To the abbots of Winchcomb, Gloucester and Hayles, in the diocese of Worcester. Mandate as below. The recent petition of all the inhabitants of the town of Cow Honeybourne (villa de Honybornia Wynchecomben.) in the diocese of Worcester contained that up to twenty-six years ago they used to go in numerous procession, one from each of their houses, every year on Whitsun Tuesday, to the Benedictine monastery of Evesham, with cross erect and banners, and make an offering of a farthing for each house; but that, inasmuch as between them and other tenants of the abbot and convent who also repaired thither from neighbouring places in like procession, there frequently arose on the way, for the honour of taking the lead, which on the ground of antiquity belonged to the said inhabitants, grave riots and mutilations or homicides, they, in order to avoid such riots etc. in future, have for the said space of twenty-six years and more ceased to go in procession, continuing, however, to pay the said farthing on the said Tuesday yearly. At the petition of the said inhabitants (who allege that the said town is about three miles distant from the said monastery, and that the said tenants, who are very numerous, trusting in the favour of the said abbot and convent, as their lords, do not fear to erect the horns of elation against the said inhabitants; and supplicating for a remedy in order to protect them in future from such evils and dangers) the pope orders the above abbots, if they find the facts to be as stated, to grant to the said inhabitants that in future and for ever they shall not be bound to go in procession to the said monastery, provided that they pay the said farthing, as above, on every Whitsun Tuesday. The pope's intention is that the present letters shall not extend to oblations made to other churches or chapels, present or future, within the said bounds, which do not depend on the said church or college. Mandate (the pope having learned from the recent complaint of king Henry and many others that to the Benedictine monastery of St. Peter, Westminster, without the walls of London, and its church, and to the collegiate church of St. Martin le Grand, London, and their houses and bounds, as also to the town of Culneham, belonging to the Benedictine monastery of Abyndon in the diocese of Salisbury, and to a number of other places in the realm, there flee many clerks and laymen, traitors, murderers, robbers, incendiaries etc. and debtors, and there, thanks to certain privileges etc. granted to the said monasteries, churches and places by popes and kings, escape the punishment of their evildeeds and the satisfaction of their debts, to the supplanting of justice and the detestable example of others, live there for a long time, even with unhonest women, not without scandal and corruption of the religious and other honest men who dwell therein, and, under pretext of the said privileges etc., cannot be taken, whence for a long time great inconveniences etc. have arisen, which increase daily), at the said king's petition for a remedy, to summon those concerned, make inquiry etc., and reform all abuses of the said privileges etc., for the better carrying out of which they have faculty hereby to compel all the heads and inmates of such monasteries etc. to exhibit to them their said privileges etc. Ex debito pastoralis. Mandate, at the recent petition of James Langtone, canon of Lichfield, and John Hygate, priest, of the diocese of Coventry and Lichfield,—containing that formerly Richard Archer, esquire (armiger), Roger the elder and Roger the younger, called Clerk, and certain other inhabitants of the town of Stotfold in the said diocese, falsely alleged that the said John, by reason of the canonry and prebend of Stotfold in Lichfield, to which prebend is united the chapel of the said town (falsely alleged by the said Richard etc. to be a parish church), and which he was then holding, was bound to appoint at his own expense a priest or chaplain resident in the said chapel to celebrate certain masses and other divine offices and administer sacraments and sacramentals to the parishioners of the said town; that they brought the said John before the auditor-general of the court of causes of Henry, archbishop of Canterbury, with a view to obtain a declaration that the canon who for the time being held the said prebend was so bound; that William Wytham, clerk, to whom the said archbishop committed the cause after the said auditor had taken some proceedings, gave an unjust definitive sentence against the said John, condemning him also in costs, from which sentence he appealed to the apostolic see; and that meanwhile the above James has obtained and at present holds the said canonry and prebend—to summon the said Richard etc. and others concerned, proceed in the said appeal cause, and confirm or infirm the said sentence, without appeal.
