fi[t]z Gerard without the Roman court, or in any other way. He is hereby specially dispensed, notwithstanding the said defect etc., to hold the archdeaconry, upon obtaining which he is to resign the vicarage. Dignum etc. (An. and Pizolpassus. | An. xxxvi. Mandate, the pope having been informed by Thomas Odruffthyn, canon of the Premonstratensian monastery of St. John Baptist (Cella parva), immediately belonging to the Roman church, in the diocese of Annadown, that Patrick, abbot of the Augustinian monastery of St. Mary, Ferns, has dilapidated goods thereof, is a notorious fornicator, and is involved (irretitus) in divers other crimes [not here named], if Thomas (who has made an express profession of his said [Premonstratensian] order, and who lately, when a secular, was dispensed by authority of the ordinary, as the son of an abbot of the said order of St. Augustine and an unmarried woman, to be promoted to minor orders and hold a benefice without cure, and who, from fear of the said Patrick's power, has no hope of obtaining justice in the city or diocese of Ferns) will accuse Patrick before them, to summon Patrick and others concerned, and if they find the above or enough thereof to be true, to deprive Patrick, and in that event, and if they find Thomas fit, to make provision to him of St. Mary's, value not exceeding 16 marks sterling, whether it become void by such deprivation, or be void by the death of Nicholas Ydruffthyn, or in any other way. To the abbot of St. Mary's, Novan, in the diocese of Meath. Mandate, at the recent petition of Edmund Portter, canon of the Augustinian monastery of St. Mary the Virgin, Trym, in the diocese of Meath—containing that on the voidance of St. Mary's by the resignation to bishop William of William Scorlag, [now] a canon, sometime abbot, the convent unanimously elected the said Edmund, who was expressly professed of the said order and in priest's orders, and who consented to the election and sought to have it confirmed by the said bishop, who unjustly refused, wherefore Edmund appealed to the apostolic see; and that John Acton, a canon of St. Mary's, obtained de facto provision by authority of the metropolitan, and under pretext thereof, being also supported by lay power, obtained possession of the administration, and has unduly detained possession of St. Mary's for more than a year—to summon the said John and others concerned, hear and decide the said appeal and the principal matter, and if he find that the said election was canonical, to approve and confirm it, if and after he find the said provision null, and if he find Edmund fit, to make provision to him of St. Mary's, value not exceeding 50 marks sterling, removing John and any other unlawful detainer. The abbot is also to grant that Edmund may be blessed by any catholic bishop, who shall receive and send to the pope his oath of fealty, as usual, without prejudice to the bishop of Meath, to whom St. Mary's is by ordinary right subject. Martin V granted in commendam to Griffin, bishop of Ross, during the pleasure of the apostolic see, the Cistercian monastery of St. Mary, le Thoronet (de Floregia alias de Taroneto), in the diocese of Fréjus, on its voidance by the death of abbot John at the apostolic see and its ipso facto reservation [above, p. 182]; and the said bishop having this day resigned to the pope the said commenda by his proctor John Ynisny, (fn. 5) a canon of Dol, and the said monastery, value not exceeding 300l. of petits tournois, being still void, as above, and reserved to the present pope (Martin V having died without otherwise disposing of the provision), the pope hereby orders the above bishop to make provision thereof to Anthony Roscagni (or Rostagni), archdeacon of the Augustinian church of Sénez (Senescen.), who has expressly professed that order. He is to grant that Anthony may be blessed by any catholic bishop, and if he be blessed by a bishop other than the bishop of Fréjus, no prejudice shall derive to that bishop, to whom St. Mary's is by ordinary right subject. Anthony is to wear the habit worn in St. Mary's and is to resign the said archdeaconry. Solicite considerationis. (An. and Franchomme. | An. l. de Adria.) [See also above, pp. 489, 647.]
