Mandate—the pope having been informed by Matthew Ogriffa, perpetual vicar of Disyrt Malacala in the diocese of Killaloe, that Thady Omigyr, rector of the rectory of ecclesiastical fee in the parish church of Derumcleyb in the said diocese, has alienated and dilapidated goods of the said rectory, committed simony and perjury, is defamed of homicide and held guilty of several other crimes [not here specified]—to summon Thady, who is a priest, and others concerned, and if they find Matthew fit, and after he (who is a subdeacon, and who lately, being then a clerk, was dispensed by papal authority, as the son of a priest and an unmarried woman, to be promoted to all other, even holy ordors and receive and hold the said vicarage in the event of its being collated to him by vigour of a mandate of provision by the present pope, after which dispensation he had himself promoted to all other minor orders and to that of subdeacon) has accused Thady etc. before them as usual, (fn. 2) to deprive Thady, and in that event to collate and assign the said rectory, without cure and value not exceeding 5 marks sterling, to Matthew; notwithstanding that he holds the said vicarage, value not exceeding 10 marks. Grant that the letters (by which the present pope lately [above, p. 62] dispensed him to hold for life with the said church any benefice with cure or otherwise incompatible, even if a parish church [or a perpetual vicarage] or a dignity etc., and to resign them, simply or for exchange, as often as he pleased) and their consequences shall hold good, notwithstanding that the said letters, (after which he obtained, and has held for some time with Peesmere, the parish church of St. Mary the Virgin, Wallingford, in the same diocese) stated that he was of noble birth, whereas, although his father was a man of great honesty and had a competent patrimony, it is not the custom in England to reckon of noble birth those who are not of knightly race, which he is not (fn. 3); and that he may retain the said two churches of Peesmere and St. Mary, value not exceeding 30 and 20 marks sterling respectively, as if in the said letters no mention of such nobility had been made. The recent petition of Eugenius Ytroighith alias Waithne, priest, of the diocese of Killaloe, contained that after Martin V had reserved to himself and his successors the absolution from all sentences etc. incurred by simonry he, to whom provision had been made by authority of the ordinary of the perpetual vicarage of Birra in the said diocese, gave up for a sum of money to a certain priest all right therein or thereto, without having had possession of the vicarage, thereby incurring the said sentences etc.; and that subsequently upon the voidance, by the death without the Roman court of Donatus Odiuluy, of the perpetual vicarage of Roscumruadh in the same diocese, James, [now] bishop in the universal church, then of Killaloe, perhaps ignorant of the said incurring (incursus), made provision thereof to the said Eugenius, who was bound by the said sentences etc., under pretext of which collation and provision he obtained the said vicarage of Roscumruadh and is still in possession. The pope therefore orders the above to absolve Eugenius from the said sentences etc., enjoining penance, dispense him on account of irregularity, and rehabilitate him. Lately, upon its being set forth to the present pope by all the parishioners of the parish church of Ilferdecombe in the diocese of Exeter that they had built in the cemetery of the said church a chapel in honour and under the name of St. Mary the Virgin de Thorn, wherein the Most High worked many miracles by the merits of the said Virgin, wherefore many oblations and alms were offered there, and that they feared lest the said alms etc. should be converted to his own uses by the rector of the said church (who, it was added, could be becomingly maintained from the fruits etc. of the said church, value about 100 marks sterling a year) the pope, thus circumvented, granted that a fourth part of all the said oblations and alms, and also of all legacies and donations etc. pertaining to the said chapel, might be converted to its fabric and ornaments, provided that the parishioners contributed a like amount, and inhibited the rector of the said church to ask or take any of the said oblations etc., or interfere therewith, as is more fully contained in a certain petition signed by the pope or by his order. At the recent petition of John Morton, rector of the said church, containing that the above addition is not true and that the said grant is greatly and manifestly prejudicial to the said church and rector, and that dissensions and scandals will probably arise, the pope hereby orders the above to summon the said parishioners and others concerned, and if they find the said rector's statement true, to annul the said grant and any papal letters about it which they may find, and its consequences, etc. Intentus semper salutis operibus. His recent petition contained that Martin V ordered the bishop of Kilmacduagh to collate and assign to him, then holding the archdeaconry of Killaloe, a non-major dignity with cure, the rectory, of lay patronage, of Cunky alias Okassyn in the diocese of Killaloe, void by the death without the Roman court of Nicholas Mac[c]onmara, the said pope dispensing him to hold both for life, after which the late John, bishop of Kilmacduagh made to him collation and provision of the said rectory. At his said petition, adding that he is the son of unmarried parents related in the double fourth degree of kindred, and that he had been dispensed by papal authority to be promoted to all, even holy orders and hold the said archdeaconry, of which there is no mention in the said mandate, and that under pretext thereof and of the said collation and provision he obtained the said rectory and has held it and the said archdeaconry together for several years, the pope hereby rehabilitates him, requiring him to resign both. To the abbot of St. Mary's, Asdara, in the diocese of Achonry. Mandate as below. The recent petition of Thady Icluman, clerk, of the diocese of Achonry, contained that the late Thady, bishop of Achonry, with consent of the chapter, granted in perpetuity to him and his heirs, under a yearly payment of half a mark of silver of the usual money to the said bishop and his successors, certain pieces, belonging to the church of Achonry, of lands, heredities and possessions, with all their rights and appurtenances.
