To Cormac Macdonchaid, a canon of Achonry (Akaden.), Donald Macnoglaid, a canon of Killala (Aladen.), and John Omulmochoiri, a canon of Ardagh (Ardachaden.). Mandate to collate and assign to Malachy Macgillakearan, perpetual vicar of Culdea in the diocese of Elphin (who was lately dispensed on account of illegitimacy as the son of a priest and an unmarried woman, by authority of the ordinary to be promoted to minor orders and hold a benefice without cure, and afterwards by papal authority to be promoted to all holy orders and hold another benefice even with cure, after which later dispensation he had himself so promoted and obtained the said vicarage) the perpetual benefice without cure called a rectory, instituted by papal authority in the parish church of Drumduban in the said diocese, and taking its name therefrom, whose rector receives certain tithes, fruits etc. within the bounds of the parishes of Culdea, Drumcolin, Killmicalan, Thammacha and Eacanach, in the said diocese, void by the death of Paul Ysomachan and value not exceeding 24 marks sterling; summoning and removing Thomas Obeanathan, Thady Ogamma and Cormac Macdonchaid, Augustinian canons of St. Mary's, Inchmacnerin (de Insula Macnere), who live without the said monastery, in divers towns (villis) and country places, and neglect to be present at divine offices therein, and also Tomultheus Macdonchaid, lord of the place of Tirnorioill, and certain other clerks and laymen of the said diocese, who, without any right or canonical title, have intruded themselves and detained possession for more than five years, as they still do, usurping and dividing its fruits and goods amongst themselves, and from fear of whose power Malachy has no hope of obtaining justice in the city and diocese of Elphin; whether it be void as stated, or by the resignation of the said Paul, or in any other way, and notwithstanding that he holds the said vicarage, value not exceeding 4 marks sterling. Mandate to collate and assign to Patrick de Brynnech, perpetual chaplain at the altar of St. Thomas the Martyr in the church of Moray, a priest, the perpetual vicarage of St. Giles, Elgyn, called the prebend with cure of 100s. (fn. 2), in the diocese of Moray, value not exceeding 20l. sterling, so long void, because James de Fores obtained when holding it the perpetual vicarage of Conwa in the said diocese, collated to him by authority of the ordinary, that its collation lapsed to the apostolic see; summoning and removing the said James who, as Patrick alleges, has since obtaining the said vicarage of Conwa detained for several years, against 'Execrabilis' and without dispensation, possession of that of St. Giles; notwithstanding that Patrick holds the said chaplaincy, without cure and value not exceeding 6l. sterling. To the dean and the provost and Maurice Oconchubair, a canon, of Killala (Aladen.). Mandate—the pope having been informed by Eugenius Ocunne, priest, of the diocese of Killala, that Rory Oluachaid, perpetual vicar of Kyllglasse in the said diocese (whilst a suit was, by authority of papal letters granted to Oluachaid, pending before certain judges without the Roman court between him and Rory Macgilladuib, priest, of the same diocese, about the said vicarage, provision of which had been made by papal authority to Oluachaid, and which both of them claimed) simoniacally bargained with Macgilladuib that if the latter would cede all right in or to the vicarage and give up possession of the vicarage to Yluachaid [sic], the latter would pay him a certain sum of money, which he subsequently paid, and obtained and has held possession of the vicarage for more than a year but less than two—if Eugenius will accuse etc. before them, as usual, the said Oluachaid, who, as Eugenius alleges, is also a perjurer, to summon Oluachaid etc., and if they find the above to be true, to deprive Oluachaid, and in that event to collate and assign the said vicarage, value not exceeding 6 marks sterling, to Eugenius. To the abbots of St. Mary's, Boyle, and Holy Trinity, Locchque, in the diocese of Elphin, and Tomoltheus Macdiarmada, a canon of Elphin. Mandate—the pope having been informed by Charles Omochan, clerk, of the diocese of Achonry (Akaden.), that Rory Omochan, priest, perpetual beneficiary called rector of the rural lands of Culofynd and Ranna in the said diocese, has dilapidated a number of the goods belonging to the said benefice and has committed simony and perjury—if Charles, who is of noble race, and who for fear of Rory's power cannot safely meet him within the city or diocese of Achonry, will accuse etc. Rory before them as usual, to summon Rory etc., and if they find the above to be true, to deprive Rory, and in that event to collate and assign the said benefice, of the patronage of laymen, with cure of souls (which is wont to be exercised by a perpetual vicar), and value not exceeding 5 marks sterling, to Charles, who is hereby dispensed to hold together for life the said benefice and the vicarage [not here named] which is to be collated to him by vigour of other letters [below, f. 44]. Mandate—the pope having been informed by the above Charles that, after provision had been made by the pope to Henry Omochan, priest, of the above diocese, of the perpetual vicarage of Killarchata (rectius Killarachta) in the same diocese, then void because Cormac Omochan had held it for more than a year without being ordained priest and without dispensation, the said Henry and Cormac made, under oath, a simoniacal agreement to the effect that Henry