Mandate—the pope having been informed by Felimy (Felemicus) Oloclahynd, perpetual vicar of Cyllmeoirmoir in the diocese of Tuam, that after the late John, archbishop of Tuam, had, on the voidance of the perpetual vicarage of Burges Voayll in the said diocese by the death without the Roman court of Cristinus Orilile, made collation and provision thereof by his ordinary authority to David Maclenyd, priest, of the same diocese, Lewis Ohubaen, priest, of the said diocese, after Martin V's confirmation of his predecessor's sentences etc. against simoniacs, made a bargain to the effect that if David would resign in his favour he would pay him a sum of money, which he did, upon which David resigned without having had possession to the said archbishop John, who, perhaps ignorant of the said bargain, admitted the resignation and made collation and provision to Lewis, who under pretext thereof took possession of the vicarage and detained it for some time, thereby incurring the said sentences etc.; that the said David has kept a woman as his concubine, by whom he has begotten children still alive, (fn. 2) has dilapidated the goods [of the vicarage] of the said church, and is involved in divers other crimes and excesses [not here specified]—if Felimy will accuse David etc. as usual, to summon David, and if they find the above to be true, to declare the said collation and provision to have been and to be null, and in that event to collate and assign the said vicarage, value not exceeding 4 marks sterling, to Felemicus; summoning and removing Malachy Oflangaen, priest, of the said diocese (who by his own temerity and without any canonical title took possession and has unduly detained it for a year or less) and any other unlawful detainer. Mandate (the pope having been informed by William Ochnachyd, clerk, of the diocese of Tuam, that Donald Mackheagayn, perpetual vicar of Kyllechan in the diocese of Elphin, has dilapidated goods of the said vicarage, is a notorious fornicator, and is involved in many other crimes [not here specified]) if William (who was lately tonsured, notwithstanding his illegitimacy as the son of unmarried parents) will accuse Donald etc. before them, as usual, to summon Donald, and if they find the above to be true, to deprive him, and in that event to collate and assign the said vicarage, value not exceeding 4 marks sterling, to William; whether it become void by such deprivation, or be void by the death without the Roman court of Tiernanus Miccagayn, or in any other way. To Master Vincent Clementis, S.T.M., a papal chaplain. Motu proprio collation and provision in consideration of his services, past and present, to the pope and the apostolic see, to him, who is a subdeacon and was recently sent to the pope as orator of Henry, king of England, of the parish church of St. Peter, Montfort (de Monteforti), in the diocese of Rouen, value not exceeding 600l. of petits tournois, which, on its becoming void by the death without the Roman court of John Pinchon, a writer and member of the household of the present pope, and also an abbreviator of apostolic letters, the pope granted, thus void and previously reserved, in commendam, first to Pasquerius, bishop [now] of Lisieux, then (tunc) of Meaux and afterwards of Evreux, to be held with the said sees of Meaux and Evreux respectively, and subsequently, upon Pasquerius being translated from Evreux to Lisieux, granted it in commendam for life to the late Lewis, cardinal priest of SS. Quatuor Coronati, by whose death the said commenda has ceased, so that the church is still void as above and reserved under the pope's late reservation of all benefices of papal writers and abbreviators. Mandate (the pope having been informed by Milerus Valentis, priest, of the diocese of Tuam, that David Valentis, rector of the rectory of the rural lands of Lochmesca in the said diocese, is lacking in learning, (fn. 5) is a notorious fornicator, and has dilapidated the goods of the said rectory) if Milerus will accuse David before them etc. as usual, to summon David, and if they find the above to be true, to deprive him, and in that event to collate and assign the said rectory, with cure and of the patronage of laymen, value not exceeding 6 marks sterling, to Milerus, who is uncertain as to who the true patrons are. Mandate to collate and assign to William Stok, priest, of the diocese of Tuam (whom, as far as regards the taking effect of these presents, the pope hereby absolves from any sentences of excommunication etc. under which he may be) the perpetual vicarage of Kyllbenayn in the said diocese, value not exceeding 5 marks sterling, so long void, by the death without the Roman court of Patrick Maccasyrlyd, that its collation lapsed to the apostolic see; whether it be void as stated, or by the resignation of the late Peter Ycormacan or the late William Ranny, or in any other way; notwithstanding that the pope recently ordered provision to be made to William of the rectory of St. Finian's, Cluoynard, in the diocese of Meath, of which he is not in possession, value not exceeding 24 marks, and previously of a benefice with or without cure, etc. in the gift of the archbishop of Tuam and the bishop of Meath, and the deans and chapters etc. of those churches. Mandate—the pope having been informed by William Ochonnochan, a canon of Achonry, that John Obcanhuchan (sic), perpetual vicar of Cluncocoll in the diocese of Achonry, recently seized violently and lacerated certain papal letters against the wish of Charles Micmcristin, priest, of the said diocese, by whom they had been impetrated, and has committed perjury and simony—if William, who is a priest and has for several years studied canon and civil law in a studium particulare, will accuse John before them etc. as usual, to summon John, and if they find the above to be true, to deprive him, and in that event to collate and assign the said vicarage, value not exceeding 6 marks