Lett.VII, p. 567] alias Wygenhale, priest, of the diocese of Norwich, doctor of canon law, Rehabilitation, at his recent petition containing that he formerly, when holding the perpetual vicarage of Holy Trinity, Cambridge, in the diocese of Ely, obtained and held therewith without dispensation for more than a year against Exccrabilis the parish church of Yaxham in the diocese of Norwich, the latter of which he still holds; that, having resigned the said vicarage, he obtained in its stead by authority of the ordinary the rectory of Retyngden in the diocese of London, void by resignation to the ordinary of John Northon, and is holding it together with Yaxham, taking however the fruits of the latter only, relying on a papal dispensation which was recently granted to him [see ibid.] to hold for life with Yaxham any other benefice with cure or otherwise incompatible, and to resign both, simply or for exchange, the said dispensation making no mention, however, of the said vicarage, which he was then detaining. He is to resign both Yaxham and Retyngden, the pope granting that the said dispensation shall hold good from the date of these presents, as if it had contained mention of the said vicarage. Mandate, at the recent petition of Charles Ogara, canon of Elphin—containing that certain lands, called townlands, namely one whole townland of Cailli and another half townland of Ardnucanlaighin (quedam terre videlicet una integra de C. et alia media de A. villatecolonu’ nuncupate) in the parish of Drumcliab, in the said (sic) diocese [of Elphin], belonging to the church of Elphin, wont to be granted in fee or on lease by the bishops of Elphin for a fixed yearly cess, sometimes to clerks, sometimes to laymen, for them and their heirs have, without any such grant by the said bishops, but rather by usurpation, been long unduly detained, as they are at present, to wit the said whole and the said half townlands (villate nuncupate) respectively by Bernard Oconchubair, lord of the cantred of Cairbri, layman, of the said diocese, who disposes of the said whole townland as if it were of his demesne, granting it to laymen, and the said half townland by Philip Odubagan, also a layman, of the said diocese, and by his progenitors; and that bishop John, in order to avoid probable persecutions by the said Bernard, whose power he fears, and also through his negligence, takes no action to dispose of the said lands or to attempt their recovery; and adding that if the said lands were granted on the above terms to Charles and his heirs in perpetuity he could recover them for the said church—to summon the said bishop and laymen and others concerned, and if he find the facts to be as stated, and if he find expedient, to make the desired grant in perpetuity to Charles and his heirs on the said customary terms, removing the said laymen and any other detainers. VII, p. 106], learning that the said rectory, of the patronage of laymen, had been so long void by the death of Hubert (Hobertus) de Burgo that its collation had lapsed to the apostolic see, ordered the dean of Tuam and two others to collate and assign it to Donatus, at the same time dispensing him (who had been dispensed by papal authority, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders, and hold a benefice even with cure and the canonry and prebend of Kylltescynd in Clonfert, provision of which the pope had ordered to be made to him) to hold, notwithstanding his said illegitimacy, the said rectory. At his recent petition, containing that William Rany, dean of Tuam, proceeding alone, made collation and provision to him of the said rectory, but that some doubt the validity of the said letters and collation and provision, in virtue of which he obtained possession, the pope hereby grants to him, who holds the said canonry and prebend, value not exceeding 10 marks, that the said letters and collation etc. shall hold good from the present date, even if the said rectory, value not exceeding 12 marks, became void as stated or in any other way. provided that its collation has lapsed to the apostolic see. Recently [above, f. 192] the pope dispensed him, asserting himself to be of great noble race, to hold for life the said church and any other benefice with cure or otherwise incompatible, and to resign them, simply or for exchange. At his recent petition, containing that he is not of great noble race, and that he therefore fears lest the said dispensation may be held surreptitious, the pope hereby grants that it shall hold good from the present date, as if it stated that he was of noble race only, and not of great noble race. To Edward Prentis, precentor of Salisbury, B.C.L. Prolongation as below. John XXIII dispensed him to hold for seven years with the archdeaconry of Essex in London, which is a dignity, any other benefice etc. as above, f. 4d; and the present pope, upon Edward's setting forth that, having resigned the said archdeaconry, he was holding the above precentorship, which is a non-major dignity with cure, and the parish church of Stokenham in the diocese of Exeter, and that the end of the said period was at hand, prolonged it by three years [Cal. Lett. VII, p. 260]; and subsequently, upon Edward's stating that he had resigned Stokenham and had obtained Byschopyshamton in the diocese of Worcester, the pope prolonged the said three years by five. The pope now, at the petition of Edward, who holds, besides the said precentorship and church, a canonry of Salisbury and the prebend of Durneford and a canonry of the church of the town of Warwick (opidi Warwici) in the diocese of Worcester and a prebend therein, value not exceeding 120 marks, 46 marks, 44l. and 10l. respectively, prolongs the said five years by seven. To Laurence, elect of Elphin. Grant as below. The pope recently made provision to him of the said see, as void by the death of Thomas. At the recent petition of Laurence (who is a priest and a bachelor of canon law, and who received, before the said provision, dispensation, as the son of a married man and an unmarried woman, to be promoted to all, even holy orders and, inter alia, to be promoted to any episcopal dignities), containing that some assert that the see became void, not as above, but by the deprivation, made by papal authority, of John, bishop [in ecclesia universali], formerly [bishop] of Elphin, and is still void) the pope grants that the said provision shall hold good from the present date, even if the said church be void by the said deprivation, or by the deprivation of Robert, also bishop, sometime [bishop] of Elphin, made by the same authority, or be void in any other way, and for whatsoever cause the provision belongs to the apostolic see. To the abbots of Meaux (Melsa) and Rivaulx (de Ryevalle) and the prior of Powmfreyt, in the diocese of York. Mandate as below. The recent petition of the master and brethren of the poor hospital of St. Leonard alias of St. Peter, York (which is of no order, and was founded by king William II for the reception and sustentation of poor and miserable persons, and in order that masses and other divine offices might be celebrated therein by brethren living in common) contained that formerly the brethren, considering that many of them and of their predecessors had been wont to wear diverse and costly clothing, agreed that they and their successors should wear a linen rochet with a white woollen tunic and a cappa and hood (cum … capucio) of a black colour after the manner of canons regular of the order of St. Augustine, and caps (eciam cum biretis) within and without the hospital, and that on double feasts, when present at the said offices, they should wear linen surplices and almuces lined (cum almuciis furratis sius linitis), as they have now done for more than forty years. The pope orders the above three, if they find the facts to be as stated, to decree that the present and future master and brethren may and shall publicly continue to wear the said habit.