should have possession, that Cormac should not molest him, and that the fruits etc. should be divided equally between them for their lives—if Charles, who is of noble race, and who from fear of Henry's power cannot safely meet him within the city or diocese of Achonry, will accuse etc. before them, as usual, the said Henry, who has been in possession for between two and three years, to summon Henry, and if they find the above to be true, to deprive him, and in that event to collate and assign the said vicarage, value not exceeding 5 marks sterling, to Charles; whether it become void by such deprivation, or be void by the said non-promotion or by the death of Patrick Ymochan [sic], or in any other way. Mandate to admit by papal authority, for this time only, if they find it to have been lawfully made, the resignation which John Wricht has made before John Hog, clerk, of the said diocese, notary public, and before witnesses, of the perpetual vicarage of Muskylburg in the said diocese, and to collate and assign the same, value not exceeding 10l. sterling, to John de Douglas, priest, of the same diocese; whether it be void by such resignation, or by the death of Alexander de Kynglasse, or in any other way. To the abbot of Fearn (Noveferne) in the diocese of Ross, and John Urqhard, a canon of Ross. Mandate—the pope having been informed by Patrick Baldon, priest, of the diocese of Ross, that, after Martin V.'s reservation to himself and his successors of absolution from sentences of excommunication etc. incurred for simony, the late Henry Buge, priest, promised to give, as he afterwards did, thereby incurring the said sentences, a certain sum of money to Robert Ingerami, sometime canon of Ross, in order that Robert should resign his canonry and the prebend of Kyncardyn, and that they should be collated to Henry's brother, Magnus Buge, who was privy and consenting; that after the said Magnus, under pretext of a collation made to him by authority of the ordinary, had obtained possession, he, who had not been absolved from the said sentences etc., and Donald Malrcowlach (rectius Makcowlach), who was perhaps ignorant of the aforesaid, resigned, for purpose of exchange, the said canonry and prebend and the perpetual vicarage of Thayn in the said diocese, respectively, to the above Henry (fn. 3) who, having been, as he alleged, specially deputed for the purpose by the chapter of Ross, during voidance by the see, carried out the exchange, making collation and provision of the said vicarage to Magnus and of the said canonry and prebend to Donald; and that, under pretext of the said collation and provision, Magnus obtained possession of the said vicarage and still unduly detains it—to summon the said Magnus and others concerned, and if they find proof that the aforesaid is as stated, to decree by papal authority the collation and provision of the said vicarage, thus made to Magnus, to be null, and in that event to collate and assign the said vicarage, value not exceeding 9l. sterling, to the said Patrick. To the abbot of Kelsow in the diocese of St. Andrews. Mandate as below. The recent petition of Thomas Wythman, perpetual vicar of Malcarston in the diocese of St. Andrews, contained that on the voidance by the death of Thomas Penven the elder of the perpetual vicarage of Wiston in the diocese of Glasgow, Thomas Penven the younger (to whom provision had been made by papal authority of the parish church of Lochmaben in the said diocese of Glasgow, whereof he had not got possession) accepted within the lawful time, in virtue of certain letters of the pope, the said vicarage, thus void, and had provision made to him thereof. Seeing that as soon as by the said letters and acceptance etc. he obtains the said vicarage, the said church of Lochmaben and all his right in or to it will become void, the pope orders the above abbot to reserve to his gift, for collation to the above Thomas Wythman, if found fit, the said church, value not exceeding 50l. sterling; notwithstanding that he holds the said vicarage of Malcarston, and that the pope lately ordered provision to be made to him of the perpetual vicarage of Carthkert in the said diocese of Glasgow, which was to become void in a certain way, the value of each not exceeding 20l. sterling, both of which, or Malcarston and all right in or to Carthkert, are to be resigned upon his obtaining Lochmaben. Mandate (the pope having been informed by Neneas [sic] Macgyllacosghy, a canon of Clogher, that Donald Ofiaig, priest, rector of St. Senach's, Derrybrusk (de Arymbrosca), in the diocese of Clogher, has publicly kept a concubine, dilapidated goods of the said church, and committed perjury and other crimes) if Nemeas (who was lately dispensed by papal authority, as the son of a priest and an unmarried noblewoman of a race of dukes, to be promoted to all, even holy orders and hold a benefice even with cure, and whom the pope has dispensed to receive and hold a canonry and dignity etc. of the church of Clogher, in the event of such being collated to him in virtue of other letters by which the pope has made provision to him of a canonry and ordered provision to be made to him of the said dignity etc.) will accuse etc. Donald before them, as usual, to summon Donald etc., and if they find the above to be true, to deprive Donald, and in that event to collate and assign the said parish church, value not exceeding 6 marks sterling, to Nemeas; notwithstanding that he was lately, in virtue of the pope's said other letters, received as a canon of Clogher.