sterling, to William; whether it become void by such deprivation, or be void by the death without the Roman court of Thomas Yc(h)onnochan, clerk, or by the free resignation of the above John, or in any other way; and notwithstanding that William holds a canonry of Achonry and the prebend of Cluncocoll and Killimarnada therein, value not exceeding 2 marks, and the provostship thereof, a non-major elective dignity with cure, value not exceeding 8 marks. Mandate to collate and assign to Florence Olochlaynd, priest, of the diocese of Kilfenora (to whom the pope lately ordered provision to be made of the archdeaconry of Kilfenora, a non-major dignity with cure, dispensing him, as the son of unmarried parents, great nobles, related in the first and second degrees of affinity and in the double third of kindred, to be promoted to all, even holy orders and receive and hold the said archdeaconry) the perpetual vicarage of Carudnaymygaynd in the said diocese, value not exceeding 5 marks sterling, void because Denis Mcgiruastair obtained it when holding the perpetual vicarage of Nona in the said diocese, and held them for more than a month against 'Execrabilis'; summoning and removing the said Denis, who has continued for other five years and more to detain unlawful possession of the said vicarage of Carudnaymygaynd, (ipso facto reserved to the pope by the terms of the said constitution), and on account of whose power Florence has no hope of obtaining justice in the city or diocese of Kilfenora; notwithstanding that Florence was recently violently despoiled of the said archdeaconry, whose value does not exceed 16 marks, and of which he had been for some time in possession, and that the pope has granted that he shall be restored to possession. Mandate—the pope having been informed by Maurice Olergussa, a canon of Clogher, that Felimy (Felemeus) Ofeddagan, perpetual vicar of Dompnachimagen in the diocese of Clogher, has committed perjury, is a notorious fornicator and, when under sentence of excommunication and publicly proclaimed excommunicate, has celebrated masses and other divine offices in contempt of the keys—if Maurice, who is a priest, will accuse Felimy etc. as usual before the above dean, to summon Felimy, and if he find the above to be true, to deprive Felimy, and in that event to collate and assign the said vicarage, value not exceeding 8 marks sterling, to Maurice; notwithstanding that Maurice holds together by papal dispensation the rectory of Tecalan and the perpetual vicarage of Lothey in the said diocese, value together not exceeding 7 marks sterling and has been received by authority of the ordinary as a canon of Clogher. Mandate—the pope having been informed by John Ocethenen, priest, of the diocese of Clogher, that formerly, whilst a suit was pending without the Roman court before a certain judge appointed by papal authority between Malachy Mescaym alias Memaghamna, [now] perpetual vicar of the parish church of Tedavnet (Sancte Dampnade), and Bartholomew Oluan, priest, of the said diocese, about the said vicarage, of which the said Bartholomew was then in possession, they agreed that Bartholomew, in order that Malachy might win the said vicarage, should give up the said suit and all right in or to the said vicarage, and that Malachy, after winning the vicarage, should permit Bartholomew to possess for life all the fruits etc. of the said church, in return for a yearly pension, after which agreement Bartholomew made the said cession before notary and witnesses, and Malachy gained a definitive sentence which became a res judicata, and by which the vicarage was adjudged to him and perpetual silence imposed on Bartholomew, Malachy inducted and Bartholomew removed, the said agreement being likewise carried out in respect of the said possession of fruits and pension, Malachy thereby committing simony—if the said John (who was lately dispensed by papal authority, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, after which he was ordained priest) will accuse Malachy etc. before them as usual, to summon Malachy, and if they find the above to be true, to deprive him, and in that event to collate and as ign the said vicarage, value not exceeding 5 marks sterling, to John, whom the pope hereby specially dispenses, on account of the said defect etc., to resign the said vicarage, if he obtain it under these presents, simply or or exchange. Lately, upon the expected voidance of the parish church of Kylmany in the diocese of St. Andrews by the promotion, made by the present pope, and the then future consecration, of James, [now] bishop of Dunkeld, to that church, the pope granted it in commendam to John, bishop of Brechin, to be held by him for life with the church of Brechin; after which, as some allege, the pope granted to the said bishop John a faculty to reserve the said church to his gift and to make collation and provision thereof, or to exchange it for another benefice, or otherwise freely dispose of it. Seeing that, as the pope has learned from the recent petition of king James, the said king believes that such commenda and faculty were the result of sinister information received from the said bishop John, and were otherwise fraudulently obtained, and seeing that, unless a remedy be applied, the said commenda and faculty will be the cause of scandals in Scotland, the pope hereby orders the above to annul the said commenda, and the said faculty, if any, and their consequences, and to collate and assign the said church, value not exceeding 45l. sterling, to Thomas de Spens, a canon of Glasgow, M.A.; whether it became void by the consecration of the above bishop James without the Roman court, or by the resignation of Thomas de Mirton, clerk, or be void in any other way; notwithstanding that the said Thomas de Spens holds a canonry and prebend of Glasgow and the parish church of Kyrckmichel in the diocese of Glasgow, value altogether not exceeding 40l. sterling.
